AGENDA 4/12/76 Council mooting:
Item 4. Melby subdivision meets Planning Commission stipulations;
recommend approval with requirement of grade plan before
issuance of :.wilding permit.
Item 5. Recommend accept Planning Commission stipulations for Meschkau
subdivision: require 5 -foot utility easements on back lot
lines and removal of shed before signing of deed.
Item 6. Recommend accept Planning Commission stipulations for Sakariason
major subdivision; development contract should be required
to assure removal of existing house and garage by July 1 or
when he moves into his new home.

Item 12. Memo from park director on general diseased tree removal
contract enclosed; recommend accept his suggestions including
designating alternate contractor. AAA has had some problems,
not excessive, but we want to be able to use another firm if
problems arise.

Item 14. Recommend reappoint Jack Shields full -time tree inspector as
of March 23 to terminate October 15, 1976, wage $4.40 /hour.

CITY OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
A regular meeting of the Mounds View City Council was called to
order by Mayor Johnson on April 12, 1976, at 8:15 p.mr, at Mounds
View City Hall, 2401 Highway 10, Mounds View, MN 55112.

MSP (Baumgartner Shelquist) to approve the minutes of March 22, 1976,
regular meeting. 5 ayes
Citizen Comments and Suggestions. Dennis Smith, 5557 St. Stephens,
suggested that there should be a sidewalk between Quincy and Long
Lake Road on County Rd. I. He has no peition yet. Mr. Gustafson,
County Rd. I and Long Lake Rd., suggested they widen the street and
the speed limit should be reduced to 30 mph. After the blacktop is
there put a white line and designate that this is the bicycle and
pedestrian area. Something should be done before somebody gets
hurt. There are also no street lights. Don McNamara, 5551 St.
Stephens, stated that the kids have to walk four blocks on County
Rd. I and when it is plowed they are practically in the traffic.

Mayor Johnson suggested researching the question to see if MSA funds
could be used. He would not want to jeopardize any funds but check
and get a reading on it.
Dennis Smith said that if they had it on the one side it would help.
Currently the women are forming a walk patrol to escort the children
to school.
Mayor Johnson stated that the problem is how to fund the project.
Further, you are going to have to have a petition from the residents
in this area.
Mayor. Johnson recessed the regular meeting at 8:30 for the public
hearin• on Selmer Sakariason ma'or subdivision re•uest for property
on Sunnyside Rd. between Ardan Ave. and County Rd. J.
Charles Buzzel, developer, stated that this is a subdivision of five
lots on Sunnyside. Presently there is a home and an out building
on the premises that will be removed. Lots will be 81 x 236.

Admin. Achen stated that the Planning Commission approved the plat.
The major question involved is when to require removal of the
structures. We have to assure that the house is removed without
imposing too stringent conditions upon the property owner: Planning
Commission recommended July 1.
Mayor Johnson inquired as to whether he would enter into a develop-
ment agreement with the city and a bond, so that the city can be
assured that it will be removed.
Mr. Buzzel said that had not been raised before so we haven't
given it any consideration. Mr. Sakariason has been waiting on the
outcome before he relocates. The whole thing is conditional upon
the approval of the subdivision. He is assured that I have a buyer
and he has received a down payment.
Mayor Johnson explained that the only reason we have a bond is to
act as an impetus to make sure that you have the home removed by
July 1. Mr. Buzzel said that he would agree to that.
Atty. Meyers stated that the Council cannot approve a subdivision
that creates a violation of our subdivision ordinance. Admin. Achen
asked if the contract could be made airtight to meet the city's
requirement so that the sale can go through prior to the filing of
this plat. Approval would be on the condition that the buildings
be removed. That way you would protect the buyer, the seller and
the city.
Atty Meyers stated that he could only envision a development contract
and posting a bond for an agreement where the city could go in and
demolish the building.
Mr. Buzzel stated that they hoped to break ground on the 25th of
this month. The buyer's home is already sold and the financing
of this new home has a deadline of July 1. If it isn't granted he
cannot get u building permit which would hamper building of the home
on Lot 1.
MSP (Johnson Hodges) that we approve the major subdivision of Selmer
Sakariason for property on Sunnyside Rd. between Ardan Ave. and
County Rd. J, subject to the home being removed on the proposed
Lots2 3 and the garage being removed on Lots 3 4 prior to final
approval of the proposed major subdivision and the recording thereof.

Sakariason at 8:45 p.m. 5 ayes
Mayor Johnson called to order the public hearing on the updating of
the Mounds View Comprehensive Plan at 8:46 p.m. Tne public hearing
was then recessed and the Council went back to the regular Council
meeting to hear more citizen requests.

Jim Benolkin, 7781 Groveland Rd., spoke regarding sudden enforce
ment of the state motorcycle ordinance. The village has cut us
off completely and we want to know why. Our understanding is we
cannot ride without getting a tag. The police came to the field we
were riding in and showed us a paper to that effect. Admin. Achen
stated that is a -state law and not a city law.
Mr. Benolkin said that the owner of the land said it was fine to
ride as long as we don't start a fire. We have talked to other
people and they have specific areas in the city designated for them
to ride by the city. Mayor Johnson told him that if it is not
our property we cannot designate that as a place to ride. We have
had calls about excessive noise. Mr. Benolkin replied that they
could put mufflers on and then it would not be noisy. They do not
ride close to the apartments and the traffic makes more noise than
the motorcycles.
Atty Meyers stated there are two laws involved: public nuisance and
permission from the owners of the property.
Mr. Benolkin asked if the city could give them a designated area.
A young man stated that a police officer had told him that the Scot-
land Green apartments were complaining. Atty Meyers told him that
they have this right.
Gene Evans, 5395 St. Stephen, stated that he was against motorcycles
unless driven in a designated area. If one of his grandchildren
stepped in front of them what is going to happen? He stated he has
tried to talk to them nicely and have been told to go to hell. A
percentage of bad ones are spoiling it for the good ones. He suggested
forming a cycle club and let them enforce the others. Mr. Gustafson,
County Rd. I and Long Lake Rd., said that he gave permission to kids
to run on his back lots. The neighbors complained and it was very
noisy. He also had a great rut in the ground.
Mayor Johnson stated that they ought to try to get permission to ride
where they want to ride. If you can't get permission, come up and
talk to the park director and maybe he could find a place for you to ride.
At 9:10 Mayor Johnson recessed the regular meeting again and called to
order the public hearin o the u of the Mounds View Comprehensive
Plan. Mayor Johnson explained that the Planning Commission and the
City Council have spent ma ,.y hours working with a professional planner
to revise, change and update the current plan. The purpose of this
meeting is to hear comments and questions on the new comprehensive
plan. He opened the meeting asking for questions from the floor.
Jerry Fahrmann, 7448 Spring Lake Rd., stated that he hadn't seen the
plan but wanted to know where there is a new development of any kind,
if there are provisions for holding water. Mayor Johnson replied
that thereis presently a drainage study being made of the city. The
Council is very mindful of this problem. Mr. Fahrmann stated that
what he had in mind was holding ponds. Could you design the drainage
for each area individually? Councilman Shelquist stated that when
Mounds View Square was developed the Rice Creek Watershed District
instructed them to hold the water, and last spring this was proven to
be disastrous but that might have been an unusual situation. Rice
Creek may be turning their ideas around. About $35,000 of revEnue
sharing is being spent to get an idea where the water drains and a
recommendation as to what can be done.

Mr. Fahrmann asked regarding the low areas are they going to be
filled in? Mayor Johnson replied that many low areas have been
designated as flood plain areas so cannot be used for development
purposes.
Paul Veneer', Roseville, stated that his land is zoned commercial.
In looking at a copy of your comprehensive plan it appears to be
changed and he very much objects to that. Mayor Johnson stated
that this does not change any zoning at all. From a planning
standpoint it tells us what really should be the uses of the open
land in the city. He illustrated on the map to familiarze the
people with what they were trying to obtain.
Robert Glazer stated that he would like to see the City take a
more forceful position in opposition to any future upgrading of
Red Oak Drive, along with construction of an interchange at Red
Oak on new Highway 10. Mayor Johnson stated that future development
of new Highway 10 is still in the planning stages and, apparently,
some time away. He indicated that the Council has on several
occasions written to the various local and state officials indicating
the City's opposition to any plans for an interchange at Red Oak.
Mr. Gustafson inquired as to how much control does the Metropolitan
Council have? Mayor Johnson replied that this plan has been
reviewed and approved by them. As a practical matter they had
little to say about it.
Councilman Baumgartner stated that if someone wanted to build a
500 home development without a sewer that would be significant
and the Metropolitan Council would look into it. Changing water
courses would be another item. Councilman Shelquist stated that
the legislature has instructed them to help communities develop
comprehensive plans. They demand that every community within the
7 county district come up with a comprehensive plan. Our plan
reflects what we think Mounds View should be doing in the next
few years.
George Gustafson asked when the open meetings were held and Barbara
Haake replied that letters were sent to all land owners, notices
were put in papers, etc. In total about 125 citizens availed
themselves of the public hearings. We were only required to have
one hearing.
Mayor Johnson stated that the Metropolitan Council has indicated
that there are certain things we should be changing, so we will
have to have another public hearing to talk about the changes.
It is better to adopt the plan conditionally upon the changes being
put into it, thereby not having to go through another public hearing.
Councilman Shelquist stated that the Planning Commissic., should
change it as changes are merited. If it requires another public
hearing then we should hold one at that time.
MSP (ShFlquist- Baumgartner)to adopt the revised Comprehensive Plan,
Resolution #727, as submitted to us in the printing of July, 1975,
by Midwest Planning and Research. A roll call vote was requested:

Mayor Johnson thanked the Council and the Planning Commission and
adjourned the special hearing and called back to order the rea:ular
Council meeting at 10:00 pm.
There was an inquiry regarding the ticketing of "funk" vehicles.
Mayor Johnson stated that the administrator should be directed to
inform the police department that, until the unlicensed vehicle
problem is worked out, that they should hold off further enforcement
of that particular ordinance.
Councilman Baumgartner stated that that should specify only those
vehicles involved in insurance cases.
Mr. Gustafson, County Rd I and Long Lake Rd, stated that the ordinance
should be amended to stated just what is junk and what isn't.
Councilman Shelquist said that he didn't think we want to suspend the
tagging of junk vehicles. The police department has to make a value
judgment, which is a problem. He would suggest that the police department
not issue final tags on recreational vehicles until this problem is
resolved. Antique cars should also be addressed.
Councilman Baumgartner stated that consideration should be given to people
who have sons in the service and are keeping their cars for them.
Atty Meyers stated that we have had people that are in no different
situations that have had to pay fines.
Councilman Pickar recommended a temporary moratorium on tagging all
unlicensed vehicles for a two week period.
MSP (Shelquist Baumgartner) that the police department be instructed
to suspend issuing tags on recreational vehicles which are stored and
not currently licensed pending consideration by the Council of the
means of providing for these vehicles in the ordinance, with the
stipulation that where such vehicles are that they be watched to be
assured that they are licensed at least once each year. 4 ayes

Councilman Pickar suggested putting a temporary moratorium on all
unlicensed vehicles until Ad. Achen has had a chance to study and offer
a recommendation and felt that, in the above motion, only a part of the
problem was covered. His neighbor has had his race car ticketed.
Ad. Achen said that he would have something at the next agenda meeting.
Councilman Shelquist stated that a provision for a special use permit
and having the vehicle in a garage should take care of the problem.
We have to decide whether we are going to enforce the ordinance or take
it off the books. Perhaps we could amend it to require a covering with
a tarp.
Nancy Burmeister stated that there is a problem with insurance. The
recreational vehicle is always subject to vandalism.
Councilman Shelquist stated that you are talking about liability vs
comprehensive insurance.
Ms. Burmeister stated that you are varying from the law when you have
a moratorium for two weeks.
Councilman Pickar stated that if a question came up on an ordinance he
would do the same thing again. Other forms of government do.
MSP(Pickar- Johnson) for a temporary :moratorium on all unlicensed
vehicles until Ad.Achen has had a chance to study the situation and has
offered a recommendation. A roll call vote was requested.

Harvey Melby, Sr., minor subdivision request for 8371 Eastwood Drive.
Ad. Achen stated that the Planning Commission approved this request
with the stipulation that an existing swimming pool and driveway be
removed prior to issuance of a building permit.
Mr. Melby said that the swimming pool has been removed and he has made
a driveway out the back onto Greenwood and they are using it. He requested
that the village take care of the assessments on Greenwood. The
building inspector said he would have gravel brought out to 8372 Greenwood
Mayor Johnson inquired as to what system the city has to follow up to
make sure that what we say should be stipulated is done.
Ad. Achen replied that it is in the file if the Council takes any action.
Perhaps the city could set up another filing system for the city lots.
MSP (Shelquist- Hodges) to approve the lot division for Harvey Melby, Sr.
at 8371 Eastwood Drive, as recommended by the Planning Commission in
their March 24, 1976, minutes. 5 ayes

Ad. Achen stated that the Planning Commission recommended approval
with the stipulations requiring 5 foot utility easements on the back
lot lines and removal of a shed before the signing of the deed.

for Arthur Moschkau for 8330 Long Lake Rd, conditionally upon the receipt
of a five foot easement on the back lot lines and removal of the shed

Receive petition for construction of Edgewood Drive between Hillview
Road and County Rd I. Mayor Johnson stated that he thinks it is fine to
have a public hearing but we should have the drainage study first.
Councilman Baumgartner asked if we could have the public hearing after
receipt of the drainage plan?
Mayor Johnson said that they would keep the petition on file until the
storm water drainage study is in. Mr.Eigenheer, 7860 Edgewood Drive,
submitted the petition.
MSP (Johnson Baumgartner) that we delay further action on this until
receipt of the storm water study. 5 ayes
Dwight Kasperbauer,5085 Edgewood Rd, asked if the Selmer Sakariason
matter could be readdressed.
Mayor Johnson asked what was to be reconsidered?
Mr. Kasperbaur stated that he was the individual who wants to build on
it and he would like his agent to discuss this briefly.
Ken Sjodin, agent for Mr. Kasperbauer spoke: When they met with the
Planning Commission they said that this would be approved conditioned upon
removing the garage by June 30.
Atty Meyers said that this was not approved by the Council, just set a
public hearing.

Mr. Sjodin asked if this couldn't be approved conditionally to avoid
undue hardship. There should be some provision to accommodate a
situation like this. It is obvious that the building is being torn
down.
Mayor Johnson told him that if he tears down the building within two weeks
go ahead and bring in a hardshell copy to the Council in two weeks.
Ad. Achen told him that the letter he was sent explained this all to him.
It was delayed three months before the city got it.
Mr. Sjodin asked if there was a way to facilitate it?
Atty Meyers told him that he still doesn't have a plat. Right now we
cannot allow two houses on one lot.
Ad. Achen suggested that an alternative would be to revise the plat
and eliminate Lot 3.
Mayor Johnson asked how quickly they could have the house torn down?
Mr. Sjodin stated about 10 days, maybe.
Mayor Johnson told him he could have the final plat signed and approved
by combining Lots 1,2, and 3 and Lots 4 and 5.
Mr. Sjodin asked if they could just subdivide Lot 1 now and proceed
with the rest later.
Councilman Shelquist told him that he would be subjecting himself to
more hearings before the Planning Commission and additional fees.
MSP (Shelquist- Hodges) to recnnsider the Selmer Sakariason subdivision.

MSP (Shelquist Baumgartner) that we approve the Selmer Sakariason subdivision
as previously stated and with the conditions previously attached to it,
but that in addition we approve an alternative subdivision of the parcel
into two lots, one lot consisting of the platted Lots 2,3,4 5 and
the other lot being platted Lot 1, the final determination to be made
by the subdividor at the time of submission of the hardshell plat.
There will be additional fees because of a new hearing with the Planning
Commission. A roll call vote was requested.

Proposed development control ordinance. Mayor Johnson stated that it
was determined to be advisable to put the development contracts into
effect. Atty Meyers stated that he had inserted some changes in the
ordinance.
MSP (Hodges Pickar) to approve Ordinance 247. 5 ayes
Proposed revision of Chp. 42, Subdivision regulations. It was decided
to lay this matter over until the next Council meeting.
There is a recommendation from the Park Director to award the tree removal
contract for tree removal at Edgewood Jr. High to AAA Tree Removal
Service. The school district has requested that we contract for the
tree removal since we have a forester and they will pay for it.

Councilman Shelquist asked if the contract is signed and if the work is
done inadequately are we liable?

staff.
MSP (Johnson Hodges) that we award the contract to the AAA Tree Removal
Service >for removal of a diseased tree on the Edgewood School
property for $8,630 conditioned upon receipt of a valid bid bond and
also on the condition of receipt of a performance bond equal to 150%

Councilman Baumgartner suggested that we investigate Mr. Kicker to see
if there are any problems, as last year we turned down 3 similar license.

Mr. Teslow stated that he has written permission from the owners.

Councilman Baumgartner suggested that the staff investigate a method
of giving the check back if a recreation class is not filled, but Atty Meyers
said that he thought everything nas to be processed, but they should
check with the auditor.
ADMINISTRATOR ACHEN'S REPORT:
Appoint delegates to Ramsey County League of Local Govts.
MSP (Hodges Shelquist) to appoint Gerald Johnson, Council delegate (voting
Roger Baumgartner, Council delegate (alternate voting) and Mark Achen,
appointed staff delegate to Ramsey County League of Local Govts. 5 ayes
Park five -year capital improvement plan.
MSP (Baumgartner- Johnson) to receive and approve the park and open
space five -year capital improvement plan for Mounds View as presented
in the memo of February 22, 1976. 5 ayes
Schluter Brogger final plat. Ad. Achen stated that the plat has been
reviewed and is in conformity with the preliminary plat as approved
by the Council.

MAYOR JOHNSON'S REPORT
Mayor Johnson read a letter from Rep. Nelsen thanking the Council
for their cooperation during the last legislative session.
Further, he stated that someone should attend the League of Municipalities
Convention in Duluth in June. He instructed Ad. Achen to make
reservations for two people.
COUNCILMAN HODGE'S REPORT
None
COUNCILMAN BAUMGARTNER'S REPORT
Councilman Baumgartner called to the Council's attention the write -up
in the news letter concerning the activities in the parks. He also
stated that Greenfield park is progressing.
COUNCILMAN PICKAR'S REPORT
He feels that all traffic should stay off while the grass is taking seed
and will have kids drop hand bills to that effect. Lakeside Park
met last Thursday. The beaches will open June 12 and he has made
arrangements for the guards and a superintendent. Also suggested
possible vandalism coverage of $1400.
COUNCILMAN SHELQUIST'S REPORT
The Planning Commission will meet Wednesday at 7:30 pm.
ATTORNEY MEYER'S REPORT
A reminder that we have some excess property as a result of certain
takings in 1973 -4. Equivalent to about 8 lots. Further, he would
like authority from the Council for the claim for the municipal building
to retain services of necessary experts fox evaluation and testimony:
specifically a real estate appraisor, ground water engineer and the
duties of an architect.
MSP (Johnson Shelquist) that we authorize the attorney to retain the
necessary consultants to determine the damages that we have suffered
and to proceed with the claim against various people involved with the
construction of our city hall but that he keep us informed as to the
progress and costs incurred. 5 ayes
Atty Meyers also stated that the assessment appeal has been t-ied
but there has been no decision rendered yet.
ENGINEER BEARDEN'S REPORT
He stated that he wrote a letter outlining the alternatives on the
Mounds View Square ditch. The attorney's recommendation is to go to
the bidding procedure.
MSP (Pickar- Hodges) to direct the engineer to prepare plans and
specifications advertising bids td finish shaping of the ditches
and sodding them, etc., and to finish the Long Lake Road ingress and
egress. 5 ayes

Councilman;Shelquist stated that last Thursday a pickup truck went
into the ditch on Highway 10 at Mounds View Square. Perhaps the
state should come in and put a railing or something

It was suggested that this be postponed until the next regular Council
meeting. Mayor Johnson directed the administrator to get everything
checked into and present it to the next meting.
