A regular meeting of the Mounds View City Council was called to order
by Acting Mayor Hodges on July, 12, '1976, at 8:00 pm, at Mounds View
City Hall, 2401 Highway 10, Mounds View, MN. 55112.

There were no citizen comments or requests.
APPROVAL OF CONSENT AGENDA
Ad. Achen asked that Item B be removed from the consent agenda
with regard to B. Glommen Sno-Kones as the Dept. of Agriculture
has to license them.
MSP (Baumgartner Pickar) to approve the following consent agenda
items. with the exception of Item B: 4 ayes
ITEM A. Approve, as recommended by Planning Commission, minor subdivision
request of Floyd and Edna Visger to create two lots from existing prop
erty located at 7815 Woodlawn Drive. East lot to be 125.0 feet frontage
and 131.39 feet deep; west lot to be 12.0 feet frontage and 162.0
feet deep. Five foot utility easements to be provided on back lines
of both lots.

The administrator stated he was going to take this area back to the
Planning Commission to clarify it. Perhaps they should review it
and -:make a recommendation to the Council.
Councilman Shelquist said that Mr. Gustafson had stated that he had an
architect looking at the rest of his lots and he replied that we
hired him to come up with something.
Councilman Shelquist said that you anticipate coming back before us
then. Did he withdraw the additional lots? I still question the
kind of fee that he paid.
Councilman Shelquist stated that that is the point. You started develop
ing your land in one mode and now you are trying to change it.
Acting Mayor Hodges stated that we want to work with you and we will
talk to and direct our Planning Commission to look into the overall
plan for the area and ask you to work with them.
The administrator told tie citizens present that if the Planning
Commission does reconsider the comprehensive plan that their input would
very beneficial to them.
Mr. Houle stated that he appreciated 'Tr. Gustafson's problem but he
has benefited because the price of land has gone up. He is not hurting
that bad..

The administrator stated that this is the "ounds View Square Shopping
Center drainage. Since the puilic hearing there has been indications
of severe erosion. The staff prepared for Council consideration a
proposal to tile only that section of tne ditch adjacent to the SE
holding pond. The Council needs to make a decision on what it plans
to do. Similar plans have been prepared for a project less than
originally proposed and in accord with the staff report at the agenda
session.
The Administrator stated that he filled out one application and conferred
with the Planning Commission but he did not revise the application.
Mr. Gustafson stated that it all seemed like discrimination to him. H
is just trying to get out from under the taxes: He does not want to
lose his land.
John Bearden prepared the final plan :7 with the thought to extend the
culverts onto either side to get a lesser slope. Since that time the
fhoppinr Center has put in a bituminous curt;.

Engineer Bearden explained the plan. He estimated the whole job
for construction costs would be $12,800. If you put the pipe in it
will be $400 more.
Councilman Baumgartner recommended putting the pipe in.
Councilman Shelquist asked if they were going to build the ditch up
Over the pipe or what? Engineer Bearden replied that the ditch
would be filled about four feet. On the open ditch the cost
estimate includes sodding the soil. Every place that there is
an open ditch it will be all sodded. In a flat ditch it will
be seeded. There won't be any extensive slopes that will be
seeded. The Highway Dept. thought that maybe the pipe in there
would be the better answer. From this point on I doubt if it would
be 25 probably 15 depending on problems that may come along.
Councilman Shelquist stated that we ought to put the pipe in all
of the way between Long Lake Road and the southeast access because
the major concern is the danger of a car going into that ditch.
MSP Shelquist- Baumgartner) to order the improvement identified as
the July 1976 revision of the preliminary report of May 1976 as
amended 7- 12 -76, accept the final plan and specifications for the
project, and instruct the administrator to advertise for bids to be
opened at 11:30 a.m. July 26.
Jerome Casey, 7750 Greenwood Drive, stated that your current intent
is to assess the shopping center?
Atty. Meyers stated that there is no other way unless they abandon
the whole project and start over.
Mr. Casey said that Attorney Frisch either said that they would be
willing to accept 100% if the price were lower, or at any cost they
would accept limited liability.
Atty. Meyers stated that it doesn't matter. The only question
before the court will be the assessment hearing. The Council prepares
a proposed assessment and has a public hearing on it and ultimately,
after reviewing it, adopts the assessment. Then they can appeal.
Mr. Casey stated that several of them are suing the shopping center
themselves and they don't want any action the Council will make that
will jeopardize them.

the B. Glommen Sno -Kones and to waive the fee for Prs. Marilyn
Gum, 7805 Greenwood Drive. 4 ayes
REPLACEMENT OF MAYOR JOHNSON
The administrator stated that they are asking for people to submit
by noon July 26, 1976, names of those interested in the Mayor's job
or the Council job. Interviews will be conducted July 29, 1976,
at '7:00 pm.
MSP (Hodges- Baumgartner) that John Picker's name be added to the list
to sign the checks for the City. 4 ayes
PUBLIC HEARING ON ROSENQUIST ADDITION
The regular Council meeting was recessed and the Public Hearing
called to order at 8:10 pm. The administrator stated that the
Rosenquist Addition extends from Spring; Lake Rd to the West City
boundary. They have asked for a subdivision into 3 lots; 2 on the
East side of Pleasant View Drive and one on the West side of Pleasant
Drive, and to create two outlots. The Planning Commission has
recommended approval and the staff recommends that the outlots not
be allowed to be created because they are substandabd.
Mrs. Bonin, 8360 Pleasant View Drive, stated that it would not be an
outlot;it would be transferred onto her property.
Ad. Achen stated that once that is created it is still a separate
piece of parcel and would have to be taken off the county records as a
separate parcel.
Atty Meyers stated that they could add it on to the lot instead of
calling it an outlot. The plat would include Mrs. Bonin's lot also
but it would be expanded to include the outlot.
Ad. Achen stated that the staff recommenec,d that Outlot B be made
a part of Block 1. The problem is they would pick up 80 feet more of
assessments. It would be an economic advantage to having it go to back
taxes.
Ken Sjodin said that he had talked to the man who owns the land directly
to the East and there is no chance of buying it. From the citizen's
point of view this is obviously the only way of platting it.
Ad. Achen said that there is no simple solution. We either protect
the City or reduce the cost to the property owner. Is there any way
that that assessment could be deferred?
Atty Meyers replied that that is legal in certain circumstances
Mr. Sjodin stated that if the outlot is left on you still have the
assessments that have to be paid some time. If you do it that way they
have lost the potential of buying that 80 feet from the other owner
where they could have realized a sale. From the City's point of view
he did not feel it would go back to back taxes.

The administrator stated that if he were the property owner it would
be the.wisest thing to just not pay taxes on it. Could at least
defer payment of the taxes until the time when they have to be paid.
Mrs. Bonin stated that during the whole process ,f building the lot
she was told that they could not be assessed above the benefit that
is received from the property. If the lot is not buildable it is
no benefit.
Atty Meyers stated that that is the one consideration the Council has
to face on the grounds that the City created this problem. They
may have to either allow it or have some kind of deferment plan.
Mrs. Bonin stated that she would like to see a deferment until the
other property can be purchased.
Atty Meyers stated that he would recommend a deferment to the Council
if they agree to this.
Councilman Shelquist stated that if nothing is done with that outlot,
it will increase the temptation not to negotiate a price.
Mr.Sjodin stated that times have changed and land does not go back to
taxes like it used to.
Atty Meyers stated perhaps a deferment with a time limit.
Mrs. Bonin stated that if that is the case they won't ask for a
deferment, it would not be a solution to let the interest accummulate.
Mr. Sjodin stated that in effect putting the assessments on this
property did not benefit the present owner. It is making the property
worthless.
Atty Meyers stated that he preferred a deferment only because we have
a handle on the situation.
Mrs. Bonin asked if there was any way they could make a deferment and
eliminate the interest.
Atty Meyers stated that possibly we could certify it to the county.
Councilman Baumgartner asked if there was some way that Mr. Meyers
could get together and talk about the deferment and the legal aspects.
Councilman Shelquist asked the possibility of negotiating with the land
owner and Mr. Sjodin replied that he has approached him twice, but
from his past experience he knows that people change their minds and
maybe he will realize this is the proper thing to do. The situation
right now is that they cannot purchase it. To not approve this or
to approve it and let the interest rho on the assessments would be an
undue burden on the citizens.

Acting Mayor Hodges asked the Council what they would like to do on
the matter.
Councilman Picker: Would like to see some way where we could approve
this. They are entitled to a lot split; would like to come back and
see if there was some way the assessments could be accummulated without
interest with Outlot B as it is and Outlot A as previously recommended.

Councilman Shelquist stated that he dislikes the situation but will
go along with it that way. He would like it referred back to the
administrator to negotiate with the Rosenquists to replat the land,
including Outlot A; in addition getting proper wording cn the deed
that Outlot B would have the restriction in the title "abatement
of the assessment for two years or some reasonable time
Councilman Baumgartner stated that he agreed with Councilman Shelquist.
He would also suggest that Outlot B be made an outlot and hope that
he negotiates with the land owner. Have Outlot A as discussed before
and leave Outlot B as it is and not have it as being deferred as the
interest probably cannot be waived.
Acting Mayor Hodges stated that this should be referred. He agreed with
the lot splits, but something should be worked out for deferred
payments.
Atty Meyers stated that there are two issues here: deferred assessment
and whether you want to waive interest.
MSP (Shelquist- Baumgartner) that we refer the subdivision back to the
administrator for negotiation of terms for a temporary abatement of
assessment and deferment of interest on Outlot B and for negotiating
of Outlot A into the Bonin property.

PUBLIC HEARING ON LEROY'S ADDITION
Acting Mayor Hodges called the Public Hearing on LeRoy's Addition
to order at 8:50 pm. The Planning Commission recommends approval of
LeRoy's Addition (applicant: LeRoy Johnson) with the requirement
that existing structure be removed from Lot 1 before approval of final
plat. The staff recommends accepting the Planning Commission's proposal.
The two new lots will be provided service from the front underground
utilities.
MSP (Baumgartner Shelquist) to close the public hearing. 4 ayes
Councilman Pickar stated that he approved of it in concept the way
that he has it. We should run it through the engineer to determine
whether any easements are required.
Councilman Shelquist stated that he approved in concept subject to an
easement on the south lot line being determined necessary by the
engineer.
Councilman Baumgartner stated that the possibility of an easement along
the rear lot lines exists.
Acting ?Mayor Bodges stated that he concurs.

MSP (Pickar Shelquist) that we approve the preliminary plat of LeRoy
Johnson with the requirement that the existing structure be removed
from Lot 1 before approval of the final plat and that the plat be
referred to the city engineer to determine whether any easements
of any type are required.

PUBLIC HEARING ON PRECINCT BOUNDARY CHANGES
Administrator Achen outlined the proposal to the citizens. He stated
that one of the problems with changing the boundaries is finding places
for polling. Council cannot take action on this until after the
November election and so another hearing will be held.
Mr. Blanchard stated that one of the reasons for moving the voting
place out of Messiah Lutheran Church was because voters did not like
voting in a church. The could vote in a garage.
PUBLIC HEARING ON REQUEST OF E. E. GUSTAFSON
The public hearing on the request to rezone Lots 4 -7, Block 3 of
Greenfield Plat 2 (applicant: E. E. Gustafson) was called to order
at 9:15 p.m. Admin. Achen explained that this proposal is to rezone
from R -1 to R -2 which the Planning Commission recommends.

Admin. Achen stated that it is against the law to have voting in a supper
club. Councilman Shelquist suggested the warming houses but was told
that they are unacceptable as there is not enrugh room_
Acting Mayor Hodges asked for other comments. There being none,
MSP (Hodges Shelquist) to close the public hearing. 4 ayes
Stu Rothgeber who is in partnership with Mr. Gustafson, stated
that rezoning of Lots 4, 5, 6 7 is the request. They originally asked
the Planning Commission to rezone to R -2 to allow development of
four double bungalows on the lots as they exist. The Commission
turned this down. The Commission wants 100 foot lots while the
existing lots are only 80 foot. What we are asking for is to
rezone this land to allow us to put two double bungalows together on
each 100 foot lot. Atty. Meyers told him that this requires R -3 zoning,
not P -2.
Dennis McGuire, 7628 Greenfield, stated that the notice says from R -1
to R -2 doesn't say anything about R -3. Atty. Meyers said
that the Planning Commission's recommendation was for R -2.
Mr. Rothgeber stated that they have changed the request and the
Planning Commission has not considered this proposal at all. He
stated that under the Comprehensive Plan this land is for multiple
density.

Mr. Gustafson stated that when they started out they were asking
for medium density. This would constitute rezoning it from R -1
to medium density. This would also correspond to the City Ordinance-
It complies in every way with the ordinance, the Planning Commission'
and the Metropolitan Council.
Acting Mayor Hodges stated that we put out a notice to go from Rl to
R2 and if this should be a R -3 type of hearing they would have to
go through it again.
Atty Meyers stated that you still made a specific rezoning request.
If you are getting an R -3 you may have to go through the whole thing
again. The only thing they can consider tonight is an R -2 rezoning
request. The Planning Commission recommendation is based on R -2.
If you want an R -3 put it through the Planning Commission again. You
have to make up your mind which way you want to go.
Mr. McGuire stated that he purchased the home last August and he was toll
that it was zoned residential and that is the way it would stay.
One of the reasons he bought the home was because of that. First you
are talking about double bungalows -than four plexes, what comes next
We have problems anyhow with the apartments around us. We will be

Helen Houle, 7643 Edgewood, had questions regarding Lot 3.
Mr. Gustafson stated that he has owned this land for 30 years and has
paid taxes. This man just moved in last August. Now I want to develop
it into something to get out of the burden of taxes. No builder
would put in single family dwellings in property like that.
Councilman Baumgartner asked if he was going to own the four plexes
or are you going to rent them.
Mr. Gustafson stated that he will be selling them.
John Houle, 7643 Edgewood, stated that it would be a beautiful area
to build single family dwellings.
Diane Schwartz, 7644 Greenfield, has lived in her home 6 years. We
feel that there are enough apartments and double bungalows around and
feel that it should stay R -1.
Dick Moss, 7656 Greenfield asked if we changed to 7-3 or staying on R -2.
With R -3 it would require another hearing. If he wants R -3 we are
wasting our time. It has been vacant for a long time. The Council
has the responsibility to the community to discharge that responsibility.
Gustafson might be able to realize a greater gain on selling
property to a developer but I am not sure that that would be best for
the community. There would Le traffic congestion, high density
population, and other problems,sehool problems, all the services of
the community. -e sug,Lested: r,ince there are homes presently here,
donate a stretch for a road as a buffer, there would be no problem
of doing wbatover he wanted to with the lower half of his property.
In the area he is discussing keep it sin -le family dwellings.

years ic' of a good argument as the price of lots have gone up.

It is to his advantage that he owned the property for 30 years.
John Brown, 7630 Greenfield, stated that there are too many people
living in the small area now.
Er. Gustafson stated that the people who own the homes on Greenfield
have already put a fence up and the whole area is separated.
We would probably put trees in there. A duplex is no bigger than a
single family home. We would want more elderly people in there. We
need a place for them that is close to the shopping center, etc.
Mrs. McGuire stated that she opposes this because she has seen what
has happened with the apartment buildings across the street. On one
bus pickup I have seen 22 children and we have had problems. I have
to believe that this has something to do with the apartment dwellings.
I hesitate to believe that if you put up a double bungalow it will be
only for older people.
Diane Schwartz stated that children wait in her yard for the bus stop
and she is continually out there policing it.
Mrs. ticGuire stated that you don't get this in private threllin as
everyone knows everyone else.
Mr. McGuire said that most older people have their own homes. It is
not feasible that older people will move in there.
Mr. Brown stated that he did not want to discriminate as to who is
renting the building. They just want to be sure that the rest of the
homes are not devalued and don't overcrowd the block.
'r. Gustafson stated that if we built single family homes, according
to the ordinance we can put one on each lot. If we put in single
family 4 bedroom homes, how many children do you have? In the bungalow
you would have less children. The children would probably be too small
to go to school.
Acting Mayor Hodges asked the Council for their opinions:
Councilman Pickar: The tough thing is the people who have lived there
a long time. I am opposed to it unless something could be worked
out that would he acceptable to the home owners.
Councilman Shelquist stated that he felt that you could not put in
single family residences and isolate them by putting in additional
multiple dwellings. Mr. Moss had a good idea in developing those
three lots in single family dwellings. I would vote to deny the R -2.

Councilman Baumgartner asked if he had specifically offered his
property for sale as R -1 and Mr. Gustafson replied that he had an
appraiser look at it. They are getting almost too valuable to put
single family homes there.
Councilman Baumgartner stated that as far as it remaining R -1 I don't
think you would have a problem on the properties pointing west. The
properties pointing east would be looking into the apartment buildings
and they are not that bad looking. Possibly on the south end you could
build a duplex on the south and north property lines and a buffer
(fencing, etc.) to screen from adjoining R -1 property. The duplexes
would be facing the Bel Rae. Would you consider that suggestion?
Mr. Gustafson replied no, as they are not talking about that particular
land right now.
Councilman Baumgartner stated that he would agree with Mr.Shelquist then.
Councilman Shelquist asked what the request is that we are acting upon
tonight? The original request to the Planning Commission was to rezone
lots 5 -23 to R -2. The administrator replied that the hearing is on
4 lots. He originally requested rezoning of all parcels.
Mr. Gustafson stated that they had wanted to rezone all of it at the
same time but did not have enough money. They will p;o for these 4 lots
and go from there.
Councilman Baumgartner stated that if these 4 lots are zoned to R 2,
the request will be for the rest of them in another six months.
Acting Mayor HODGES SUGGESTED perhaps taking another look at this
and coming up with some plan. They should stick with the single
family there.
Mr. Gustafson stated that he was sorry to hear this negative talk.
He has tried to develop this before. He cannot hold the land anymore,
he has tried to develop it for what it is worth; you allowed the
apartments to come in right across the street.
rSP (Pickar- Shelquist) to close the public hearing. L ayes
Attorney Meyers stated that this is a hearing for an R -2 zonin
and that is just for Lots 4 -7 as indicated, advertised and agreed
upon by the owners. There were 18 notices sent out, excluding those
properties owned by r. Gustafson.
There are 5 home owners present and against it.
iSP Shelquist- Baumgartner) that we deny the rezoning from R1 to R2
for Lots 4 -7 :dock 3 of Greenfield Plat 2 for the reason that it is
inconsistent with the immediate adjacent residential district,
there would he an adverse effect on the value of the property of
those homeowners affected i:rned?ately adjacent, increased density
:ould an adverse effect as well as traffic congestion, and it
is spot rezoning-.

CHAPTER 92, DISEASED TREES
This is a proposed revision of Chapter 92, Diseased Trees, bringing
the ordinance into conformity with State Statutes.
Councilman Shelquist stated that the revision of the ordinance does
not state when you have to have the tree down; Atty Meyers replied
that he assumed the notice will contain the date it would have to be
down. The state requires they must be removed in 20 days.
Councilman Shelquist wanted to know if it would be appropriate to say
not less than 5 days but not more than 20 days.
The administrator stated that it possibly does not have to be passed
this evening and
Acting Mayor Hodges recommended tabling the matter temporarily.
LAWCON GRANT APPLICATION
The administrator explained that this grant application is for $100,000
in state and federal: funds to acquire 19 additional acres for Silver
View Park. The action that the Council has to take ?s to approve
the application and approve the city's source matching. We would
have to have a higher priority ie "community park" to get any funds.
It might be possible to use up to 15 acres of the site for storm

MSP (Baumgartner- Shelquist) to approve the concept of the LAWCON Grant
Application for $100,000 in state and federal funds and that the City
designates its source of funding as General Revenue Sharing, park and
playground fund and other sources.
Councilman Baumgartner stated that in Greenfield Park a water

Councilman Shelquist inquired as to what was going to be done

1976 BUDGET REVISION
The administrator stated that the projected General Fund revenues and
expenditures indicate a better financial position than we originally
anticipated when the budget was prepared. On the basis of that the
staff reviewed the immediate problems and suggested the attached

Councilman Pickar stated that we may wait a long time for a use for
the grill.
Councilman Baumgartner stated that he saw Mr. Shelquist's point of
view, but to put in glass would certainly dress the building up.
Councilman Shelquist stated that he agreed but he just cannot see
throwing away $2,000.
Acting Mayor Hodges stated that he thought we should go through with it.
Engineer Hubbard stated that he would study and see how much the
water line for Greenfield Park would be.
Councilman Baumgartner asked if this area can be revised or do you need
a motion on it tonight. The cost may already be in the park budget.
MSP (Baumgartner Hodges) to authorize the expenditure of the following
monies by account number in the 1976 budget based upon revenue
estimates submitted by the administrator which indicate that there
will be adequate funds to cover these expenditures and to still avoid
using prior year surpluses to balance the budget.
Councilman Shelquist amended the motion to delete Item 7. Amendment
failed for lack of a second.

ADMINISTRATOR ACIIEN'S REPORT
Ad. Achen stated that he received a formal amendment to the CETA
agreement. The effect is to authorize extention of the program
beyond July 1, 1976. The original agreement provided for employment
only through June 30, 1976. He needs Council's approval to execute
the agreement.
MSP (Pickar Baumgartner) to authorize the administrator to execute the
amended CETA agreement. U ayes
ATTORNEY MEYERS had no report.
ENGINEER HUBBARD'S REPORT
He would like Project 76 -1 to be approved and advertised for bids. The
project includes sealcoatinp north of County Hd I. 17' will be for
repair work. He suggests that bid opening be heard at 11:00 am July 26,
1976, for Improvement Project 1976 -1. $39,620 is the estimate.

COUNCILMAN PICKAR'S REPORT
Councilman Pickar stated that the Lakeside Park meeting is Thursday
evening. Since Anoka County authorized a limited food license the
concession stand is almost completed. Also the manufacturer of the
slide stated that they will replace it but we will have to install it
Further, he would like to make a motion to change the fee for fencin
within` the City of Mounds View to $5 for any fence and along with
$5 fee either a survey of the property line involved or a written
agreement with the staff to prepare
a form to hand out with the $5 permit
The administrator stated that that involves both an ordinance and
resolution.
Councilman Shelquist suggested directing the administrator to revise
the ordinance.
Ad. Achen stated that they have begun that. If action is desired
sooner than that you may want to take action in the form of a
resolution without the other stipulation.
Councilman Pickar stated that he would scratch the other motion and
move Resolution 745 to change the fee to t5 for the fence fee. This
was seconded by Acting Mayor Hodges.
Councilman Shelquist asked wh was so important about reducing fee
right now.
Councilman Pickar stated that he is assuming the rest will follow and h
wants to go as far as he can tonight. He then stated that he would
withdraw his motion. Acting Mayor Hodges withdrew his second.
ACTING MAYOR HODGE'S REPORT
He has received a letter from the Governor's office on volunteer
services. August 19, 1976, is proclaimed as
Day.
Youth Volunteer Recognition
MSP (Hodges- Baumgartner) that we also proclaim August 19, 1976, as Youth
Volunteer Recognition Day and pass on to Doug Bryant for suggestions

COUNCILMAN SHELQUIST'S REPORT
Administrator Achen asked if it would be worthwhile for the Council
to make a formal request to the Watershed District to emphasize the
City's concern for the amount of water storage at Mounds View
Square?
Councilman Shelquist stated that he would like the administrator to
formally request the Watershed District to provide the City copies
of all permits issued to Mounds View Square Shopping Center and
indicate what action they have taken on the permit and whether they
have conformed with the requirements of that permit.
