HomeMy WebLinkAboutMinutes - 1977/10/11rTh PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A regular meeting of the Mounds View City Council was called to order by Mayor Pickar at 7:30 PM on October 11, 1977 at the Mounds View City Hall, 2401 Highway 10, Mounds View, Minnesota 55112. Members Present: Also Present: Mayor Pickar Attorney Meyers Councilmember Ziebarth Engineer Hubbard Councilmember Baumgartner Councilmember Rowley MSP (Ziebarth- Baumgartner) to approve the minutes of the regular meeting Septem- ber 26, 1977 and the special meeting October 3, 1977. MSP (Pickar Rowley) to appoirt Engineer Hubbard as deputy clerk for the meeting in the absence of Clerk- Administrator Achen. CITIZEN COMMENTS AND REQUESTS There were no citizen comments or requests. 4 ayes 4 ayes APPROVAL OF THE CONSENT AGENDA Councilmember Ziebarth requested that Item E be removed from the consent agenda. Councilmember Baumgartner requested that Item G be removed from the consent agenda. MSP (Ziebarth Baumgartner) to approve the consent agenda as follows: 4 ayes ITEM A. Set public hearing for 7:40 PM, October 24 1977, on Kathleen Berg single family preliminary plat of property located north of 8444 Sunnyside Road and south of County Road J. ITEM B. Adopt Resolution No. 868 acknowledging fulfillment of the terms of Development Agreement No. 76 -5 by Steve's Appliances and authorizing release of the $4,500 performance guarantee. ITEM C. Set special Council meeting for 7:00 PM, October 13, 1977, to interview the three finalists for the Parks and Recreation Director position. ITEM D. Receive report of the iiinncsoca DepartmenL of irdnsputcatiun District 9 Director regarding a traffic signal and median opening on Trunk Highway 10 between County Road H and County Road H -2. The report concludes that neither should be approved or installed until completion of new Trunk Highway 10. Direct the Administrator to request repre- sentative of the District 9 Director to appear at the Council's October 24, 1977, meeting. October 11, 1977 Page 2 ITEM F. Anoka, MN 55303 Peddler 11/15- 12/15/77 Cub Scout Pack 167 Indianhead Council c/o Barb McCluskey to sell Christmas bows city wide waive the $25 peddlers license fee Councilmember Ziebarth stated that he was interested in the cost of the Council/ Staff team building retreats. Councilmember Rowley replied that in the letter she received from Administrator Achen, the cost appears to be $30 per day per person, which would include meals. MSP (Rowley Pickar) to approve Item E on the consent agenda, to set the following dates for the Council /Staff team building retreats to be held at the Seven Pines Lodges, Lewis, Minnesota, with the Council retreat to be November 4 and 5, 1977 and the joint Council /Staff retreat to be November 19 and 20, 1977. 4 ayes Councilmember Baumgartner stated that he would like to see an itemized bill for Long Lake 66 for repairs before their check is issued. MSP (Baumgartner Pickar) to approve Item G on the consent agenda, the payment of the October 11, 1977 bills with the exception of Check #15398, until Long Lake 66 presents an itemization of specific charges. 4 ayes FINANCIAL CONSULTANT CONTRACT DEBT SERVICE AND STORM SEWER STUDIES Mayor Pickar stated that the proposed contract with Ehlers Associates, Inc. for financial consultant services is the standard contract that the City has entered into previously for the sale of bonds and debt service study. The services of Ehlers Associates are essential in the preparation of the feasibility report in order to determine the most practical and equitable special assessment procedures and what portion of the project cost can be realistically financed through general taxes. In addition, the City is requesting Ehlers Associates update the 1973 Debt Service Study, which would assist in the Council's decision making process regarding the storm sewer financing. Mr. Phil Chenoweth introduced himself as a representative of Ehlers Associates and gave a brief summary of the contract. Attorney Meyers stated that he felt four years was more than enough time to go by October 11, 1977 Page 3 before having another analysis made of the City's financial situation. Councilmember Ziebarth asked how often it was best to have the study done, whether it should be done every yei..r or every other year, or whatever. Mr. Chenoweth replied that his firm puts all information into their computer, which is where the information from the 1973 study is, and that it is best to update this information yearly. MSP (Pickar-Ziebarth) to renew the contract with Ehlers Associates for 1978 and request the debt service study, as outlined by the City Administrator, from Ehler Associates. 4 ayes SANITARY SEWER CONNECTION BALK ASSESSMENT HEARING WAIVER Engineer Hubbard reported that when the Balk Addition was approved, a lot was created fronting County Road J. This lot contains the existing homy of the Balks. Project 1973 -4 did not provide sewer main extension along County Road J between Eastwood and Sunnyside Roads. Therefore, the Balk's lot does not have direct access to a sanitary sewer connection. The matter has been resolved by securing an easement through underdeveloped lots still owned by the Balks fronting on Sunnyside Road. The Balks will contract and pay for the cost of a long sanitary sewer connection from the main on Sunnyside Road to their existing dwelling. Engineer Hubbard stated that because the sewer main was not extended along County Road J, the Balk's lot did not receive an assessment under Project 1973 -4. An assessment for the connection service is required and has been agreed to by the Balks. Such an assessment would normally require a public hearing, however, the Balks have agreed to sign a waiver of the public hearing. Engineer Hubbard reported that in order to come up with an assessment figure for the Balks, he had taken the assessment figure for a 100' lot from the 1973 -4 project and updated it to 1977, which turned out to be $1,927 and that if the charge to Mr. Balk from the contractor he chose was less than $1,927, the City would assess Mr. Balk the difference. However, if it was exactly $1,927 or more, there would be no assessment from the City. Engineer Hubbard stated that he had spoken with Mrs. Balk during the day, and that she had a verbal estimate from a contractor of $1,550 for the required work, which would result in a $377 assessment from the City. Mr. Balk stated that he was concerned with getting stung if the cost of the work was above the estimate and he was still assessed the $377 by the City. Councilmember Baumgartner asked if these would be additional connections put into the line from the adjoining vacant property. Mr. Balk replied that the adjoining property was already hooked into the main sewer system. Attorney Meyers requested that the easements for the sewer line on the adjoining property be recorded so that whoever purchased the property would know they were there. Mayor Pickar suggested that the Council could leave an option open to Mr. Balk that he could come back to the City if he runs into trouble with the cost of the project October 11, 1977 Page 4 going over the estimate and would then face a double assessment. MSP Pickar- Ziebarth) to authorize the Mayor and Clerk Administrator to enter into a waiver of assessment agreement based on an assessment of $377,with the owner of the property, and if there is a substantial increase in the cost to the Balks, that the Council would entertain a plea to reduce the assessments sometime in the future. 4 ayes ATTORNEY MEYERS REPORT Attorney Meyers reported that the City had received a letter from Mr. Beim regard- ing the Northcrest Park development and requesting an interpretation. He stated in his letter that he did not feel he was liable for a park dedication. Attorney Meyers stated that in reviewing the situation, he did feel Mr. Beim was liable for a park dedication. Attorney Meyers also reported that he had received an appraisal from Krause Anderson regarding the land the City hopes to acquire for Silverview Park. The City had appraised the land at $6,500 per acre, while Krause Anderson appraised it at $10,000 per acre. Attorney Meyers stated tnat he did not feel the City and the land owner were that far apart on agreeing on a price. Attorney Meyers also reported that the City had been served with a complaint from James Refrigeration regarding their denial of a conditional use permit. ENGINEER HUBBARD'S REPORT Engineer Hubbard had no report. COUNCILMEMBER ZIEBARTH'S REPORT Councilmember Ziebarth requested Engineer Hubbard to contact Administrator Achen regarding the signing of Bona Road. He stated that he has had discussions with the people from Bona Road and believes they will be present at the next Council meeting. COUNCILMEMBER ROWLEY'S REPORT Councilmember Rowley stated that in the near future she will be going to the Spring Lake Park City Council with a proposal for changes in the contract, maintenance, financing, etc. of Lakeside Park, and that Mayor Pickar would be going with her. Councilmember Rowley reported that she had taken a tour of the Ramsey County Watershed district and saw some good examples of holding ponds, drainage streams, erosion, etc. COUNCILMEMBER BAUMGARTNER'S REPORT Councilmember Baumgartner stated that there would be a meeting on Thursday night, October 13 to interview the three finalists for the Park and Recreation Director opening. October 11, 1977 Page 5 Mayor Pickar asked if the Council members would have a chance to review their resumes before the meeting. Councilmember Baumgartner replied that Administrator Achen had all the available information on each candidate and that they could con- tact him for this information. Councilmember Baumgartner stated that the Planning Commission would be meeting at 7:30 PM on October 12 and that one of the items on the agenda was the discussion of home occupations and the City ordinance governing it. He stated that the Planning Commission would be reviewing it, clarifying it or redefining it and then making an recommendation to the Council. Councilmember Baumgartner reported that within the past two or three weeks, Northeast Marine had moved into the building on the southwest corner of Highway 10 and Silver Lake Road and that they wanted to put up a sign advertising that they were there, but were told it would require Council approval. Mayor Pickar replied that the owner should contact Steve Rose to find out the require- ments of signs. MAYOR PICKAR'S REPORT Mayor Pickar asked Engineer Hubbard when Bauer's would be opening up their business. Engineer Hubbard replied that he was not certain of the date but would check into it.
