Members Present: Also Present: Acting Mayor Hodges Councilmember Ziebarth Councilmember Rowley Councilmember Baumgartner PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Clerk Administrator Achen Attorney Meyers Engineer Hubbard MSP (Baumgartner Ziebarth) to approve the minutes of the October 11, 1977 meeting as presented. 4 ayes CITIZEN COMMENTS AND REQUESTS There were no citizen comments or requests. APPROVAL OF THE CONSENT AGENDA MSP (Baumgartner Rowley) to approve the consent agenda as follows: 4 ayes ITEM A. Adopt Resolution No. 869 authorizing execution of Development Agreement 77 -12 with Sunnyside Builders for construction of a duplex located at the southwest corner of County Road H -2 and Edgewood Drive. This development agreement is pursuant to Council's action May 26, 1977, rezoning this parcel to accommodate a two- family rather than single family dwelling. The terms of the development agreement are essentially the same as those of Development Agreement 77 -11 with Steven Loeffler: $1,000 performance guarantee, a front yard tree, paved driveway, appropriate grading for surface drainage. ITEM B. Approve, as recommended by the Planning Commission (10/12/77 minutes), the minor subdivision of Mitchell Gwiazdon to create two lots from property located at 7555 Spring Lake Road. The existing parcel shall be divided into equal parcels each with 82.5 feet of Frontage on Spring i..ike Road. A variance of the 85 foot frontage minimum requirement is hereby authorized for both lots. ITEM C. Adopt Resolution No. 870 certifying .i special as ses:;oc'nt of $377 to Lot 1, Block 1, Dalk' s Addition. The as sessm�nt shall be spread at 8% annual interest over a 13 -year period. October 24, 1977 ITEM D. Receive petition QC lV .!_liam H. Deli, tror the ex`_ensn of Mustang Drive to Service the Mounds View industrial Park No 2 plat. Authorin the preparation of an engineering feasibility report. ITEM E. Authorize the Mounds View Lions Club to sell the surplus civil defense truck previously purchased from the City. Proceeds from the Lion's sale of the truck in excess of •$125 shall be divided equally between the Mounds View Lions Club and the City of Mounds View. The generator equipment shall be returned to the City. ITEM F. Receive the September, 1977, activity reports of the city attorney, police, fire and abatement depa::tments. ITEM G. Postpone the November 7th Council agenda session until 7:00 PM, Wednesday, November 9, 1977. At that time a special joint meeting of the Council and Planning Commission will be conducted to consider revision of the home occupation; ordinance. ITEM H. Accept the resignation of Virginia Klumb as clerk- typist effective October 31, 1977. ITEM I. Approve the following license: CONTRACTOR expires 6/30/78 Sign hanging renewal Signcrafters Outdoor Display Inc. 013 77th Way N.E. Minneapolis, MN 55432 ITEM J. Approve the October 24, 1977, bills for payment. TRAFFIC CONTROL BONA ROAD- W00DCREST DRIVE INTERSECTION Engineer Hubbard reported that he had viewed the intersection of Bona Road and Woodcrest Drive with the police chief and they had come up with the recommendation of putting stop signs on the north and south side of Woodcrest Drive. He stated that a crosswalk has been painted across Bona Road and that advance warning signs of the crosswalk will be put up. Engineer Hubbard also stated that he hopes that the crosswalk will channalize the pedestrians across the intersection. Richard Willhaus, 5135 Bona Road asked how far the advance warning signs will be from the crosswalk. Engineer Hubbard replied that they would be between 150' and 300', whatever was required by the uniform traffic control device standards. Mr. Willhaus asked if there was a traffic control expert to make a decision as to what would be the best type of control to put in. Engineer Hubbard replied that while there most likely are traffic control experts, this was a unique situation to Mounds View and it was being handled as best as could be. October 24, 1977 MSP (Ziebarth Hodges) to accept the Engineer's report on traffic control at Bona Road and Woodcrest Drive and authorize installation of stop signs as recommended. 4 ayes PUBLIC HEARING BUZZELL BUILDERS RESIDENTIAL DEVELOPMENT BERG ADDITION PRELIMINARY PLAT Administrator Achen reported that the plat involves the property at the southwest corner of County Road J andSunnyside Road. It creates six lots and all require- ments are met other than the 85' frontage requirement. Carol Vogland, 249 99th Ave. N.E., introduced herself as the representative of Jim Petrowski, 2708 County Road J, and stated that Mr. Petrowski believes the surveyors report was incorrect and that his lot should include 10' more depth and 5' more width. Ms. Vogland presented Atty. Meyers with Mr. Petrowski's deed to the 1 Attorney Meyers stated that after reviewing the deed, which states the lot size "more or less", that the City must recognize the measurements in the certified survey which would be accepted before a deed. Councilmember Ziebarth asked if the City was concerned with whether or not the unplatted lots meet requirements. Attorney Meyers replied that the City has expressed concern in the past about small islands of land such as the 30' strip included in Lot No. 2. Ken Sjodin introduced himself as the agent for the owner of the property and stated that the 30' would not be a wasted piece of land. It could be used for a garden or whatever the owner should decide to do with it. MSP (Baumgartner Ziebarth) to approve the preliminary plat of the Berg Addition as presented. 1977 OPERATING BUDGET REVISED GENERAL FUND REVENUE EXPENDITURE ESTIMATES PROPOSED EXPENDITURE AUTHORIZATIONS Administrator Achen presented the projection of 1977 revenues and expenditures to Page 4 ayes LAUNCHING PAD LIQUOR LICENSE AGREEMENT PARTIAL RELEASE OF FINANCIAL GUARANTEE Administrator Achen reported that the Launching Pad has completed nearly all the terms of the agreement regarding its liquor license renewal. However, the paving near one of the driveway entrances was apparently damaged during construction and the City is requiring them to repair that and to extend the fencing further east a short ways to assure that traffic cannot circumvent the driveways. Administrator Achen stated that Staff recommends that the financial guarantee incurred with the agreement be reduced to $1,000 from the current $5,000 that the City is now holding. Councilmember Ziebarth asked where the fence would be extended. Administrator Achen replied that it would be extended on the west end between the open space by the service station and the Launching Pad, on County Road H -2. MSP (Hodges Rowley) to accept the recommendation from Staff on the financial guarantee agreement for the Launching Pad to be reduced to $1,000 from the $5,000 that is now being held. 4 ayes October 24,1977 the Council Members and reviewed the additional MSP (Baumgartner Rowley) to appropriate $12,660 fund balance to be used for the items presented strator to the City Council, dated October 24, appropriations recommended. from the projected 1977 general on the memo from the City Admini- 1977. 4 Page ayes ADMINISTRATOR ACHEN'S REPORT Administrator Achen reported that he met with Bruce Anderson on October 21 and offered him the position of Park Recreation Director: starting at $17,600 with a raise to $18,300 after six months service.. Mr. Anderson accepted and will be starting November 7, 1977. His benefits wll include city paid memberships and attendance at state and national Professional association conferences. M Baumgartner) to approve Bruce Anderson as the Park Recreation Di rector, effective November 7, 1977, at a starting salary of $17,600 with a raise to $18,300 after a six month probationary period. Administrator Achen reported that a scheduling conflict arose with Mn /DOT so that Glen Van Wormer would not be available for discussion of the traffic signal and median opening on T.H. 10 until the Council's November 14 meeting. Administrator Achen reported that the first Local No. 320 police mediation session was held October 18 and that it was merely an introductory session and no bargaining actually occurred. A second session is set for November 4. Administrator Achen reported that the CETA program has informed the City that the mechanic's helper, Richard Schmidlin, will begin working for the City on October 31, 1977 and that CETA has forwarded the necessary funding agreements which he and the Mayor will execute. Administrator Achen reported that the Public Works Director and Superintendent have met with Mr. Schmidlin and feel he is qualified to handle the responsibilities of the position. Administrator Achen reported that Mn /DOT has responded to Ramsey County's request that a speed study be conducted on County Road J. Mn /DOT recommendations are that the 30 mph speed limit between Central Avenue and Baltimore be retained, that from Baltimore to Hastings Street (Spring Lake Road) the speed limit be set at 35 mph, and that from Hastings Street to New T.H. 10 the speed limit remain at 40 mph. Administrator Achen stated that this was not a very strong response to the Council's request and that if anything, the three speed limits on the particu- lar section of County Road J may simply, confuse travellers and result in a gradual decrease of speed as now occurs from the stop sign to Central Avenue and vice versa, an increase in speed from the light at Central Avenue to the stop sign. Administrator Achen stated that the County Board has acted to implement the Mn /DOT recommendations. Administrator Achen stated that in the past, the City has been working under a state grant for diagnostic referral service for employees and their families. He stated that on January 1, 1978 the program will be on a self- supporting basis and that Mounds View would be responsible for the cost if they decide to continue with the program. Administrator Achen reported that the fee would be approximately $200, which would be $6 per employee. COUNCILMEMBER Administrator Achen reported that the Council has tentatively set a meeting for October 26 for a working session on storm sewers. However, since that date did present conflicts for the Council members, he recommended that it be changed to ctober 27. MSP Ziebarth- Hodges) to st': a meeting for 7:30 PM on October 27, 1977 for a session on the storm sewer system. ATTORNEY MEYERS REPORT Attorney Meyers had no report. ZIEBARTH'S REPORT Councilmember Ziebarth had no report. Page 5 working 4 ayes COUNCILMEMBER ROWLEY'S REPORT Councilmember Rowley stated that she had attended the Ramsey County League meeting with Councilmember Baumgartner and that Councilmember Baumgartner would be reporting on it. COUNCILMEMBER'BAUMGARTNER'S REPORT Councilmember Baumgartner reported that the November 7 Council agenda meeting was changed to November 9 at 7:30 PM and that it would be a joint meeting with the Planning Commission and City Attorney to review home occupation regulations. Councilmember Baumgartner stated that information on the Ramsey County Sheriff Department was presented to the Ramsey County League meeting and that he would leave the packet of information he had received if anyone was interested in looking at -i t. ACTING MAYOR HODGE'S REPORT Acting Mayor Hodges stated that he was not able to attend the Youth Service Bureau meeting as it conflicted with the Council meeting.
