Adjournment s/ CONSENT AGENDA September 25, 1978 The consent agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the consent agenda and placed upon the regular agenda for debate. ITEM A. Reschedule the October 9, 1978, regular City Council meeting, which falls on a legal holiday, to 7:30 PM, Tuesday, October 10, 1978. ITEM B. Set public hearing for 7:50 PM, Tuesday, October 10, 1978, on the Willard Graham request to rezone 2525 County Road I from R -1 to R -2 residential district. ITEM C. Adopt Resolution No. 930 authorizing execution of Development Agreement 78 -27 with Omega Management Inc. for the construction of a duplex residence at 7636 Woodlawn Drive as recommended b) the Planning Commission (9/13/78 minutes). Terms of the Agreement require a $1,000 performance guarantee, sodding paving, concrete sidewalks, two trees, and surface drainage to Woodiawn Drive. ITEM D. Adopt Resolution No. 931 amending salaries, wages and benefits established for calendar year 1978 in order to rectify inequities in pay levels resulting from the June 22, 1978, Teamsters Local No. 320 police arbitration award. ITEM E. Adopt Resolution No. 932 authorizing application for $3,000 of a second year funding Local Planning Assistance Grant from the Metropolitan Council; and authorize execution of an amendment to the existing 1977 -1978 Local Planning Assistance Grant Agreement to include the recently awarded $3,000 for special problems planning. ITEM F. Approve, as recommended by the Planning Commission (9/13/78 minutes), the minor subdivision of Orval Adair to create two lots from property located at 6900 Pleasant View Drive. The east lot shall be 146 feet wide on its County Road H frontage and have a ten foot utility easement along its south lot line. The west lot shall be 153 feet wide. The existing garage and shed, located on the newly created west lot, shall be removed or relocated to conform with city building setback requirements within one year of this date. As recommended by the Planning Commission, staff is directed to inform property owners on the west side of Pleasant View Drive between Woodale Drive and County Road H of this subdivision and the procedures for petitioning for a street extension on their west property lines. CITIZENS COMMENTS AND REQUESTS There were no citizen comments or requests. APPROVAL OF THE CONSENT AGENDA MSP (Rowley- Hodges) to approve the consent agenda as follows: 5 ayes ITEM A. Heating Air Conditioning Bill's Heating 7841 157th Ave N W new Excavating renewal Hayes Contractors 1010 Currie Ave. Excavating new Don Zappa Son Excavating 1599 Berne Road Masonry renewal Englert Cement 794A nnnejlas Drive SEVEN ELEVEN REQUEST TO INSTALL GASOLINE PUMPS Administrator Achen reported that a year ago Southland Corporation had requested to install three gas pumps at the Seven Eleven store at Silver Lake Road and County Road H2, and that the Council had conducted a public hearing and at that time requested that Seven Eleven have a professionally conducted study done of some of September 25, 1978 Page 3 the problems the Council was concerned with. Administrator Achen added that a study was done, and based on Staff's objections or criteria, the City had its own planning consultant do a study. Administrator Achen stated that Southland Corporation had been scheduled to be on the Planning Commission agenda at the August 23 meeting, after several delays at Seven Eleven's request, but they had not appeared at the P1arning Commission meeting, and the Planning Commission recommended that their request for a conditional use permit for gas pumps be denied. The item was then scheduled for the September 25 Council meeting and Southland Corporation was once again told of the meeting, and they told the City they did not plan to attend. Attorney Meyers reported that the Council considers this to be the final determination of Seven Eleven's request and that all public hearings have been closed. Mayor Pickar reviewed the reasons given by Midwest Planning for not approving the conditional use permit for the gas pumps. MSP (Pickar Ziebarth) to deny the request for a conditional use permit for the Seven Eleven store based on the following reasons, that the proposed use is incon- sistent with the spirit and intent of neighborhood commercial centers, the proposed use represents an additional non neighborhood oriented use on the existing Seven Eleven site, with the proposed use the Seven- Eleven site cannot accommodate suff- cient parking to comply with the zoning ordinance, the existing Seven- Eleven site cannot comply with zoning ordinance requirements pertaining to site dimensions and access locations for aas stations, the existing Seven Eleven site is not of sufficient size or dimension to accommodate necessary maneuvering areas and provide reasonable car stacking spaces, and due to the fact that the Planning Commission recommended to the Council denial of the conditional use permit. 5 ayes Councilmember Baumgartner pointed out that one of the recommendations from the Planning Commission was that the property at Silver Lake Road and County Road H2 be down zoned from B -3 to B -1 and that the Council direct Staff to review the impact of the current convenience food operation, which is an apparent violation of the existing ordinance. He added that some grocery stores in the City have turned into a convenience food type establishment where a person can run in for a hamburger or hotdog. Attorney Meyers stated that if the City does down zone the property, they could be exposing themselves to a lawsuit from the property owners. He added that the City has been sued before but the Court upheld the City's findings. MSP (Baumgartner Pickar) to set a public hearing on rezoning the subject property from B -3 to 8 -1 at 8:20 PM on October 23, 1978. 5 ayes Councilmember Baumgartner stated he would like to make sure that those to be legally notified do receive their notices and suggested they either be hand delivered and signed for or sent certified or registered mail. Administrator Achen reported that there are 24 property owners involved within the 350' and that if Council is going to take that approach, they should consider adding a considerable amount of money to the budgets of the projects to cover the cost. Attorney Meyers stated the City could legally use the County auditor's records and the water billings together, but that they should try to make sure that the legal owners of the property are notified. September 25, 1978 Page 4 Councilmember Baumgartner stated he would like to see the water billings list used and have the issue put on as an agenda item for an agenda meeting, once the budget sessions are over with. Councilmembers Rowley, Ziebarth and Hodges agreed that they would like to have the issue discussed further. Councilmember Hodges stated that the City should check into the violators of the food operations. Councilmember Baumgartner recommended that that item also be put on a future agenda, after the budgets and elections, to give Staff time to research it. NORTHCREST PARK DEVELOPMENT Mr. Beim of Pinecrest Properties explained that he had thought everything was set on the development of his property and putting in the improvements but that he had been surprised to find out that a security was required by the City and that he had checked on a letter of credit or bond but was not able to get either one at this time. He added that the fact that there is a ten year spread on the special assessments is different then for other land owners. He added that he has agreed to everything but the pay -off on the special assessments. Administrator Achen explained that the City had never set these requirements before but also pointed out that such a project had not been done in the City before. He added that the fiscal agent had recommended that the City shorten the assessment plan. He also stated that the City has been working with Mr. Beim for the past two years and during that period has begun taking a stronger stand by requiring developers to provide financial performance guarantees. He added that staff had surveyed other cities and found that most cities will not put in public improvements for a commercial project when there is only one property owner. Administrator Achen explained that the financial guarantee is designed to relieve the City of financial risk. Staff recommended an $845,000 bond to cover the first five years of principal and interest on Mr. Beim's estimated special assessments. Although Mr. Beim says he cannot meet this, staff still recommends some amount of security be required. Mr. Beim pointed out that if the special assessments don't start until 1980, it will give him a year to sell some of the property but that he could not guarantee he would sell some. Administrator Achen stated that the Attorney has determined that the development agreement binds Mr. Beim to paying the special assessments. Attorney Mayers added that the City has not been in such a situation before: with a major commercial/ industrial development that must generate enough sales to assure that the debt service terms of the bonds can be met. He added that in the development agreement, the developer agrees to pay the taxes and assessments as they come due and that the best protection for the City is a letter of credit or bond. He added that another method would be a promissory note from the developer, using the property as collateral. Attorney Meyers stated that the 125% pay off of special assessments as land is sold or developed would be an alternative assurance for the City. Mayor Pickar stated that some cities allow 120 days from the issuance of a building permit before the taxes and assessments are due at 125 Attorney Meyers stated that they could count from the time of the sale or the issuance of the building permit. HQ recommended that the City go with the time of the sale. September 25, 1978 Page 5 Mr. Beim stated he would be more comfortable with the time of the sale rather than the issuance of a building permit as he could have a six month construction period before completing a building and closing on the property. Attorney Meyers stated that one of the Council's fears is that the land might sit empty for two or three years and the developer not pay the taxes. He added that the City must be able to assure itself that it will know about the sale of the property as it occurs, and that arrangements could be made at the time of the issuance of the building permit to pay the assessments. Mayor Pickar suggested that the assessments be tied into the issuance of an occupancy permit. Attorney Meyers replied that an occupancy permit is not as strong a legal tool to use. Administrator Achen suggested that at the time the building permit is applied for an agreement be executed to assure that payment is made at some specified date such as at the time of issuance of the occupancy permit. Mr. Beim stated that he would like to have some input in determining the time when special assessments on a parcel must be paid. Mayor Pickar asked if Mr. Beim could make a decision on this matter within the next two weeks. Mr. Beim replied that he has a partner in the project, to whom everything is new, and that he would like time to study the 125% pay -off rate. He stated that he could get back to Administrator Achen within the next few days to let him know what they will be doing. Mayor Pickar stated he would like the item put on the agenda for the next meeting, to allow time to work everything out. Administrator Achen replied that several items were pending, such as a construction contract which has to be signed by October 6. He asked that the Council make some recommendation now. Attorney Meyers stated that the Council could authorize the Clerk /Administrator and Mayor to sign the development agreement by October 6. Councilmember Ziebarth stated he would like to agree in principle and look at it further at the next agenda session. He added that he was concerned with going from requiring $845,000 to no bond or letter of credit, and 125% assessment pay -off. Councilmember Rowley stated that she agreed with Councilmember Ziebarth and that some type of up front money should be required to protect the City. Administrator Achen stated that he had discussed the issue with Mr. Beim and that Mr. Beim had told him he could not come up with any financial security. Administrator Achen added that he personally feels the City should have at least the first year's payment guaranteed. Councilmember Baumgartner stated that he also agreed that some type of security should be required. He added that the 125% pay -off would not protect the city if no development occurred until 1981 or 1982. September 25, 1978 Page 6 Maor Pickar stated that he also agreed some front money should be required to cover the project and protect the City. He added that the issue would be discussed further at the next agenda meeting. Mr. Beim stated that he would be discussing the matter with his partner and would get back to Administrator Achen. PETITION FOR TRAFFIC CONTROL CHANGES HILLVIEW ROAD /GREENFIELD AVENUE Mayor Pickar read the recommendation from the Police Chief regarding the traffic control changes. MSP Pickar- Ziebarth) to place stop signs at the intersection of Hillview Road and Greenfield Avenue on Hillview's southwest and northeast corners on a temporary basis for 60 days, with the Police Department to determine further need after that time. 5 ayes Councilmember Hodges asked if a street light had been considered. Mayor Pickar asked that Staff look into it. IMPROVEMENT PROJECT 1978 -4 ACTION ON CONSTRUCTION BIDS Administrator Achen reported that the City Attorney and the engineering consultant both recommended rejection of the Project 1978 -4 bids and rebidding the project. Administrator Achen recommended that the Council authorize specifications to be revised to allow a 1979 construction season completion date of June 22, 1979. MSP (Baumgartner Rowley) to reject Project 1978 -4 bids received on September 8, 1978, and that the Council authorize the specifications to be revised to allow a 1979 construction season completion date of June 22, 1979, and that the staff be authorized to readvertise for bids with a bid opening date of October 20 at 11:30 AM. 5 ayes CITIZEN COMMENTS (CONTINUED) Duane McCarty, 8060 Long Lake Road, stated that he had earlier asked permission to use the marque in front of City Hall to advertise a Concerned Citizens group meeting for September 27 and had been told the advertisement could not be placed on the marque if the meeting was for political endorsement. Mr. McCarty presented Administrator Achen with a hand written letter stating that the meeting was not for the purpose of political endorsement. Councilmember Rowley asked if the Concerned Citizens group was the same one that Jim Bergstrom had organized for the airport issue earlier in the year. Mr. McCarty replied that it was not and that the first group was not active and the two were considering merging. Bill Doty, 3049 Bronson Drive, asked if the $1,000,000 he found in the Project 1978 -1 estimated costs was for land acquisition. Attorney Meyers replied that he had given the Council an estimate of $1,000,000 for land acquisition. Mr. Doty asked if Item D from the consent agenda referred to police salaries. Councilmember Rowley replied that it did refer to the police raises as a result of the arbitration award. She added that the City Administrator's salary had also been adjusted by the Council to keep that position in line with the others. September 25, 1978 Page 7 ADMINISTRATOR ACHEN'S REPORT Administrator Achen reported that the Council would be meeting for a budget work session after the Council meeting was adjourned. ATTORNEY MEYERS' REPORT Attorney Meyers reported that a hearing had been held on Mounds View Square's motion for a new trial and that the judge had denied the motion. COUNCILMEMBER HODGES' REPORT Councilmember Hodges had no report. COUNCILMEMBER BAUMGARTNER'S REPORT Councilmember Baumgartner reported that the Planning Commission would be meeting on September 27 at 7:30. Councilmember Baumgartner stated that two meetings earlier, Neil Loeding had given him information concerning Council action from 1972 regarding improving services and storm sewer for the City. Councilmember Baumgartner stated that after reviewing the information and minutes Mr. Loeding had given him, he felt Mr. Loeding's statements could not be substantiated. He added that one of the reports Mr. Loeding had given him dealt with Ramsey Countys open space program and did not deal with storm water problems at all. Councilmember Ziebarth agreed that the Task Force interpretation of this information seems erroneous. MSP (Baumgartner Ziebarth) that the Comstock and Davis report of June 5, 1972, regarding open space within the village which could be made available for the Ramsey County open space program be made part of the minutes. COUNCILMEMBER ROWLEY'S REPORT Councilmember Rowley reported that the Ramsey County League meeting was scheduled for September 27, to deal with open space. and that she would try to attend. 5 ayes COUNCILMEMBER ZIEBARTH'S REPORT Councilmember Ziebarth stated that the Park and Recreation department would he meeting at 6:30 on September 28. MAYOR PICKAR'S REPORT Mayor Picker reported that he had received a letter from Ton Foster of Roto Rooter regarding dredging the man made lake. Administrator Achen reported that Staff is checking into draining the lake and that Roto Rooter is indefinite about the quantity to come out of the lake. September 25, 1978 Page 8 Mayor Pickar asked that Staff check further into the situation. Attorney Meyers stated that the City should make sure they have title to any property before they allow the silt to be put on it. Councilmember Baumgartner stated that he would like to get approval from the DNR before giving the request further consideration. It is our understanding that Mounds View must give approval of any lands being considered in the Village before they can be included in the County program. Tha Comity concept considers interconnecting greenwaya, wherever possible, and utilizing them for overland drainage. If this can be accomplished, it can take the place of constructing costly storm aware and at the sane tins enhance the beauty of the Village. A good example of greenway development can be seen in Minneapolis. Years ago, some people had the foresight to plan for the beautiful parkways which are now a reality. If tLd Ramsey County Open Space System is to be successful, the planning and land acquisition must be done now while there is ntill land available for this purpose. The Council should study this report and determine whether or not they wish to give their approval of the acquisition, by the County, of tha designated lands within the Village. The decision should be made as soon as possible to assure the desired areas will be included in overall County plan. It is our understanding that the casts of land acquisition as well as development of the grammays will be borne by the County. We suggest that the Council study the Ramsey County Open Space System report which was prepared by the City of St. Paul. Said report describes the analyses of present condittona and eats forth tha concept which is now under consideration.
