PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to CALL TO ORDER order at 7:35 PM, July 9, 1979 by the Mayor. Members Present: Mayor McCarty, Council members Forslund, Hodges, Ziebarth 1. ROLL CALL Members Absent: Councilmember Rowley Also Present: Building Zoning Official Rose, City Attorney Meyers, and City Administrator Nelson The Mayor recommended the minutes of June 25, 2. APPROVAL OF MINUTES 1979 be approved as corrected. 4 ayes 0 nays There were none at this time. 3. PZTITION %COMPLAINTS OF PUBLIC Maynard Bowman re: a variance granted him on 6/21/79 by the Planning Commission for a 5.4 foot sideyard setback, conditional that no windows be installed on the south wall of the new structure toward his neighbor- -wants to appeal to remove the stipulation of no windows because of depreciation to house, loss of sunlight, heat and air. Neighbor objects due to possibility of noise trans- ferring and loss of privacy. 2ieba=th made the motiuu, Seconded by Nudges to table the matter based on inadequate information to make a decision. The motion was withdrawn. Ziebarth made the motion, seconded by Hodges for a continuance of the hearing on July 23, 1979 based on inadequate information to make a decision. *The mayor asked to abstain from voting as it involves friends and neighbors. Forslund made the motion, seconded by Hodges to approve the Consent Agenda. APPROVAL OF THE CONSENT AGENDA MOUNDS VIEW CITY COUNCIL Regular Meeting Page 2 July 9, 1979 The City owns 16.9 acres on Silver Lake Rd. and County Road H2. A LAWCON grant of $136,800 has been received to purchase as much as possible of an additional 30 -35 acres. Kraus Anderson may be willing to "swap" their land to the northwest on Silver Lake Rd. and County Rd. I. The northwest area is better suited for a high use activity area since the southwest corner is more rolling and wooded. Ziebarth made the motion, seconded by Hodges to adopt Resolution #996. 4 ayes 0 nays The Planning Commission requests Council members attend a meeting August 8, 7:00 p.m., Council Chambers, with Planning Commission, Staff and Midwest Planning, to start review for preliminary Comprehensive Plan. City will seek the help of Mounds View citizens via newspaper notification_ Mr. Meyers reported that a waiver of appeal had been received from Mr. Biem contingent .,.upon the City dropping the $2,000.00 contin- gency portion of the assessment. If the City adheres to the terms, owner will waive all rights to appeal relative to assessment pro- ceedings, and principle amount not to exceed $58,051.60, and the assessment spread over 10 years. McCarty made the motion, seconded by Hodges to adopt the amended assessment role relative to i nprov e ier t Pr j rt l978 in the amount of $58,051.60 spread over a ten -year period at 8% per annum interest. 4 ayes 0 nays Re: the short term method of paying outstanding bills and a long term payment to coincide with the assessment adopted above. Two funds are considered -Storm Drainage Management Fund, and Improvement Revolving Fund. These Funds could be repaid at the time of bonding for the Silver Lake Road project. 5. REPORTS OF COMMISSIONERS A. SILVER VIEW PARK B. COMPREHENSIVE PLAN UPDATE 6. OLD BUSINESS A. ASSESSMENTS- IMPROVEMENT PROJECT 78 -3 B. OUTSTANDING BILLS MOUNDS VIEW CITY COUNCIL Regular Meeting Page 3 July 9, 1979 Ziebarth made the motion, seconded by Forslund to pay the $50,330.23 of out- standing debts by transferring funds from the Improvement Revolving Fund. The Improvement Revolving Fund will be replenished at a rate of 87 interest. Staff should contact a bonding agent and get assurance that we can get a bond for this amount in the event of an appeal. 4 ayes 0 nays Ziebarth made the motion, seconded by Hodges to accept the resignation of Jerry Foss from the Planning Commission. 4 ayes 0 nays Ziebarth commended Mr. Foss for his many years of service and expressed appreciation for his contributions. McCarty made a motion, seconded by Hodges to appoint Peg Mountin to Planning Commi- ssion to serve the remainder of Jerry Fvss' term, and to advertise the position of ex officio member. 4 ayes 0 nays Forslund's Report: She suggested the main- tenance people be around to show the equip- ment the day of the Festival in the Park. Hodges' Report: Questioned how Council members can be informed of a disposition of a citizen concern. City Administrator suggested Councilmembers keep a copy of the request to follow up if disposition is not known. Ziebarth's Report: 1) Suggested there be a central "drop box" for information that might be of interest to other Councilmembers. 2) Invited citizens to the Festival in the Park on July 15. McCarty's Report: No report, but wished to thank Ziebarth for all his efforts on the Festival in the Park. 6B. OUTSTANDING BILLS (Continued) 7. NEW BUSINESS 8. OFFICERS REPORTS A. COUNCILMEMBERS B. REPORT Ziebarth made the motion, seconded by Forslund that we authorize Staff to nego- tiate a rider to insurance policies to cover the activities of Festival in the Park July 15, 1979. This insurance is indicated primarily for activities on the grounds, i.e., personal bumps and bruises to a maximum of $200.00. 4 ayes 0 nays 2) Nelson explained that Staff is working on a new format for meeting minutes. Dave Notaro, 2749 Ardan Avenue, asked Council if something could be done on the City storm sewer in hi __sa as his r =ter= flooded five times already this year. The Mayor explained what the City has done to date. Hodges made the motion, seconded by Ziebarth the meeting be adjourned at 9:45 PM. 4 ayes 0 nays 9. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval.
