Adjournment CONSENT AGENDA March 9, 1981 The consent agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the consent agenda and placed upon the regular agenda for debate. ITEM A. Adopt Resolution No. 1251 Approving Just and Correct Claims Against City Funds PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order at 6:58 p.m., for a Special Meeting, on March 9, 1981, by Mayor McCarty. MEMBERS PRESENT: Blanchard, Doty, Hodges, Forslund, and Mayor McCarty. OTHERS PRESENT: City Attorney Meyers, Clerk Administrator Pauley, and Building and Zoning Official Rose. Ayes -5 Nays -0 MOTION CARRIED. Call to Order Mayor McCarty stated that the purpose of this 3. Discussion of Ordinance meeting was to discuss Ordinance #301 with the #301 with City Attorney City Attorney. Meyers City Attorney Meyers advised the Council that Ordinance #301 was adopted under authority granted by Minnesota Statute 462.355 and indicated to the City Council that the impact of Ordinance #301 could be the denial of all subdivision and building permit requests for property identified in Exhibit A of Ordinance. #301. City Attorney Meyers also advised the Council that Minnesota Statutes 462.365 which relates to 1980 laws, Chapter 566 and provides specific rights to the City and property owners regarding the timing of certain issues in the subdivision process. City Attorney Meyers recommended that the City Council elect to not come into compliance with 1980 laws, Chapter 566 at this time. Doty made a motion, seconded by Forslund. that the City elect not to come into compliance with 1980 laws, Chapter 566, as cited in Minnesota Statutes 462.365 until such time as modifica- tions are made to the City Subdivision Ordinance. 4. Re -call to Order MOUNDS VIEW CITY COUNCIL March 9. 1981 Special and Regular Meeting Page Two their regularly scheduled meeting, by Mayor McCarty. MEMBERS PRESENT: Blanchard, Doty, Hodges, Forslund, and Mayor McCarty. OTHERS PRESENT: City Attorney Meyers, Clerk Administrator Pauley, and Building and Zoning Official Rose. Clerk- Administrator Pauley introduced Karen Petrangelo, the new Recording Secretary. Corrections: Doty: Page 2, Item #8, Motion: Should read as follows: Forslund made a motion, seconded by Doty to approve Consent Agenda Items A and C, "and to waive the reading of the Resolutions." Forslund: Page 2, Item #6, after Water Conservation, should read: "City maps of the wetlands MOTION: Doty made a motion, seconded by Hodges, to approve the February 23, 1981, REgular Meeting Minutes as corrected. Ayes -5 Nays -0 MOTION CARRIED. Judy Rowley, 2562 Ridge Lane, representing the Women League is '-ague o f n Voters presented copies of the of Mounds View Guide, which will be given to new residents that are moving into the City, in addition to present homeowners. Mayor McCarty instructed Clerk- Administrator Pauley to write a resolution of appreciation to the League of Women Voters on behalf of the City. Jack Downing, owner of vacant property located at Woodale and Longview Drive, asked about the moratorium that had been placed on his land and the impact that moratorium would have on his property taxes. City Attorney Meyers referred Mr. Downing to the County Assessor's Office. Sharon McCarthy, 7760 Long Lake Road, read aloud the following: "As a citizen of Mounds View I would like to express my concern and call to your attention e a h the lack of respect for the 5. Residents requests and comments from the floor MOUNDS VIEW CITY COUNCIL Special and Regular Melting Open Meeting Law that is being expressed by, 1)meetings being called at frequent agenda sessions when there is no emergency involved in the business being transacted, 2) meetings held outside and inside City Hall that are not clearly announced and are being held at hours when citizens would find it hard to attend, 3) waiving the reading of resolutions. How can you justify statements of keeping the public informed when these things are not being read? The reading of a number doesn't inform the community of the business being transacted. It doesn't take that long to. read. Also it would leave no reason for people to leave meetings held in this City feeling they had wasted their time in attendance and as though they really hadn't seen their government work for them. Also, I don't know if the Mayor and Council are aware that many times the discussions cannot be heard by its audience and especially not by the senior citizens or hearing impaired citizens of which there are many! As public officials I feel you should immediately strive to reinforce your respe for the Open Meeting Law by preventing t hese practicies from continuing. Mayor McCarty pointed out to Mrs. McCarthy that every item in the Council packet, including resolutions, was in a folder on a table in the Council Chambers for public reviewal. Further- more, the City Charter allows dispensation of reading resolutions by unanimous consent of the Council and residents or always read on request of anyone in the audience. Mayor McCarty asked if Mrs. McCarthy had the records (of the meetings that she was objecting to) and it she knew when the meetings were held. Mrs. McCarthy replied she did not. Mayor McCarty stated, "Then you are talking about something you know nothing about." There were no more comments from the floor. REGULAR MEETING CLOSED: 7:42 p.m. PUBLIC HEARING OPENED: 7 :42 p.m. Applicant requests approval of a preliminary plat called Miller Industrial Plat and rezoning of the land which presently has sections of R -1 and B -2 to I -1 for development of an Industrial Park. J Preliminary Plat Review Reaoning Case 47 -80 MOUNDS VIEW CITY COUNCIL March 9, 1981 Special and Regular Meeting Page Four Gary Comstock, Engineer, representing Mr. Miller reviewed the proposed plat. Discussion in length took place regarding the wetlands located within the proposal. Councilmember Hodges discussed the concerns that the Ramsey County Soil and Water Conservation District have regarding the wetlands located within the proposal. Mayor McCarty asked if there were any comments from the audience for the public hearing. There were none. PUBLIC HEARING CLOSED: 7:56 p.m. REGULAR MEETING RE- OPENED: 7:56 p.m. Concilmember Doty discussed the following: 1) The information that the Council had been provided by Official Rose regarding poor soils that were located on the property, water table, and substance of the soils. 2) That a piece of property located within Mr. Miller's proposal was not included in the Wetland Study. 3) He cited information and wetland data sheets that had been received from Ramsey County Soil and Water Conservation District. City Attorney Meyers asked the Council if they were familiar with the property. Mayor McCarty stated that he has walked the land himself. He stated that the only concession that has been made by the developer is the change in zoning. Councilmember Forslund stated that she has walked the property. She further stated that she was concerned about the soils and asked if soil borings had been done. Mayor McCarty stated that soil borings have been made. Mr. Comstock stated that they plan to remove the unsuitable soils. He stated that about 75 soil borings have been done. Councilmember Hodges stated that he has walked through the land several times. MOUNDS VIEW CITY COUNCIL March 9. 1981 Special and Regular Meeting Page Five Mayor McCarty asked if Mr. Miller would be willing to amend the plat. Mr. Miller stated that he was not amiable to an amended plat. Councilmember Blanchard stated that she is familiar with the property, but that she had not recently walked it, but had done so many times as a youth, and that the property had always been wet. MOTION: Mayor McCarty made a motion, seconded by Found to approve the preliminary plat for Lot 1, Block 1, and Lots 1, 2, 12 &13, of Block 2, subject to the remainder of Block 2 being designated as an outlot, to grant approval for the rezoning from R -1 B -2 to I -1, except for the land within the outlot which would be subject to the provisions of Ordinance No. 301. The vote was taken by calling of the roll. Ayes -5 Nays -0 MOTION CARRIED. Official Rose discussed the different classi- fications of Wetlands. He stated that Block 1 on the Ramsey County Soils Map indicates a wetland that needs to be studied. AMENDMENT TO THE MOTION: Mayor McCarty made a motion, seconded by Doty, to approve the preliminary plat for Lots 1, 2, 12 13, of Block only, subject to the remainder of Block 2 being designated as an outlot, and to approve the rezoning from R -1 and B -2 to I -1, except for the ror the land within the outlot which would be subject to the provisions of Ordinance No. 301. The vote was taken by Ayes -4 Nays -1 (Councilmember MOTION calling of the roll. Hodges voted nay). CARRIED. COUNCIL RECESSED FOR A BREAK: 8:26 p.m. COUNCIL RE- CONVENED AT: 8:44 p.m. AMENDMENT TO THE AMENDED MOTION: Mayor McCarty made a motion, seconded by Hodges to further amend the last action by approving the pre- liminary plat to allow development on Lot 1, 3lock 1, excepting wetland areas therein, and to grant rezoning approval from R -1 and B -2 MOUNDS VIEW CITY COUNCIL March 9, 1981 Special and Regular Meeting Page Six to I -1, on Lot 1, Block 1 for the area other than wetlands and further that the identified wetlands area be subject to the provisions in Ordinance No. 301. The vote was taken by calling of the roll. Ayes -5 Nays -0 MOTION CARRIED. Clerk- Administrator Pauley asked to have Item E removed for discussion. MOTION: Councilmember Forslund made a motion, seconded by Doty to approve the Consent Agenda (eliminating Item E) and to waive the reading of the Resolutions. Ayes -5 Nays -0 MOTION CARRIED. Clerk- Administrator Pauley asked that Item E be tabled until the March 23, 1981, City Council Meeting in order that Councilmembers who had voiced concern over this issue could have the opportunity to discuss it with him and other members of the Council. MOTION: Councilmember Doty made a motion, seconded by Forslund to table Item E until the March 23, 1981, City Council Meeting. Ayes -5 Nays -0 MOTION CARRIED. Official Rose stated that he had no report. Finance Director Brager stated that he was get- ting proposals from three different agents regarding liability and property insurance for the City. He said that he could obtain the proposals by the end of March so that Council could review them in April and a decision could be made by May 1, 1981. He further asked if proposals or bids should be pursued. MOTION: Councilmember Hodges made a motion, seconded by Blanchard, to seek proposals instead of formal bids to be received by March 30, 1981. Ayes -5 Nays -0 MOTION CARRIED. 10. Approval of Consent Agenda 11. Report of Building and Zoning Official 12. Report regarding City's Insurance Coverages MOUNDS VIEW CITY COUNCIL March 9, 1981 Special and Regular Meeting Page Seven Finance Director Brager stated that the Minnesota Statutes requires competitive bid ding when changing Group Health Insurance Plans. MOTION: Councilmember Doty made a motion, seed by Blanchard, to advertise for bids for Group Health Insurance Coverage and to close the bidding on March 30, 1981. Ayes -5 Nays -0 MOTION CARRIED. Clerk Administrator Pauley presented bids 13. Consideration of Street for street sweeping. He said that two of Sweeping Bids and Staff the bids had been invalid because of Recommendations not complying with specifications. Clerk Administrator Pauley said that he recommended that American Sweepers, Inc. be awarded the bid. MOTION: Mayor McCarty made a motion, seconded ages, to grant American Sweepers, Inc. the bid in the amount of $3,850.00. Ayes -5 Nays -0 MOTION CARRIED. City Attorney Meyers discussed that the County 14. Report of Attorney may again consider the County Court Proposal. He said that a hearing would be held on Monday, March 16, 1981, at 1:30 p.m., and that Clerk Administrator Pauley would be attending the hearing. Blanchard: No report. 15. Reports of Councilmembers Doty: He attended a meeting with the Parks and Recreation Commission on February 26, 1981, and discussed the possibility of a Joint Powers Agreement with the City of Spring Lake Park regarding Lakeside Park. He noted that some of the Planning Commission members had met with the Parks and Recreation Commission to discuss the Comprehensive Plan and the Parks Plan. He further discussed an article written by Jimmy Schwartz in the New Brighton Bulletin. Hodges: He noted a meeting that he had attended with the N.W. Suburban Youth Service Bureau. MOUNDS VIEW CITY COUNCIL March 9, 1981 Special and Regular Meeting Page Eight Forslund: She noted some of the Planning Comm sionAgenda items from their February 4, 1981 meeting. Among the items noted were the MnDOT proposal, review of Shorewood's Comprehensive Plan, and their approval of the final draft of the Housing Plan. Mayor McCarty: He noted that Irondale High School has entered the State Hockey Tournament for their 3rd year in a row. Mayor McCarty instructed Clerk- Administrator Pauley to post a notice on the bulletin board, and to also put together a resolution or proclamation for the team. Clerk- Administrator Pauley noted a telephone call from State Senator Don Frank regarding a consensus of the Council for a possible 4% gasoline tax increase. Clerk- Administrator Pauley noted that Parks, Recreation and Forestry Director Anderson had requested approval of the 1981 Forestry Contract for tree removal and set the bid opening for 10:00 a.m., March 27, 1981. MOTION: Councilmember Doty made a motion, seconded by Hodges to approve the 1981 Forestry Contract for tree removal and set the bid opening for 10:00 a.m., Friday, March 27, 1981. Ayes -5 Nays -0 MOTION CARRIED. Clerk- Administrator Pauley noted that there is trouble with the sewer line on Quincy. He noted the located of where there had been a drop in the pavement, and that today there had been a drop of 12 feet. He said that a televising crew had gone out today to televise the line. He noted that Lift Station #5 is pumping sand. He further noted that Dan Boxrud would be talking with the Metropolitan Waste Control Commission regarding a tie into their gravity main. He said that the meeting with the Metropolitan Waste Control Commission would be held either late on Wednesday or on Thursday of this week. He said that he would call the Council by Thursday, and that a special meeting may be called at 5:00 p.m. on Thursday, March 12, 1981 to discuss this issue. 16. Report of Administrator MOUNDS VIEW CITY COUNCIL March 9, 1981 Special and Regular Meeting Page Nine MOTION: Mayor McCarty made a motion, seconded may, to authorize Clerk- Administrator Pauley to take any action necessary in order to prevent back -up in this area. Ayes -5 Nays -0 MOTION CARRIED. MOTION: Councilmember Doty made a motion, sec by Hodges, to adjourn the March 9, 1981 meeting. Ayes -5 Nays -0 MOTION CARRIED.
