Adjournment CONSENT AGENDA May 11, 1981 The consent agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the consent agenda and placed upon the regular agenda for debate. ITEM A. Adopt Resolution No. 1281 Approving Just and Correct Claims Agctifl L City F in PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order -at 7:31 p m., on May 11, 1981, by Mayor McCarty. MEMBERS PRESENT: Councilmembers Blanchard, Doty, Forslund, Hodges, and Mayor McCarty. ALSO PRESENT: City Attorney Meyers, Clerk/ Administrator Pauley, Parks /Recreation and Forestry Director Anderson and Police Officer Tim Smith. REGULAR MEETING CLOSED: 7:32 p.m. 1. Call to Order. 2. Roll Call. DATE APPROVED: 5/26/81 Regular Meeting May 11, 1981 Mounds View City Hall 2401 Hwy. 10, Mounds View, MN 55112 PUBLIC HEARING OPENED: 7:32 p.m. Mr. and Mrs. Chilinski and their Attorney, 3. Public Hearing Variance William Ekstrum, were in attendance. Request (Sideyard Setbck) Mrs. Chilinski stated that they feel this var- 5242 Red Oak Drive iance request for their addition is a hardship, that it was not due to their fault. She stated that there is also a drain in the back of the property and a sewer easement in the back. Also, that the house next door is only 5 feet from their property line. She talked about the build- ing inspector being out. She has submitted a petition from all of the abutting residents. She talked about a variance that had been granted along Long Lake Road. Further, they are not creating any dangers for public safety. She stated that they feel that their pi upo addition would not diminish property values, that it would improve the neighborhood. William Ekstrum, Attorney -at -Law, asked for a show of hands on which neighboring residents were in attendance for this hearing. There were five. Mayor McCarty stated that the petition is not valid unless the Ordinance allows for the petition to be brought in. Mayor McCarty discussed variances issued by the Supreme Court. He read the definition of hardships and unique circumstances that are not due to an act of their own. Discussion took place regarding hardships and unique circumstances. Lyle Lindgren, 5236 Red Oak Drive, stated that he is a ne'jhbor whose property abuts the side where the addition is being constructed. He further stated that there are no windows on his side of the house that faces the new addition. Mr. Chilinski stated the petition was brought in to indicate to the Council that the neighbors did not disagree with the const- ruction of the addition. PUBLIC HEARING CLOSED: 7:39 p.m. REGULAR MEETING OPENED: 7:39 p.m. MOTION: Councilmember Hodges made a motion, seconded by Councilmember Doty to approve the Variance for the sideyard setback at 5242 Red Oak Drive. Discussion of the Motion: Hodges: He feels that the hardship was caused by circumstances that were beyond their control. Also, that the construction was taken too far before it was stopped. Doty: He feels that there are alternatives that could have been made, but that the construction has gone too far for a revision to be made. McCarty: Due to an action not under the control of the homeowner and that they were victim to another parties action. Vote was taken by calling of the roll. 5 ayes 0 nays MOTION CARRIED. It was noted that Mr. Engel was not in atten- dance. Clerk /Administrator Pauley stated that staff was recommending that a verbal reprimand be given. Summary of Discussion: Administrative costs that this error has cost the City additional Administrative costs. Contractor should have attended the meeting. That the contractor had not been issued a Building Permit before starting construction on the addition. MOTION: Mayor McCarty made a motion, seconded by Councilmember Hodges to direct staff to send a letter to Mr. Engel reprimanding him for work that was done on the addition without the issuance 4. Review of Contractor's License David J. Engel MOUNDS VIEW CITY COUNCIL Regular Meeting of a Building Permit, also that the Permit fees be doubled as per Chapter 59, Section 2. 5 ayes 0 nays MOTION CARRIED. Corrections: 5. Forslund: Page 2, 2nd paragraph, should read Si' ated that she feels that a Conditional Use Permit can be applied for and granted for an accessory building in the R -1 if the build- ings are over 216 square feet and use less than 25% of the rear yard Page 10, 4th paragraph, after the word "commun- ications" the rest of the sentence should be deleted. MOTION: Councilmember Forslund made a motion, seconded by Councilmember Blanchard to accept the Minutes of the April 27, 1981, Regular Meeting as corrected. 5 ayes 0 nays MOTION CARRIED. There were no comments from the audience. Jerry Linke, 2319 Knoll Drive, stated that he 7. would like to be kept more informed of what is going on at the meetings. Mayor McCarty stated that the entire agenda was in a book on the table tor that purpose. Mayor McCarty gave a short review of all of the Consent Agenda items. Item A: Should be May 26, 1981, instead of May 25, 1981. Item J: Funds to be taken from the Lakeside account and put into the contingency fund. Item K: Date should be May 26, 1981, instead of May 25, 1981. Councilmember Blanchard stated that she would like Item F removed from the Consent Agenda for discussion. MOTION: Councilmember Doty made a motion, seconded by Councilmember Hodges to approve the Consent Agenda (eliminating Item F) and to waive the reading of t'o Resolutions. 5 ayes 0 nays MOTION CARRIED. Councilmember Blanchard asked why the Garbage and Rubbish Haulers Licenses had expired. Clerk/ May 11, 1981 Page 3 Approval of the April 27, 1981, Regular Meeting Minutes. 6. Residents Requests and Comments from the Floor. Approval of the Consent Agenda. MOUNDS VIEW CITY COUNCIL May 11, 1981 Regular Meeting Page 4 Administrator Pauley stated that it was because the renewals had not gone out on time. Parks /Recreation and Forestry Direction Anderson discussed in length Item F of the Consent Agenda. He stated that up until four months ago Lakeside Commission had managed the beach, but that the management and administration of activities would be taken over by the City of Mounds View and that the day to day maintenance of the site would be done by the City of Spring Lake Park. George Gustafson, 8391 Spring Lake Road, asked who holds the title for the property. Mayor Duane McCarty stated that the title was held by Playground, Inc. Discussion in length took place regarding the park. MOTION: Councilmember Forslund made a motion, seconded by Councilmember Doty to approve Item F of the Consent Agenda and to waive the reading of the Resolution. 5 ayes 0 nays MOTION CARRIED. George Gustafson, 8391 Spring Lake Road, asked 8. if the Council would bring them up to date of what has transpired at previous public hearings. Mayor McCarty discussed the previous hearings. Attorney Meyers stated that the Ordinance in question restricts the parking of over one ton trucks on private property in residential districts. He discussed the proposed changes. George Gustafson, 8391 Spring Lake Road, asked if unrestricted parking 15 feet off the streets was going to be allowed. He stated that he feels that it would be a big mistake. He stated that it would be bad for appearances in the Village. He stated that he has sold real estate for the past 20 years, and that people that want to sell their homes that have neighbors with trucks, would have to probably drop the asking price of their house $10,000 to $15,000. He feels that consideration should not be given for big trucks parking within residential areas. Harold Finney, 7624 Spring Lake Road, stated that he owns a dump truck, that it is not a road truck, and that his truck is no larger than many recrea- tional vehicles. Tom Foster, 2516 Ridge Lane, agrees with the statements that were made by George Gustafson. 2nd Read of Ordinance No. 303 Amending the Municipal Code of Mounds View by amending Chapter 81, Entitled "Parking MOUNDS VIEW CITY COUNCIL Regular Meeting Julienne Sprunck, 2649 Louisa, stated that he moved to Mounds View 3 1/2 years ago because it was pleasant and quiet. He talked about the noise from trucks that had been parked on the Burlington Northern property near his home. Further that he was opposed to the changing of the present Ordinance. Robert Shelquist, 8025 Fairchild, asked why the Ordinance is being changed at this time. It was stated that it had been requested by the people. He stated that 15 out of 17 persons that had signed in at the April 27, 1981, Meeting had been in opposition to the changing of the Ordinance. He read many exerpts from Ordinance 67 that had been adopted in 1960. He further stated that Zoning Ordinances from 1968, 1970, 1972, and 1974, had precluded or prevented the parking of truck vehicles in residential areas. He stated that he feels that there is a small majority of people who want the Ordinance changed. He talked about financial aspects, limiting the sale of homes. He further stated that he opposes any change to the present Ordinance. Councilmember Doty stated that he is concerned regarding tractors running during the night that would become a nuisance. Further he discussed the parking of boats, travel trailers, campers, motor homes etc. Further that many people park vans which are used as part of their work. He stated that he does not want to restrict people from using their property in a restrictive way. He state that people should tile complaints when things become a problem so that the problem can be resolved. Further, that this Ordinance for trucking has not been an enforceable one. Jerry Linke, 2319 Knoll Drive, stated that he does not feel that it's a valid argument that they cannot enforce the Ordinance. He thinks that it would not be good to rescind the Ordinance that benefits the majority of the people within the City. Further that people who want the Ordinance rescinded should go through the Charter process. Betty Shelquist, 8025 Fairchild, stated that she feels that the Ordinance can be enforced. She stated that the PCA could enforce violations. Further that there are State Standards regarding noise abatement. She feels that the City Council has the responsibility to enforce the Standards. She talked about residents that do not have trucks. She talked about sections of the 1960 Ordinance. Further discussed noise, unsightliness and drop in May 11, 1981 Page 5 MOUNDS VIEW CITY COUNCIL May 11, 1981 Regular Meeting Page 6 real estate values. Also, that she feels that there are 12,900 plus citizens that do not want trucks parked in residential areas. Mayor McCarty discussed in length the PCA noise level requirements. He stated that there presently are areas on County Road J that are in violation of the regulations. Further that there have been no truck accidents within the City. Further that there have no injuries resulting from the operation of trucks, or damage to property. He stated that fumes, odors, gas and, smoke problems are covered under the Nuisance Ordinance. He talked about diminishing of aesthetic values. He stated that many recreational vehicles are as large as trucks and that they can be parked without restrictions. He discussed the 5 foot setback which precludes the parking of a truck. He discussed Ordinance 90 and 91. He stated that he supports Ordinance No. 303. The enforcement of the Ordinance was discussed in length. Barb Haake 3024 County Road I, asked if they could tell the truck owners not to park there. Mayor McCarty stated that the Police Department can keep tagging and the truck owners can keep paying the fines. Ms. Haake stated that she does not feel that the changing of the Ordinance is what the majority of the people want. She speaks against the changing of the Ordinance. Mayor McCarty stated that the truckers have indicated that they gave a petition to the City with 700 names on it that were in opposition to the Ordinance. The original petitions were discussed. Mayor McCarty stated that he feels that there is ahni_ut 50/50 split at this time. He stated that he had called several of the people who had originally signed the petition in favor of the previous Ordinance. He discussed some of their comments. He further stated that out of 438 tags that have been issued, 228 have been issued to one person. Gerald Tesch, 5135 Long Lake Road, stated that !•then he bought his home in 1952, there was a truck parked at the time next door. He stated that when he purchased his home the City had valued it at $10,000 and that it was now valued at $54,000, and he feels that the truck that is parked is not degrading the value of his property. Sharon McCarthy, Planning Commission Member, stated that she would like to see the limiting of the number of vehicles that can be parked on the yard and that they would have to be on a paved surface. She talked about the parking of 3 or 4 mobile homes at one time. She stated that 65 dba's is an okay level and that trucks are 84 dba's. Further that she feels that MOUNDS VIEW CITY COUNCIL Regular Meeting Councils job is to keep peace between the neighbors. She feels it is important for everyone to become involved, and would like to have the issued put to the citizens for a vote. Gerald Fields, 2255 Lambert, he would like to have a safe place where he can park his truck. He stated that his truck was purchased last year at a cost of $72,000. He does not think that his truck is any louder than a snowmobile. Further that he would rather pay the $5.00 fine than to park his truck elsewhere. He stated that he does not believe that there are anymore than 25 or 30 trucks that park within the City. Documentation of the original petitions was dis- cussed in length. It was stated that the petition with 300 names in favor of the Ordinance had been mentioned in the Minutes, but that no petition had been found. Doris Olson, 8101 Edgewood, asked why it has taken 21 years to bring up the complaint about trucks. Mrs. Delbert Stimpson, 5132 Long Lake Road, stated that when the people next to their home bought their house, her husband's truck was parked in the yard at the time. MOTION: Councilmember Doty made a motion, seconded by Councilmember Forslund to approve the 2nd reading of Resolution No. 303 and to adopt Resolution No. 303. Vote was taken by calling or the roll. 3 ayes 2 nays (Hodges and Blanchard voted nay.) MOTION CARRIED. Clerk /Administrator Pauley read Ordinance No. 303. Councilmember Doty asked if staff would prepare some guidelines prohibiting the parking of semi's, flatbeds, and refrigeration trucks. May 11, 1981 Page 7 MOUNDS VIEW CITY COUNCIL May 11, 1981 Page 8 Regular Meeting COUNCIL RECESSED FOR A BREAK: 9:17 p.m. COUNCIL RE- CONVENED: 9:31 p.m. Mayor McCarty stated that a year ago a petition had been brought in by the garbage haulers asking that the size of containers be increased and that they could pickup garbage at the curb. He sta that they were asking to allow containers to be 80 gallon maximum, and that cans be placed on the curb up to 12 hours before pickup and 12 hours after garbage pickup. MOTION: Mayor McCarty made a motion, seconded by oouncllmember Doty to approve the 1st reading of Ordinance No. 304. The vote was taken by calling of the roll. 5 ayes 0 nays MOTION CARRIED. Attorney Meyers reviewed the changes to the proposed Ordinance Amendment. Consensus of the Council was to pass discussion on this Ordinance. NO ACTION WAS TAKEN. Those in attendance were: Ed Donatelle, Joe 11. Ryan, Attorney, 7039 Knollwood Drive, and it was indicated that the architect was also in attendance. Mr. Ryan stated that there is a good deal of work that is going to be done such as: building would be sprinkled, additional exit added, new wash room facility on the main level. He stated that they were eliminating the bottle shop an6 that he feels this will eliminate alot of the in and out patterns. Discussion in length took place regarding the security deposit. Clerk /Administrator Pauley stated that staff had met with Sherman Rutsick and that he had indicated a willingness to sell Mr. Donatelle a one acre site. Councilmember Doty stated that there is parking on the easement off the property on H -2, and also that the building is on the easement. The use of ease- ments was discussed in length. Attorney Meyers stated that placing of a structure on an easement is a risk factor because the structure may at some time need to be removed. 9. 1st reading of Ordinance No. 304 Amending Municipal Code of Mounds View by amending Chapter 104, Entitled "Garbage and Rubbish 10. 1st reading of Ordinance No. 306 Amending Municipal Code of Mounds View by amending Chapter 50, Entitled "Parks and Play- grounds". Donatelle's Supper Club Development Review 2400 Hwy. 10 Resolution No. 1282 MOUNDS VIEW CITY COUNCIL Regular Meeting Discussion in length took place regarding the security deposit. Mr. Donatelle stated that he would pursue the purchase of additional land. MOTION: Mayor McCarty made a motion, seconded by Councilmember Hodges to adopt Resolution No. 1282 for the remodeling of Donatelle's Supper Club, and further that a $500 administrative escrow would be required to cover administrative costs. 5 ayes 0 nays MOTION CARRIED. Official Rose stated that the developer of 12. Order Feasibility Study Silver Lake Woods was petitioning for 100 percent for P.U.D. Silver Lake of the improvements. Official Rose reviewed the Woods Resolution No. request. He stated that staff was recommending 1283. the ordering of a public hearing to order a Feasibility Study. He stated that the cost of the Feasibility Studay was going to be $8,000, and that fees would be submitted by the applicant. MOTION: Councilmember Forslund made a motion, seconded by Councilmember Blanchard to adopt Resolution 1283 and to waive the reading of the Resolution. 5 ayes 0 nays MOTION CARRIED. MOTION: Councilmember Forslund made a motion, seconded by Councilmember Doty setting a public hearing on June 8, 1981, di 7:40 p.m. for a Planned Unit Development petition, subdivision, and zoning, and public improvement according to Chapter 26 for the Silver Lake Woods Proposal. 5 ayes 0 nays MOTION CARRIED. Parks /Recreation and Forestry Director 13. 1st Quarter 1981 Staff Anderson made a presentation of the Parks/ Report of the Parks /Recreation Department 1st quarter report. Summary of Report: 150 baseball and softball teams for the summer, totally run by volunteers. There are 48 teams on the Irondale Baseball Assoc. Specifications are being completed for Silver View Park. May 11, 1981 Page 9 MOUNDS VIEW CITY COUNCIL Regular Meeting Completion of the electrical installation has been made to the picnic shelter. Park Board Referendum Tax Force. Park Commission Meeting on May 21, 1981. Preliminary grant application for Phase II of Silver, View! Park. Joint Powers Agreement with school district regarding Edgewood Park. No football this fall because of new use of the fields. 14 trees were donated to the park system. Two trees were conifers valued at $800 each. Wood pile survey has been completed. Planted 2,500 trees in Arden Park, making total 4,000. Three newletters sent out. 2,000 Ball Field Permits issued. Lakeside Park Commission Meeting May 30, 1981. Student intern from University of Wisconsin to work in Park Department. Police Officer Tim Smith made a presentation of Police Report. Summary of Report: Police Officer's Chambers and Krogg were injured. $300 repair bill for squad car #2792. Clerk /Administrator Pauley stated that the new squad cars should be here in a month. MOTION: Mayor McCarty made a motion, seconded by Councilmember Forslundto authorize Clerk/ Administrator Pauley to transfer funds out of Account #4704 for the repair of Squad Car #2792. 5 ayes 0 nays MOTION CARRIED. Offical Rose presented the Building and Zoning Report. May 11, 1981 Page 10 Summary of Report: 25 Building Permits, 35 Merchanical Permits issued. 217 new inspections and 312 reinspections made. 13 Planning cases. Comprehensive Plan is at Metropolitan Council. Permanent hire of Planning Secretary. Parks /Recreation and Forestry Director Anderson 14. Awarding of 1981 -1982 Tree made a presentation of the 1981 -1982 Tree and and Stump Removal Contract Stump removal Contract. He discussed in length the bid tabulation process. MOUNDS VIEW CITY COUNCIL May 11, 1981 Regular Meeting Page 11 r^1 MOTION: Mayor McCarty made a motion, seconded by Councilmember Blanchard to authorize the Mayor and staff to enter into the 1981 -1982 Tree and Stump removal Contract. 5 ayes 0 nays MOTION CARRIED. Attorney Meyers made a presentation of Ordinance No. 305. He stated that presently Ordinance 301 is in force which prohibits wetland development. Discussion in length took place regarding the Ordinance. Summary of Discussion: Require buffering. Setting criteria. Flowage into the wetland. Avoidance of adverse impacts. Consensus of the Council was to discuss this Ordinance further at their next agenda meeting. NO ACTION TAKEN. 5 ayes 0 nays MOTION CARRIED.
