CONSENT AGENDA June 22, 1981 The consent agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the consent agenda and placed upon the regular agenda for debate. Adopt Resolution No. 1312 Approving Just and Correct Claims Against City Funds PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order by Mayor McCarty at 7:30 PM, on June 22, 1981. MEMBERS PRESENT: Councilmembers Forslund, Blanchard, Doty, Hodges and Mayor McCarty. ALSO PRESENT: Clerk /Administrator Pauley, City Attorney Meyers and Building and Zoning Official Rose. Motion /Second: Hodges /Forslund to approve the minutes of the June 8, 1981 meeting as corrected. 0 nays Doug Dindoft, 2901 Oakwood Drive, read a pre- pared statement, expressing his and his neighbors concerns regarding a proposed condo- minium development in their neighborhood. He asked if the City could go ahead and rezone the property in question to medium density, from R -4, as called for in the Comprehensive Plan. Attorney Meyers replied that Cities must be very cautious about rezoning pro- perty without the owner's request, as they could be found liable for damages. Mayor McCarty added that the City has taken the position to work with each developer as they come before the City. He added that he could understand Mr. Dindorf's concern and recommended that he attend the City meetings where the development is to be discussed, to express his opinion. Mayor McCarty purchased five buttons for the Festival in the Park from Frank Holm, of the Festivities Commission. Shirley Munholand, also the Festivities Commission, gave a rundown the planned activities. Motion /Second: Hodges /Blanchard to approve the final plat of the Richard Charbonneau Addition, adopting Resolution No. 1316, accepting Development Agreement 81 -46 as amended, and adopting Resolution No. 1315, and waive the reading of the resolutions. 5 ayes 0 nays 5. No. 1315 Motion Carried Mounds View City Council Regular Meeting tion /Second: Forslund /Doty to have the first reading of Ordinance No. 307, an ordinance amending the municipal code of Mounds View by amending Chapter 41 entitled Specific Rezonings. 5 ayes 0 nays Motion /Second: Doty /Forslund to approve the minor subdivision and Resolution No. 1313 and Resolution No. 1314, and Development Agreement 81-45, and waive the reading of the resolutions. 5 ayes 0 nays Mayor McCarty expressed concern with the way the improvements on the project would be assessed. Official Rose explained that he had spoken to the County and that as long as the City certifies the assessments with the County, they could be flexible. otion /Second: Hodges /Blanchard to approve the Silver Lake Woods P.U.D. by adopting Resolutions No. 1318, 1319, 1320 and 1321 and waive the reading of the resolutions, to include the amendment to No. 1320. 5 ayes 0 nays Official Rose reported that Kraus Anderson has requested tax exempt financing and suggested the public hearing be set for July 13, 1981. Motion /Second: Doty /Forslund to set a public hearing concerning the Kraus Anderson develop- ment on the north side of County Road I for tax exempt financing, to be held at 7:40 PM on July 13, 1981, adopting Resolution No. 1322 and waive the reading. 5 ayes 0 nays Motion /Second: Doty /Forslund to direct Staff to contact tie attorney on the matter of the -reneral obligation bond sale of $1,600,000. ayes 0 nays June 22, 1981 Page Three 9. No. 1321 Motion Carried Motion Carried Motion Carried Mounds View City Council June 22, 1981 Regular Meeting Page Four official Rose reported that Tyson Trucking gas requested to be placed on the July 13 agenda, to discuss both tax exempt financing and to present the data of a study being done concerning a potential noise problem on the property they would like to develop. Motion /Second: McCarty /Hodges to set a public hearing in reference to the proposed changes to the Tyson Trucking development on July 13, 1981 at 7:50 PM, and for the tax exempt financing, adopting Resolution No. 1323 and waive the reading. 5 ayes 0 nays Official Rose discussed the improvements that are currently being made to the Edgewood School property. He stated that the MWCC would like to give a parcel of land to the school, where their lift station is located, and with the way the law reads, they must first give it back to the City, and then the City give it to the school. He added that he was also discussing the possibility of the MWCC giving another parcel of land to the City to use fora cold 'torage building. Motion /Second: McCarty /Doty to direct the Building and Zoning Official to pursue nego- tiations with the MWCC for cold storage space. 5 ayes 0 nays Motion /Second: McCarty /Forslund to authorize the City Attorney to continue negotiations with the MWCC to expedite the property transfer to the school. 5 ayes 0 nays Official Rose requested Council approval for the general contractors license for E. T. Hughes, which had not been included in the development agreement which had been approved earlier. Motion /Second: Blanchard /Doty to approve the general construction license of E. T. Hughes for license year 1982. 5 ayes 11. Motion /Second: Doty /Forslund to revoke the license of Future Fence on the grounds that they have failed to provide insurance. 5 ayes 0 nays Official Rose reported that he had received a letter from the attorney of Tyson Trucking, expressing concern with the SDM charge for their proposed development. Mayor McCarty replied that the SDM charge has presented problems many times and suggested that the Council discuss it at their next agenda session. Official Rose discussed his memo to the Council regarding the Water Quality Management Plan. otion /Second: McCarty /Forslund to direct Staff p convey to the MWCC support of Alternate #2. 5 ayes 0 nays Attorney Meyers reported that he had researched Laws 1980, regarding subdivision laws, per the Council's request, and summarized his findings. Attorney Meyers reported that he had been request- ed to provide the police reports to the widow of the homicide victim from the Launching Pad, and that he had denied ;he request, due to the privacy laws, and that the City is now being sued to have them released. He explained that if he had released them, the City could also have been sued by the individual involved in the case. He added that they will await a judge's opinion on whether they should be released. Attorney Meyers reported that he had read the draft Master Plan for the Anoka County Airport and reviewed it. He also reported that the Council would be meeting with the Rice Creek Watershed District on June 24. Mayor McCarty asked that it be noted that the Council would be meeting at that time. Councilmember Blanchard reported that she would have a report to give the Council at the June 25 meeting, concerning the League of Cities conference. Councilmember Forslund reported that she had attended the Wetlands Conference and felt it was very valuable. Mounds View City Council Regular Meeting Councilmember Hodges had no report. Mayor McCarty reported that copying costs were accelerating and requested that a fee be set. /Second: McCarty /Doty to have Staff large five cents per sheet for copying public records at City Hall for individuals. 5 ayes 0 nays Motion /Second: McCarty /Forslund to direct the Clerk /Administrator to give the Council a detailed and comprehensive report regarding detachment or anexation proceedings. 5 ayes 0 nays Clerk /Administrator Pauley reported that the quality of work on the Quincy Street sewer repair has been very good and that it should be finished in another week. Clerk /Administrator Pauley reported that a committee will review the applications for the I I study and submit a recommendation of three applicants for Council consideration Clerk /Administrator Pauley reported that the Finance Director will have a report ready soon z what the Legislature did during the last ��ession.
