Adjournment CONSENT AGENDA August 24, 1981 The consent agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the consent agenda and placed upon the regular agenda for debate. ITEM A. Adopt Resolution No. 1350 Approving Just and Correct Claims Aginst City Funds PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Regular Meeting August 24, 1981 Mounds View City Hall 2401 Hwy. 10, Mounds View, MN 55112 The Mounds View City Council was called to order 1. Call to Order by Mayor McCarty at 7:30 PM on August 24, 1981. MEMBERS PRESENT: Councilmembers Doty, Forslund, 2. Roll Call and Blanchard, and Mayor McCarty. It was noted that Councilmember Hodges had an excused absence. ALSO PRESENT: Clerk /Administrator Pauley, City Attorney Meyers and Building and Zoning Official Rose. Motion /Second: Blanchard /Doty to approve the minutes of the August 10, 1981 meeting as ,.„presented. 'ayes 0 nays 1 abstain Mayor McCarty stated he was abstaining from the vote as he had not been present at that meeting. Motion/Second: Doty /Forslund to approve the minutes of the August 17, 1981 special meeting as corrected. 4 ayes 0 nays Motion /Second: Doty /Blanchard to approve the minutes of the August 18, 1981 special meeting as presented. 4 ayes DATE APPROVED: 9/14/81 3. Approval of Minutes Motion Carried Motion Carried 0 nays Motion Carried Harry Gumm, 7805 Greenwood Drive, stated he had 4. Residents Requests signed a petition regarding the recent election, and Comments from and had then received a call the night before the Floor the election and was asked how he was going to vote. He asked that the person in question be reprimanded. iyor McCarty asked Clerk /Administrator Pauley place the issue on the next agenda for discussion, and asked him to send the pertinent information to the Charter Commission. Mounds View City Council August 24, 1981 Page Two Regular Meeting ssell Paul, 7940 Greenfield Avenue, stated he aad also received a phone call from the Mounds View People for Parks Committee, asking him how he was going to vote. Mayor McCarty replied that they would look into the situation and see if any laws had been violated. He explained that the City Council had charged the Parks Commission with seeing that the residents were informed, and that a subcommittee had been formed, and many other groups came forward to help. He also asked Staff to check into the DFL inserts that were placed in the circulars to see if any violations had occurred. Mr. Paul also stated he felt the recent seal coating project that had been done in the City was of poor quality, with the streets being uneven. Mayor McCarty replied that it would be looked into. Bob Schmidt, 8110 Edgewood Drive asked if Silverview Park had been part of the bond issue. Mayor McCarty replied that it had not. otion /Second: Forslund /Doty to approve the .onsent agenda as presented and waive the reading of the resolutions. 4 ayes 0 nays Jack Thesenga, of Nasco North Central, Inc., requested on behalf of four businesses; located in the Mounds View Industrial Park, that the City discontinue the practice of billing sani- tary sewer costs for water used in lawn sprinkling. He added that the City had desired they use separate water meters when installing their automatic lawn sprinklers. Official Rose stated that the City had never required any development to install automatic lawn sprinklers, and that the four businesses had installed them by their own agreement. Clerk /Administrator Pauley pointed out that there was no documentation from meeting minutes or applications or permits where it was ever required that the applicants install an automatic sprinkling system. Thesenga stated that they could have put in their own well for sprinkling, had they known the cost involved in using the City water. Mayor McCarty replied that it would not have been allowed by the ordinance. He also explained how 5. Approval of the Consent Agenda Motion Carried 6. Presentation by Mounds View Industrial Park Owners Regarding Sewer Billing Procedures Mounds View City Council August 24, 1981 Regular Meeting Page Three to sewer charges are billed to the City and how the City in turn bills the residents. Clerk /Administrator Pauley noted that Mr. Thesenga and the :they businesses involved had been billed an estimated charge for the first year, before a determination was made as to how much water they were actually using, which was why their bills seemed to increase so much. Mr. Thesenga stated he did not feel they should have to pay the same rate as everyone else for sewer, when it was just water they were putting into the ground. Mayor McCarty again explained the rational of the billing. Motion /Se..:ond: McCarty /Forslund to deny the re- quest from Mr. Thesenga and the Mounds View Industrial Park Owners. 4 ayes 0 nays Attorney Meyers explained the purpose of the —SDM fund. He also recommended that Staff tudy the amount of the SDM charge and try to determine how much future development will go in and how much revenue will be generated by the charge, as well as a plan on how the money will be used. He added that it has been determined that the newly developed properties in the City are what is creating the run -off problems. Mayor McCarty explained the rational of the SDM ordinance for those present. Motion /Second: McCarty /Doty to direct Staff to prepare a recommendation to the City Council for a comprehensive study of the Storm Drainage Management ordinance and its future inpact, reference collection and anticipated uses. 4 ayes 0 nays Mr. Riggs stated he felt he had been double billed as he had been required to make extensive improvements, such as concrete curbs, storm sewer, culvert and grading, the time his plat was approved, and then w as assessed an SDM charge on every lot but the first two he took out building permits for. He also stated that the City was not maintaining the culvert, as it had been plugged up for two years. Motion Carried 7. Presentation by Joseph D. Consideration of Letter from Riggs Construction Company Regarding SDM Charge Mounds View City Council August 24, 1981 Regular Meeting Page Four fficial Rose explained that the required improve ients had occurred befor the SDM charge was enacted, and the first two homes built, and that the SDM charge was then assessed to the remaining lots. Mayor McCarty informed Mr. Riggs that the Council would consider his input and look into the matter. Councilmember Doty asked that the Maintenance Department check into the plugged culvert. Councilmember Forslund asked that Staff look into the charges being assessed to the developer. Motion /Second: Doty /Blanchard to table the request of Mr. Riggs until such time as the ordinance is resolved. 4 ayes 0 nays Motion /Second: Forslund /Blanchard to set Pat Michna's probationary salary at $5.65 per hour, retroactive to August 7, 1981 nd that a part -time clerk /typist position a advertised, with authorization to start t $4.00 per hour. 4 ayes 0 nays Clerk /Administrator Pauley stated that he had contacted the resident who did not sign the petition, and that resident did not want to have a streetlight placed on his property. a;:�_ __i �m. Mayor McCarty recommended looking into Reso- lution No. 1069, to see whether a home owner could stop a light from being put in, in a case where it is highly recommended or needed. Motion /Second: McCarty /Forslund to approve two streetlights on the north and south, as pro- posed, and have Staff provide a recommendation from the Chief of Police on the necessity of 'le third light. Consideration for Streetlights on Red Oak Drive and Staff Recommendation Motion Carried Mounds View City Council Regular Meeting Page Five ,l Jerk /Administrator Pauley explained that the ogosiiare required to be placed on the sides of City vehicles in order to obtain a tax exempt status for license plates. He stated that the funds would have to come from the contingency as it was not a budgeted item. Mayor McCarty reminded the Council of their firm resolve to not use the contingency funds. Motion /Second: McCarty /Doty to have the Department Heads find funds from their present budgets to purchase logos for the vehicles in their departments. If such funds are not available, the logos should be budgeted for in the 1982 budget. 4 ayes 0 nays Mayor McCarty noted that the bid tabulation had been received for the Silverview Park rough and final grading. He noted, however, that the bidders did not bid on the same amount of work, as Mary Anderson Construction ad included the work they had done to date, end thus their bid involved more work and was higher than the other bidders. Motion /Second: McCarty /Forslund to reject all bids and readvertise, with a bid opening date of Tuesday, September 8 at 1 PM. 4 ayes 0 nays Official Rose reported that the Planning Commission had denied the variance request of Harold Hjelle, and that he would like to appeal the denial to the Council. Motion /Second: Doty /Forslund to set a public hearing for September 14, 1981 at 8 PM for Harold Hjelle, 5161 Red Oak Drive. 4 ayes 0 nays Attorney Meyers had no report. .uncilmember Forslund reported that vandalism seems to be increasing in the City and that additional lighting will be requested by the citizens. Reports of Council members Mounds View City Council August 24, 1981 Regular Meeting Page Six s^1 ouncilmember Forslund reported that a Housing *Conference for local officials would be held on September 14 at the Sheraton Inn Northwest. Clerk /,Administrator Pauley added that additional information will be provided to the Council on the conference, and that if the budget allows, they could send some members of the Planning Commission, as the registration fee is $12.50. Councilmember Forslund reported there would be a sludge site meeting held in Coon Rapids on September 10 at 8 PM. Councilmember Blanchard had no report. Councilmember Doty reported that there were several park buildings that were not up to code, and recommended looking into using revenue sharing funds to move the buildings to cement slabs and repair them to meet code. Mayor McCarty recommended that the issue be brought before the Park and Rec Commission. Councilmember Doty reported he had attended League of Cities meeting regarding pensions, abor relations and so forth, and that they are working on the areas they will be lobbying for in the Legislature. Mayor McCarty reported that they are close to having the final recommendation ready to present to the Met Council on the airport, and that they hope that within nine months there will be a change in the regulations. He added that he had received a letter that Arden Hills and Spring Lake Park had opted out of the airport fight. Mayor McCarty requested that Staff submit a recommendation for the manhole on Ardan Avenue, such as cost, etc. Clerk /Administrator Pauley replied that the City does not have the equip- ment to do the work so they would obtain estimates on contracting the job out. Mayor McCarty stated he was concerned with the property around the southeast edge of Spring Lake, since the vehicle barrier had been removed and cars and trucks were driving on the grass, which had eroded away. He stated he would like to get 'le approval of the St. Paul Water Works and Ramsey _,Junty to get some controls enacted. Mounds View City Council August 24, 1981 Regular Meeting Page Seven otion /Second: McCarty /Doty to direct Staff to install or repair the barricade that has been broken out of the southeast edge of Spring Lake, and have the area policed. 4 ayes 0 nays Attorney Meyers suggested that they check into making it a trespassing v3.olation. Mayor McCarty stated he would like Staff to research the thought of basing an accessory building size on the percentage of lot area. He stated he felt the —additional $650 was required as they did not want o cut services. Clerk /Administrator Pauley replied that Park Director Anderson had revised the figures down as he felt some costs had been overestimated. Mayor McCarty replied he would check with Park Director Anderson when he returned from his vacation. 4 ayes Clerk /Administrator Pauley reported that per g he salary administration program review I uidelines, he was currently reviewing salaries and would be making recommendations to the Council soon.
