It was noted that Councilmember Hodges was absent, as well as Attorney Meyers. ALSO PRESENT: Clerk /Administrator Pauley and Building and Zoning Official Rose. He added that they are waiting for a legal opinion from the City Attorney before Mounds View City Council November 24, 1981 Regular Meeting Page Two roceeding further. Official Rose added that Asphalt Driveway Co. has been notified not to do any further work, pending the opinion from the attorney. Russell Paul, 7940 Greenfield Avenue, stated he was concerned with cracks in the City streets, and the washboard effect after their repair. He stated he had brought it to the Council's atten- tion earlier but had not heard back from them. He added he was not satisfied with the work the City crews were doing. Mayor McCarty apologized for a lack of communica- tion, since it had been his understanding Mr. Paul was going to get back to him after repairs were made. He added he had checked with the involved Staff and had been assured the work was being done properly. He added that the City always insures that professionals do the work within the City. It was the concensus of the Council that Mounds View does have very good streets. '4ayor McCarty closed the regular meeting and pened the sewer rates public hearing at 8:01 PM. Clerk /Administrator Pauley reviewed the proposed budget and expected increases in cost to the City from the MWCC. He stated that Staff recommends the entire increase be passed along to the consumer, as they do not feel they can cut services further. He added that the rate increase does not include a root control program, which would increase the cost approximately 25 cents per REC. Mayor McCarty asked for clarification and more information from Solidification, Inc. on their proposal for sewer root control. He asked specifically for the chemical content of the solution proposer: to be used, and that a representative of Solidification, Inc. appear before the Council to answer questions. Clerk /Administrator Pauley stated he would have him present at the next meeting. Motion /Second: McCarty /Doty to table action on sewer rates and the proposed root control until December 14, 1981. ayes 0 nays 'Mayor McCarty closed the public hearing and reopened the regular meeting at 8:32 PM. 5. Approval of from the consent agenda. Consent Agenda Motion /Second: Doty /Forslund to approve the consent agenda, minus Item B, and waive the reading. 4 ayes 0 nays Councilmember Doty asked for a clarification of the change order for Silver View Park. He stated that he felt once an agreed upon price had been establish- ed, it should be maintained. Park Director Anderson explained the change orders thrt have been approved to date, and the necessity for this particular one. He stated that the overrun was unforeseeable as there was not the anticipated amount of fill from the ponding area, so fill had to be brought in. He added that including the proposed change order, the project is still $7548.85 under budget. Motion /Second: Doty /Forslund to approve Item B of the consent agenda. ayes It was the concensus of the Council that it was 7. Review the Purchase very important for them to get together with Staff of Winter Maintenance as quickly as possible and go over the budget, Equipment with no action on purchases to be taken beforehand, in light of the present budget problems in the State and City. Motion /Second: McCarty /Blanchard to table any major equipment purchases. 4 ayes 0 nays 0 nays Motion Carried Park Director Anderson stated that without the purchase of this equipment, they would have to cut back on the winter skating program. He added that there is an older International tractor that could be repaired, at an estimate of $2,383. It was the concensus of the Council that it would be worthwhile to have the tractor repaired and put into use. Clerk /Administrator stated he would instruct the Public Works Superintendent to we the repairs made. Councilmember Doty asked what the cost would be to rent another park trailer for the season, in Motion Carried Motion Carried 8. Consideration of Lampert Park Building Construction Mounds View City Council November 24, 1981 Regular Meeting Page Four ight of the fact that the Jaycees would not be able to assist in the construction of the park building. Park Director Anderson replied that it would be approximately $1,000. He also reviewed the options available. There was discussion among the Council of the value of renting a shelter and waiting until next year for the Jaycees to assist in building the shelter, versus hiring a contractor to put the building up now. The present budget situa- tion was discussed again, with the feeling being that the Council should be consistent in the actions they take, and wait to get a better picture of the budget situation before taking action. Motion /Second: Doty /Forslund to table action on the proposed Lambert Park shelter building until more is known about the financial situation. 4 ayes 0 nays otion /Second: McCarty /Doty to approve the ^-°issuance of a building permit for Mary Anderson Homes at 7501 Silver Lake Road. 4 ayes 0 nays Mayor McCarty strongly urged that the Council implement the code procedure from July 1980 as a policy guideline as the City could not keep having exceptions on variances and setbacks and so forth. Official Rose explained how the problem of the drain tile occurred. He stated the original owner of the property was well aware of the drain tile requirement when he sold the property, but did not pass the information along to the purchaser. He added that Staff is implementing steps to assure that all lots that would be required to have drain tile will be so noted at City Hall, with the information passed along to those requesting a building permit. He explained they will add a rain tile inspection to building permits, they lan to have pre- construction meetings with developers, and will also have a stamp made up to use on plans where drain tile is required. Motion Carried 9. Consideration of the Issuance of a Build- ing Permit for 7501 Silver Lake Road (Mary Anderson Homes) Motion Carried 10. Consideration of Letter and Request from Timberline Homes, Inc. Mounds View City Council November 24, 1981 Regular Meeting Page Five t was the concensus of the Council that the lot in question definitely needed drain tile, and in order to protect the City from a lawsuit by a future purchaser of the home, that drain tile should be required. Motion /Second: McCarty /Doty to deny the request of Timberline Homes, Inc. to omit the drain tile at 7741 Greenwood Drive. 4 ayes 0 nays Clerk /Administrator Pauley stated the Planning Commission is in the process of reviewing Chapter 40 and recommended any implementation of code procedures should wait until they are finished. Official Rose stated they would most likely be completing it in January. Mayor McCarty pointed out that the developer is required to include a negotiable warrantee to the adjacent property owners, and recommended it be stipulated in Exhibit 2A of the development -Agreement. Tyson stated that any violation of MPCA standards would come under State jurisdiction, and they could be shut down if they violated the standards. Mayor McCarty asked for some type of written agreement that could be given to the mobile home park owner. Mr. Tyson replica he would be glad to put in writing that he would not violate the State standards. He added that he would prefer not having to build a wall, as they would rather usebearming, screening and trees and so forth. Official Rose explained Item 5 of Exhibit 2A had been included as it was referred to on the site plan. It was agreed to change the wording to read that the developer agrees to install an adequate buffer, reference Chapter 40.04 sub G. Motion /Second: McCarty /Doty to approve Resolution No. 1383 and waive the reading of the resolution. 4 ayes 0 nays Aotion /Second: Forslund /Blanchard to have the Police Department donate the bicycles to the Goodwill. 4 ayes 0 nays 11. Councilmember Blanchard aye Councilmember Doty aye Councilmember Forslund aye Mayor McCarty aye Official Rose explained to the Council that while exceptions do occur, Staff is trying its very best to enforce the code. Clerk/ Administrator Pauley pointed out that many of the violations have occurred because the property owner made a change and never came into the City for a building permit or whatever was required, and it came to the attention of Staff after the fact. °'ttorney Meyers was absent. Councilmember Blanchard stated she had received several calls regarding the radiator repair shop in her neighborhood and asked if anything had been done yet. Official Rose replied that a citation will be delivered on November 25, as he -c in violation of the 61gT1 ordinance. Councilmember Blanchard reported she had attended the Ramsey County League meeting the previous week, but due to the bad weather, the Legislators had not attended. Councilmember Doty reviewed a report from the previous City auditors, showing how Mounds View compares with 19 other suburban cities in the cost of government per capita. Mounds View was rated extremely well in all areas. Councilmember Forslund reported she had received many complaints of snowmobilers. Clerk /Administrator Pauley replied that, ifortunately, not much can be done to ,pprehend them, but a notice was published in the last newsletter, with another going in the forthcoming newsletter. Mayor McCarty pointed out that the youngsters who use them November 24, 1981 Page Six 13. Second Reading and Adoption of Ord. He added, though, that he was concerned with the small seedlings being run down that had been planted. Mayor McCarty reported that public access to Spring Lake is being looked into. Mayor McCarty asked that Mr. Loedings memo to the Wetlands Committee be typed up and given to Council members. Mayor McCarty reported he had received the draft Water Resources Management Guide from the Met Council and asked that the City obtain a copy for each council member, as he felt with just one library copy, they would not be able to spend the amount of time necessary reviewing the guide. Mayor McCarty stated he had received one phone call regarding the increase in license fees for 3.2 beer, which had been approved by ordinance on November 9. He added that while he felt an increase was in order, $100 was excessive, with perhaps $40 being more in 'ine. .:lerk /Administrator Pauley replied that the actual cost to the City is approximately $32, and since only one individual had objected to the increase, saying he could not afford it, perhaps he should reconsider the profit of selling 3.2 beer. He added that the code review does address setting fees by resolution, but due to time restraint^, nrdinance had to be adopted as the licenses are due January 1. It was the concensus of the Council that a rebate would be given after the code review was finished. Mayor McCarty reported he had received a letter from the Roseville City Council, asking Mounds View's support in opposing Ramsey County's hotel /motel taxing authority. It was the concensus of the Council to reply to Roseville that they are reserving comment at this time. Clerk /Administrator Pauley discussed the State financial problems and the uncertainty that Mounds View is facing, not knowing what the cuts will be, or the status of the November and Decem- ber payments. He stated he is planning on attend- the special session as much as possible as .Ice the Legislature acts, the City will have to act quickly. Clerk /Administrator Pauley reported he is working with the Department Heads and they are all coming 17. Report of Admini- strator Mounds View City Council November 24, 1981 Regular Meeting Page Eight with suggestions on cuts that can be made but :ed direction from the Council. It was agreed that they would meet and discuss it at the December 7 agenda session, with Council being given a written report prior to the meeting. Clerk /Administrator Pauley reported that Dan Boxrud is preparing to submit the final paperwork to the State for MSA money and needs to know if the City is willing to make a financial committment. Mayor McCarty replied that they must look at the complete financial picture, and will have to wait on any action until after the Legislature acts. Motion /Second: Blanchard /Doty to adjourn the 18.
