Adjournment CONSENT AGENDA FAhrrnary 8, 1982 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire Agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Adopt Resolution No. 1411 Approving Just and Correct Claims Against City Funds PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW MINNESOTA RhiiSEY COUNTY, The Mounds View City Council was called to order by Acting Mayor Forslund at 7:30 PM on February 8, 1982. MEMBERS PRESENT: Councilmembers Blanchard and Doty and Acting Mayor Forslund. It was noted that Mayor McCarty and Councilmember Hodges would be arriving at approximately 8:30 PM. ALSO PRESENT: City Attorney Meyers, Clerk/ Administrator Pauley and Building and Zoning Official Rose. Motion /Second: Doty /Blanchard to approve the January 25, 1982 minutes as presented. 3 ayes 0 nays There were no residents requests or comments from the floor. Motion /Second: Forslund /Doty to approve the consent agenda as presented. 3 ayes 0 nays Official Rose reported that 245 building permits had been issued in 1981, which was approximately 50 less than average. He stated that they are seeing a lot more remodeling, with people putting more money into their existing home. He stated the Department did 78 HRA inspections and 491 housing inspections, out of approximately 1100 units, with 547 reinspections. He added that they did get into all buildings and inspect the public areas. Official Rose reported that 11 planning appli- cations were processed, with them going onto either the Planning Commission and, when required, the Council. Fourth Quarter 1981 Department Head Reports Mounds View City Council Regular Meeting assisted in the Comprehensive Plan update and code review. Official Rose stated he would like to thank the Council for their support. He cited two instances recently where there had been fires in homes, one with a fireplace and the other with a wood burning stove, where the work had been done without a permit and without inspection from the City. He added that many phone calls are received from citizens asking advise on how to conserve energy in their home, and that he has been setting up appointments before and after City Hall hours to meet with people who cannot come in during regular business hours. Counciimember Blanchard asked if there was a brochure available that could be given to the citizens to answer their questions. Official Rose replied that there is nothing available, to his knowledge, as the questions vary a great deal. Acting Mayor Forslund asked if the City has been receiving many calls from apartment residents with complaints. Official Rose replied that those calls usually come in when it gets unusually cold out and they do inspect all complaints. Official Rose presented the Council with a procedure outline to be given to citizens, showing them the proper steps to be followed when taking out any type of building permit. Acting Mayor Forslund stated that in review- ing the procedure, it looked very good, and she thanked Official Rose for a job well done. Acting Mayor Forslund closed the regular meeting and opened the first public hearing at 7:45 PM. Bob Cook, 13084 ElDorado St NE, Blaine, introduced himself as a representative of Sunrise Methodist Church. He stated that at this time, the church is requesting the Council defer any action on their request for a conditional use permit as they may be moving the facility from the parsonage into the church, which would allow more room. He added that they have determined that the number of children allowable in the parsonage would result in a deficit to the church. February 8, 1982 Page Two 7A. No. 1410 Mounds View City Council February 8, 1982 Regular Meeting Page Three Motion /Second: Doty /Blanchard to refer the Sunrise Methodist Daycare project back to the Planning Commission, due to the changes in the request for a conditional use permit with no additional fees being charged. 3 ayes 0 nays Acting Mayor Forslund closed the public hearing for Sunrise Methodist Church at 7:50 PM and opened the public hearing for the 1981 long term financial plan at 7:50 PM. Clerk /Administrator Pauley explained that the purpose of the long term financial plan is to provide a five year plan for the City, covering four basic elements, a public service program outlining future needs of the City, a capital inprovement plan which outlines what capital inprovements the Council anticipates would have to be made in the City over the next five years, a long term revenue program which will anticipate revenues for the next five years, and a capital budget program, which will summarize the capital improvements and long term revenue plans. He added that copies are available for the public to review. There were no questions or comments from the audience. Acting Mayor Forslund closed the public hearing and reopened the regular meeting at 7:57 PM. Motion /Second: Doty /Forslund to approve Ordi- nance No. 312 extending the applicability of Ordinance No. 301 as amended by Ordinance No. 305. Acting Mayor Forslund aye Councilmember Blanchard aye Councilmember Doty aye Clerk /Administrator gave an explanation of Ordinance No. 312. Clerk /Administrator Pauley reported that the issue had previously been discussed with Attorney Meyers and at an agenda session, with the decision made to refer it back to Gerald Sunde, who drafted the December 28 drainage report, requesting that he include a supplement of calculations for the area that presently drains into Silver Lake Woods Pond and the Motion Carried 7B. 1981 Long -Term Financial Plan 8. Second Reading and Adoption of Ord. No. 312 Extending the Applicability of Ord. No. 301 as Amended by Ord. No. 305 Motion Carried 9. Consideration of December 28, 1981 Overall Drainage Calculations for Oak Lake Park Ponding Area Mounds View City Council February 8, 1982 Regular Meeting Page Four impact of that drainage on the capacity of the pond, allowing for a 17 cfs outlet. Mayor McCarty arrived at 8:15 PM. There was considerable discussion of the history of the ponding problem and the contracts involved. Councilmember Hodges arrived at 8:20 PM. Motion /Second: McCarty /Forslund to inform Mr. Sunde that his drainage plan, reference the requirements from Rice Creek Watershed District, is not complete and that he revise the plan to include a 17 cfs outlet with a 50 acre foot storage pond as pre- viously agreed to in the grading plan as approved by the DNR. 5 ayes 0 nays Motion /Second: Forslund /Doty to table the issue. 1 aye 4 nays Councilmember Forslund stated she would like to table the issue as she felt the supporting documentation for the Park Department was the same amount as the defeated Park referendum, as well as there being other areas of question. Clerk /Administrator Pauley explained that this was the Park Master Plan and reviewed where the contributions would come from. Mayor McCarty stated he agreed that the revenues were short and the plan should reflect what is actually planned and feasible. Attorney Meyers advised that since this was the first reading of the ordinance, the Council could either approve the reading and make changes before the second reading, or could table it and make the changes before the first reading. Motion /Second: Doty /Hodges to have the first reading or Ordinance No. 311 adopting the 1981 long -term financial plan. Motion Carried 10. 1st Reading of Ord. No. 311 Adopting the 1981 Long -Term Financial Plan Motion Denied Mounds View City Council February 8, 1982 Regular Meeting Page Five Clerk /Administrator Pauley stated the item would be placed on the February 16 agenda for further discussion. 5 ayes 0 nays Councilmember Councilmember Councilmember Councilmember Mayor McCarty Hodges aye Forslund aye Flanchard aye Doty aye aye Mayor McCarty stated that due to the present State: budget and all the problems involved, he felt the Cit should take advantage of its share of MSA monies that have been paid as gas taxes. Motion /Second: McCarty /Blanchard to approve an agreement to purchase O'Connell Drive from M &E Realty, and authorize the Mayor and Clerk/ Administrator to enter into an agreement, and establish $185,000 as the fair price for the right -of -way based on the October 23, 1981 appraisal by n. J. Janski and Associates. Official Rose asked the Coti;.ncil to consider the request of Bauer Welding and Metal Fabricators, which had received Planning Commission approval earlier and which the Council had received information on. Motion /Second: McCarty /Hodges to direct Staff to draw up a development agreement for Bauer Welding and Metal Fabricators as per the Planning Commission's direction, upon receiving the final plans and specs from Bauer Welding. 4 ayes 0 nays 1 abstain Councilmember Doty stated he was abstaining from the vote as he does a small amount of business with Bauer Welding. Attorney Meyers reported he had received a letter from the attorney of Teamsters Local 320, which represents the Police Department, asking that the City pay the legal fees of an officer who had been involved in litigation. He added that the expenses incurred amount to $1,275 and that he is researching the matter further and will report back to the Council. He added, however, that his preliminary findings 11. Report of Attorney Mounds View City Council February 8, 1982 Regular Meeting Page Six are that the City does not have to honor this billing, although they can choose to do so. Attorney Meyers reported that Mark Kerney would be attending the next Council meeting, in his absence. Attorney Meyers reported that the Metropolitan Council had approved the schedule of notifica- tion prepared by their General Counsel in conformance with the court order resulting from the Anoka County Airport lawsuit filed by the City. Councilmember Hodges reported he had just attended the Police Department appreciation dinner for Mounds View, Spring Lake Park, Blaine and Anoka County, and on behalf of the Council, expressed their appreciation: for a job well done. Councilmember Forslund noted that the Council had received the yearly police report. Motion /Second: Forslund /Doty to accept the 1981 Police report. 5 ayes 0 nays Councilmember Forslund reported there would be a meeting on February 22 at Westwood Jr. High in Blaine at which the PCA would hold a public hearing regarding disposal sites being considered by the Met Council. Councilmember Blanchard reported she had attended the League of Minnesota Cities conference with the Mayor and that while it was interesting, she felt it was more geared to communities outside the metropolitan area and did not feel it was necessary for the Council to attend every year, but would still recommend that they belong to the League. Councilmember Blanchard reported that the Ramsey County Commissioners had held a meeting earlier in the day, trying to set up a Metro regional rail authority, which would be a subdivision of the Met Council. She recommended the City send a letter, stating their view on the subject. She stated her personal view was that it was just another step by the Met Council to try and gain authority. 14. Reports of Councilmembers Motion Carried Mounds View City Council February 8, 1982 Regular Meeting Page-Seven Mayor McCarty asked Clerk /Administrator Pauley to research the proposed authority and get baci: to the Council, so they could make a decision and send a letter. Councilmember Doty reported to the Park and Rec Commission had just held their annual elections. Councilmember Doty reported that a good deal of damage had been done to the rented warming house at Hillview Park, while the attendant was out on the rink. He suggested checking into a reward system to see if they could find the violators. Councilmember Doty reported that he and Council member Hodges had attended the Ramsey County League meeting last week, where district court was discussed. Motion /Second: McCarty /Hodges to reappoint Donna Bowman for a term on the Lakeside Park Commission. 5 ayes 0 nays Motion Carried Mayor McCarty asked that it be noted that a regular member is needed for the Festivities Commission. Motion /Second: McCarty /Forslund to appoint Peg Mountin as chairperson of the Planning Commission. 5 ayes 0 nays Motion Carried Mayor McCarty reported there would be a hearing on House File #1738, which would allow manu- factured homes in an R -1 district, at the State Office Building, in Room 57, at noon on February 10. Clerk /Administrator Pauley stated he would provide a briefing that morning at 9:00 in his office. Mayor McCarty reported that the Met Council Committee of Legislators would be convening soon and he will pass the information on as he gets it. He also asked Clerk /Administrator Pauley to inform the Council if the City is not receiving the information they need in a timely manner. Clerk /Administrator Pauley reported that he had represented the suburbs and their position at the Ramsey County League of Cities meeting, and recommended that the suburbs unify. 15. Report of Administrator Mounds View City Council Regular Meeting Clerk /Administrator Pauley asked for authoriza- tion to let bids for the rr of the drainage ditch along Long Like Road. Attorney Meyers reported that his interpre- tation was that cleaning and maintenance of the ditch should not have an adverse effect on the wetlands. There was considerable discussion between the Council and Attorney as to the legalities and how it could affect the wetlands, and where the fill should be hauled. Motion /Second: McCarty /Doty that the City Council finds that the ditch maintenance south of County Road H2 and west of Long Lake Road, based on information from the Engineer and other sources, is not inconsistent with wetlands preservation, and approve the plans and specs and authorize the letting of bids for February 22, 1982. 5 ayes 0 nays Motion /Second: Doty /Hodges to adjourn the 16. meeting at 9:32 PM. 5 ayes 0 nays Rejpeetfully subbmit DonAYd F: Pau ey February 8, 1982 Page Eight Motion Carried Adjournment Motion Carried
