Adjournment CONSENT AGENDA February 22, 1982 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire Agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Adopt Resolution No. 1413- Approving Just and Correct Claims Against City Funds The Mounds View City Council was called to order by Mayor McCarty at 7:30 PM on February 22, 1982. PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA MEMBERS PRESENT: Councilmembers Blanchard and Doty and Mayor McCarty. It was noted that Councilmember Hodges was out of town on business, and Councilmember Forslund was absent. ALSO PRESENT: Attorney Karney and Clerk/ Administrator Pauley. Motion /Second: Doty /Blanchard to approve the February 8, 1982 minutes as corrected. 3 ayes 0 nays Mayor McCarty replied he would have Staff check into it and he would get back to her. Call to Order 2. Roll Call 3. Approval of Minutes: February 8, 1982 Motion Carried Sheila Quick, 5367 Jackson Drive, reported that 4. Residents Requests her dog had been picked up on a Friday afternoon, and Comments From and when her husband went to the dog pound to the Floor retrieve the animal, he was told he had to go to City Hall to pay the fine first. He reached City Hall after it closed at 4:30, and since it was a holiday weeLend, they were not able to pick up their dog until the following Tuesday. She ask- ed if the system could be changed to allow owners to pay their fines at the pound. 5. Approval of Consent Agenda Motion Carried Mounds View City Council February 22, 1982 Regular Meeting Page Two Motion /Second: Doty /Blanchard to have the second re:a in.g of Ordinance No. 311, and adopt it, the 1981 long -term financial plan, and waive the reading and have the Clerk/ Administrator give a short summary. Councilmember Blanchard aye Councilmember Doty aye Mayor McCarty aye Clerk /Administrator gave a brief summary of the ordinance. Mayor McCarty closed the regular meeting and opened the: public hearing at 7:42 PM. He explained that there would be no presentation, as this was a public hearing for input from the citizens. There were no comments or questions from anyone present. Mayor McCarty closed the public hear- ing at 7:42 PM and reopened the regular meeting. Clerk /Administrator. Pauley explained that a previously scheduled public hearing by the Cable Commission had been cancelled due to the death of a Cable Company representative, and had been rescheduled for 7:00 PM on March 25, at the Parkview Middle School in Roseville. He added that all legal notices were still valid. Councilmember Doty stated the winter skating program was over and would like to see the rental buildings removed as soon as possible. Mayor McCarty asked Neil Loeding for an update of where the Wetland Committee is. Mr. LoedinL replied that work is in progress, with a meeting to be scheduled for the next two to three weeks. Mayor McCarty stated a special Wetlands meeting would be held on March 9 at 7 PM with Mr. Peterson and others. Mr. Loeding also reported that the possibility of financial support for hiring a recent graduate of soil management to work in the City had been discussed. He added that they would like to make Second Reading and Adoption of Ord. No. 311 Adopting the 1981 Long -Term Financial Plan as Amended Motion Carried 7. Clerk/ Administrator Pauley replied it would be a good opportunity to try out the new mimeograph equip- ment. Mayor McCarty stated there were two items he would like to discuss at the next agenda session, one being the ordinance that presently requires drain tile if a building or house is to be built within 5' of the water table, and the other being a priority item of working on the joint powers agreements and job descriptions. Mayor McCarty reported that the senior citizen member of the Lakeside Park Commission has resigned so there is an opening on the Commission. Mayor McCarty reported that on February 25, at 10 AM in Room 83 in the State Office Building, Senate file 744 and House file 1117, regarding surface water management legislation, will be discussed. He stated he would be attending the meeting and encouraged others to do so. Mayor McCarty reported the City Dinner would be held on April 24, with more details to follow at a later date. Park Director Anderson reported that the over- all reaction to the use of portable buildings in the skating program was that they were functional and can work. He stated there had been a problem with damage to the buildings and they would be dealing with the vandalism through the Police Department. He added that the skating rinks had closed last Thursday due to the warm weather and slush. Park Director Anderson reported he had been looking into having private industry perform some of the park maintenance duties. He stated three meetings had been held so far and that it is a very interesting possibility. He added that the specs are being drafted at this time. Park Director Anderson reported that with Edgewood and Red Oak Schools being closed down, he is the chairman of a task force to find an alternate use for the schools. He stated they hope to have something r' -ady by early next: week. 9. Fourth Quarter 1981 Report from Parks, Recreation and Forestry Director Anderson Mounds View City Council February 22, 1982 Regular Meeting Page Four Park Director Anderson reported the March /April issue of the Newsletter would be going out on Friday, and would include the bulk of the summer programs. He added the the joint powers agree- ment for the puppetry program with New Brighton will be before the Park Commission within the next two weeks. Park Director Anderson reported they are looking at a mass planting this Spring, especially at Silver View Park, and hope to put in between 1500 and 2000 plants, many of them seedlings. He stated they would be contacting volunteer organizations to assist. Park Director Anderson reported they are working on a joint contract with New Brighton to have a combined bid on dieseased tree removal for 1982. He added they are also in the process of hiring a forestry assistant, and do have a candidate who is very promising. Mayor McCarty stated he is concerned with the vandalism that has occurred. He added he has spoken :'ith many elected officials and has been told they are all experiencing problems. He suggested perhaps looking into spending .1maller amounts of money and repairing the existing buildings instead of building new ones. Park Director Anderson replied that he did not see that as a viable alternative and explained that the buildings have already served approximately 30 years. He added that the proposEl is for concrete block buildings, which are very sturdy. He added that the Park Commission is not con- sidering indoor pli*-nbing. Mayor McCarty stated he frit it could be very cost effective to contract for municipal services through private companies and asked Park Director Anderson to continue checking into it. Dan Boxrud presented the Council with the bid tabulation sheet and recommendations on the bids that were received earlier in the day. He reviewed the bids and answered the Council's questions. Mr. Boxrud pointed out that the low bidder had neglected to sign his bond, but in speak- ing to the attorney of the bond company, was told it was valid as he had paid all fees and the bonding company had signed the bond. 10. Consideration of Bids for Long Lake Road Ditch Mainte- nance Mounds View City Council Regular Meeting Attorney Karney agreed that the bid was valid and the contractor could still sign the bond if awarded the job. Motion /Second: Doty /Blanchard to accept the bid for contract with GTF Landscaping, for a total bid price of $11,962.74, and the funds be designated from Storm Water Management, and GTF sign the bond before the contract becomes effective. 3 ayes 0 nays Attorney Karney reported that regarding paying the legal fees in a lawsuit involving one of the police officers, after reviewing the law, he would recommend the Council pay the fees if they feel the police officer is not guilty of gross neglect of duty. Mayor McCarty stated he would agree to pay as the lawsuit had been dropped after an insurance settle lent had been made, so he felt that with- out a trial the officer was innocent until proven guilty. It was agreed that the officer in question should be told they were paying based on the attorney's findings, and the City would not be responsible for any gross misconduct of any employee. Motion /Second: McCarty /Doty to allow payment of the attorney fees for Officer Chambers, with the funds to come from the contingency fund. 3 ayes 0 nays Clerk /Administrator Pauley noted that the City and Barb Collins had received a certifi- cate of appreciation from the United Way for their outstanding contribution the past year. Clerk /Administrator Pauley reviewed the problems the City is having in putting a water main through from Oakwood to Spring Lake Park Road. He outlined three plans but explained they are runnit:g into problems with people who will not give the necessary casement. He added they will be working on it further.
