Adjournment CONSENT AGENDA April 26, 1982 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire Agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Adopt Resolution No. 1431 Approving Just and Correct Claim: Against City Funds The Mounds View City Council was called to order 1. Call to Order by Mayor McCarty at 7:30 PM. MEMBERS PRESENT: Councilmembers Doty, Hodges, 2. Roll Call Forslund, Blanchard and Mayor McCarty. ALSO PRESENT: Attorney Meyers, Clerk /Administra- tor Pauley and Building and Zoning Official Rose. Mayor McCarty read the Resolution of Appreciation to Art Holm, commending him for his years of service to the City, and presented him with a framed copy of the Resolution. Motion /Second: Doty /Blanchard to approve the April 5, 1982 minutes as presented. 4 ayes 0 nays 5 ayes 0 nays PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA 1 abstain Councilmember Hodges abstained as he had not been present at the April 5 meeting. Motion /Second: Blanchard /Hodges to approve as corrected the April 12, 1982 minutes. 4 ayes 0 nays 1 abstain Councilmember Doty abstained as he had not been present at the April 12 meeting. Mayor McCarty closed the regular meeting and opened the first public hearing at 7:43 PM. There were no questions or comments from the floor. Motion /Second: Hodges /Doty to approve the conditional use permit request, to include Resolution No. 49 -82. 5 ayes 0 nays Mayor McCarty closed tr public hearing and reopened the regular me,ting at 7:45 PM. Motion /Second: Forslund /Hodges to approve the request for a carnival license for Series Fun Shows for Mounds View Square, with the hours to be 9 AM 10 PM, Monday thru Friday, 9 AM 12 PM Saturday, and noon to 12 PM on Sunday. 5 ayes 0 nays Mayor McCarty closed the regular meeting and opened the second public hearing at 7:50 PM. There were no questions or comments from the floor. Mayor McCarty closed the public hearing and reopened the regular meeting at 7 :50 PM. Motion /Second: Doty /Forslund to approve the request of Sunrise United Methodist Church for a conditional use permit for a daycare facility to be located at 2520 County Road I, contingent upon complience with Resolution No. 51 -82 from the Planning Commission. 5 ayes 0 nays Councilmember Blanchard expzessed concern that the facility should be required to have a fire alarm system. Attorney Meyers and Official Rose explained that the State Fire Code requires one for over 50 occupants, but the Council could establish their own ordinance if they would like to be more restrictive. The majority of the Council felt the church was properly set up and their staff would be prepared. Councilmember Doty recommended it be included in the development agreement that the contractor show the amount of peat rock he brings into the City and uses. Clerk /Administrator Pauley replied they will have a pre- construction meeting and they will not allow the contractor to do any subbing while he is doing the City project, which will allow for better control of the quantities used. Motion /Second: Doty /Hodges to approve the seal coating bid by Allied Blacktop Company of Maple Grove, in the amount of $52,854.98, which is $2,854.98 over budget due to higher oil costs than anticipated. 5 ayes 0 nays Motion /Secon2_ Forslund /Hodges that the 1982 street sweeping be awarded to American Sweepers, Inc. in the amount of $4,450.00. 5 ayes 0 nays Motion /Second: Doty /Blanchard to authorize the hiring of Joyce Johnson of Arden Hills as part time clerk /typist for the Police Department, for a probationary period of six months, at $4.50 per hour, to begin May 3, 1982. 5 ayes 0 nays Motion /Second: McCarty /Doty to rescind action authorizing the hiring of the New Brighton Community Service Officer on April 12. 5 ayes 0 nays Motion /Second: Doty /Hodges to approve the hir- ing of Kenneth Herke for the position of Community Service Officer on a part -time basis, at a salary of $4.50 per hour, and for the customary probationary period, to start April 28. 5 ayes 0 nays 9. Consideration of Police Department Recommendation for Hiring of a Commu- nity Service Officer Motion Carried Motion Carried Mounds View City Council April 26, 1982 Regular Meeting Page Four Mayor McCarty closed the regular meeting and opened the third public hearing at 8:02 PM. Marlin Grant, president of Marvin Anderson Homes, outlined the requested revision before the Council. He explained they have requested the change from townhouses to condominiums as they have received a strong indication from people interested in the development that they are looking for the $70,000 to $100,000 price range, which the condominiums are, rather than the $130,000 to $140,000 price range of the townhouses. Mr. Grant answered questions from the Council, and presented sketches of what the proposed development will look like. Mayor McCarty closed the public hearing and reopened the regular meeting at 8:12 PM. Councilmember Forslund stated the Planning Commi- ssion had been concerned with the number of parking spaces required by Code. Official Rose replied the Planning Commission at their last meeting directed Statf to revise the Code review to include one parking space per unit for condominiums. Attorney Meyers added Council cannot authorize this before the Code change takes place, but consideration could be given this evening. Mayor McCarty suggested directing Staff to draft an addendum to the original agreement, and take final action at a later date. Motion /Second: McCarty /Doty to direct Staff to draft an agreement containing the following, a resolution amending Resolution No. 1319, exhibiting the revised development stage plans for Tract D and noting the change from zoning of R -3 to R -4. 5 ayes 0 nays Motion /Second: McCarty /Hodges to direct Staff to draft an amendment to the September 22, 1980 agreement with Kraus Anderson, M E Realty Company and Marvin H. Anderson Construction, stating that the applicants agree to make payment of all City charges and fees as they exist or are amended, and to amend the September 22, 1986 agreement ar: the public improvement i-.greement to modify the approved assessment schedule to agree with the bond payment schedule for the public improvement, and to add to the September 22, 1980 agreement a provision which would approve a schedule for payment of the SWM charges as approved by the City Attorney. 5 ayes 0 nays 7C. Revision of Kraus- Anderson/M E Realty PUD Pro- posal Motion Carried Motion Carried Mounds View City Council April 26, 1982 Regular Meeting Page Five Official Rose explained the SWM charge will be figured for the entire development and levied over the condominium proposal. Mayor McCarty asked where the Planning Commission was on the Code update. Official Rose replied that they have zoning, subdivisions and signs left. Motion /Second: McCarty /Blanchard to set a public hearing for the municipal code review for May 24, 1982 at 7:40 PM. 5 ayes 0 nays Motion /Second: Hodges /Doty to authorize the hiring of Sharon Linke as the Parks, Recrea- tion and Forestry secretary, at a salary of $5.40 per hour, with a six month probationary period. 5 ayes 0 nays Park Director Anderson explained the City is having trouble getting City Newsletters delivered to all residents, as several of the routes include residents of other Cities, and since the Newsletter is sent third class, the postman delivers it to all homes on the route. There was discussion among the Council of the best way to insure that all residents receive a Newsletter. Motion /Second: McCarty /Forslind to direct Staff to get the figures of the Mounds View residents who are not receiving the City Newsletter under the new postal regulations, and additional direct Staff to investigate the cost of using a private mailing system for delivery of the Newsletter. 5 ayes 0 nays Official Rose reported 7 -11 has requested to expand their soda fountain from 4 lines to 6 or 8 lines, which requires construction. He stated the Planning Commission has directed Staff to research the matter, including dis- cussing it with the Ramsey County Health Department. He added it looks like it will be 1 to 2 months before they receive the information back from the County. Motion Carried 13. Consideration of Parks, Recreation and Forestry Dept. Recommendation for Hiring of a Full- time Parks and Rec- reation Secretary Motion Carried 14. Consideration of Staff Memorandum Regarding Increased Circulation of City Newsletter Motion Carried 15. Report of Building and Zoning Official Mounds View City Council April 26, 1982 Regular Meeting Page Six Tom Bey, of 7 -11 Stores, 7201 Quanticle Lane, Maple Grove, stated their construction people had received the necessary approvals from the health officials, although he didn't know who those official were. Mayor McCarty replied that the Council has referred the item back to the Planning Commission, and are waiting for their recommendation, which will take one to two months. He added the license that 7 -11 operates under does not provide for fast food operation, and they must determine if they are crossing over to another license area. Official Rose reported Messiah Lutheran Church has submitted plans to remodel their church, which includes putting in a new rear entrance and some other changes. He asked if the Council would like them to go through a development review or if they would consider this minor. The Council discussed the proposed remodeling and determined it would be considered minor. Motion /Second• McCarty /Blanchard to authorize the issuance of a building permit for Messiah Lutheran Church. 5 ayes 0 nays Official Rose reported the Mermaid will be remodel- ing their downstairs restrooms, which also will be minor. The Council indicated approval would not be needed due to its minor nature. Official Rose reported a resident is interested in putting up a wind generator, and while the Planning Commission has approved an addition to the Code to cover wind generators, the resident would like to put it up by June. The Council discussed the matter and felt there would be many complaints from neighbors Attorney Meyers advised he be told not to proceed until the regulations are adopted. Mayor McCarty directed Official Rose to notify the resident in writing not to proceed at this time. Motion /Second: McCarty /Doty to direct Official Rose to inform '_he applicant that regulations on towers are pending and strongly recommend he not proceed until those regulations are in place. 5 ayes Motion Carried 0 nays Motion Carried Mounds View City Council April 26, 1982 Regular Meeting Page Seven Attorney Meyers presented the Council with a copy 16. Report of Attorney of the letter he had received from the Kraus Anderson attorney, regarding SWM charges. Attorney Meyers briefed the Council on a recent case in the Supreme Court, in which a resident sued the City for damage to his home during a heavy rain storm, stating the City was negligent in designing the storm sewer system. He stated he would keep the Council posted on any decision made. Attorney Meyers reported he will be preparing a memo on tax increment financing regarding Chapter 8 of the charter provision, once he has completed researching it. Attorney Meyers reported he had checked into a private detective, who is working in the City, per the request of a Councilmember, and found that the detective is not violating any ordinance or law. He suggested that anyone with a complaint could call the Bureau of Criminal Apprehension. Motion /Second: McCarty /Doty to limit each Council- 17. member to five minutes for their report, and beyond that, to be submitted in writing. 5 ayes 0 nays Councilmember Doty had no report. Councilmember Blanchard stated she would put her report in writing. Councilmember. Forslund reported the Planning Commission will discuss the fill permit the Council referred back, and will act on May 5. Councilmember Hodges reported Oakwood Park appears to need fill. Clerk /Administrator Pauley replied that fill will be brought in, once the load limits are off. Councilmember Hodges stated he was concerned with the amount of bike and pedestrian traffic along Long Lake Road, between County Road H2 and Highway 10. He recommended letting the County know. Mayor McCarty reported he would not be able to attend the April 29 Met Council public hearing. Clerk /Administrator Pauley replied he would be attending, and will present Mounds View's position. Motion /Second: McCarty /Hodges to adopt Resolution No. 1533 and waive the reading regarding the City's Reports of Councilmembers Motion Carried Mounds View City Council April 26, 1982 Regular Meeting Page Eight position on proposed Metropolitan Council Surface Water Management Plan. 5 ayes 0 nays Clerk /Administrator Pauley passed out a letter 18. from John Johnson, with a summary of the last three years of Short Elliott- Hendrickson billings. Clerk /Administrator Pauley reported he had received a call from the Ramsey County Environmental Health Department, requesting permission to give a slide presentation of their procedure in selecting land fill sites. He reported they were scheduled for the May 10 meeting. Clerk /Administrator Pauley reported he had attended a session given by the Secretary of State regarding elections, and stated he would place the item on the next agenda session. Clerk /Administrator Pauley reported the firm that is doing the Long Lake Road ditch clean -up was not familiar with the City's procedure on billings and had missed the cut -off date.
