Adjournment CONSENT AGENDA May 10, 1982 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire Agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Call to Order by Mayor McCarty at 7:31 PM. MEMBERS PRESENT: Councilmembers Hodges, Forslund, 2. Roll Call Blanchard and Mayor McCarty. It was noted that Councilmember Doty was absent. Motion /Second: Forslund /Hodges to approve the April 26, 1982 minutes as presented. 4 ayes 0 nays There were no residents requests or comments from the floor. 4 ayes Clerk /Administrator Pauley reported Mr. Johnson would be available at the next agenda session if the Council had any questions regarding his contract. Motion /Second: McCarty /Forslund to approve the employment contract submitted by John Johnson, dated May 6, 1982. 4 ayes 0 nays Motion /Second: McCarty /Hodges that th Council plans to ina ize the restructuring plan ar_u provide for general job descriptions and salary levels at the next agenda meeting for action at the May 24th Council Meeting. 4 ayes 3. Consideration of Employment Contract with John Johnson Motion Carried 0 nays Motion Carried Mounds View City Council May 10, 1982 Regular Meeting Page Two Motion /Second: Hodges /Blanchard to accept the recommendation of the Chief of the Civil Service Commission to hire Terrance Broos, effective May 17, 1982. 4 ayes 0 nays Motion /Second: Forslund /Hodges to approve the fill request for 2609 Louisa Avenue, with respect to Resolution No. 54 -82 of the Planning Commission, recommending approval, contingent upon compliance with the resolution. 4 ayes 0 nays Official Rose reported that Mr. and Mrs. Arthur Doltz of 2191 Terrace Drive had appeared before the Planning Commission and had their request for a front yard set- back denied, and would like to appeal it to the Council. He requested a public hearing be set. Motion /Second: Forslund /Blanchard to set a public hearing for Arthur Doltz, 2191 Terrace Drive, for a front yard setback variance request, for May 24, 1982 at 7:50 PM. 4 ayes 0 nays Mayor McCarty closed the regular meeting and opened the public hearing at 7:42 PM. Gary Winter, of Holmes and Graven, presented the Council with a revised document regarding the tax increment financing, and covered each revision with them and answered questions from the Council. Attorney Meyers answered questions from the Council regarding tax increment financing, and some of the revisions that had been made. Mayor McCarty asked for any comments from the audience. There were none. Mayor McCarty closed the public hearing and reopened the regular meeting at 7:58 PM. 7. Public Hearing Proposal to Establish Tax Increment Financing District for Elderly Housing Project Mounds View City Council May 10, 1982 Regular Meeting Page Three Motion /Second: Hodges /Blanchard to approve adoption of Resolution No. 1436 establishing a Development District and adopting a Finance Plan and waive the reading. 4 ayes 0 nays Motion /Second: Forslund /Hodges to adopt Resolution No. 1437 and waive the reading. 4 ayes Mr. Winter explained one of the next steps would be to work on the development agreement, of which a first draft was available. He added they will also get a letter of credit or performance bond for the City. He introduced Ms. Barb Portwood who was working on the development agreement. Ms. Portwood stated she would be discussing the agreement with Attorney Meyers. Councilmember Forslund read portions of a letter received from the Rice Creek Watershed District, dated April 28, 1982, regarding their review and comments of the Mounds View wetlands inventory and commending the job done. She asked that the letter be included in the minutes. Councilmember Forslund asked the status of the TKDA VI Study. Clerk /Administrator Pauley replied he had spoken with them two weeks agu and they were waiting for the wet weather, and anticipated the meters would be in place until sometime in June. Councilmember Blanchard reported the Ramsey County League is holding a meeting on the State watershed district regulations on Wednesday evening, which she would try to attend. She also reported that Blaine was holding a meeting on a hazardous waste site at the Blaine City Hall at 7:30 PM on May 12, which she felt was important to also attend. Motion Carried 0 nays Motion Carried Attorney Meyers had no report. 11. Report of Attorney Councilmember Forslund stated she had received 12. Reports of a complaint regarding youths riding mini bikes Councilmembers and asked the Police Department to patrol the area known as the Byum property. Mounds View City Council May 10, 1982 Regular Meeting Page Four Councilmember Blanchard reported she had asked Staff to draft a resolution, commending Rob Shelquist, a Mounds View resident and Irondale High School student, for being named Mr. Basket- ball of 1982. Councilmember Doty arrived at 8:10 PM. Motion /Second. Blanchard /Hodges to adopt Resolution No. 1438, commending Rob Shelquist. 5 ayes 0 nays Clerk /Administrator Pauley read Resolution No. 1438. Councilmember Hodges reported he had been con- tacted by the resident at 2708 County Road J, who wants to put on a garage addition, which will help abate the noise problem with the traffic on J, but which requires a variance. He added he had been to the home and did find it was very noisy, and asked the rest of the Council to view the property. Official Rose explained that Mr. Petrowski, the owner, had been before the Planning Commission the previous week and had informally asked them for their input before making a formal application, and had been told by them that they did not feel they could grant a variance. He pointed out that the Planning Commission has denied such requests in the past. He also stated that Mr. Petrowski had not made a formal application to date. Mayor McCarty recommended starting the thrust on County Road J again, and approaching t'‘e County and reasserting the City's displeasure with the noise and problems on County Road J. Councilmember Hodges asked when the street patching would begin. Clerk /Administrator Pauley replied it would be a few more weeks, once the street sweeping is complete. He explained they were behind schedule due to the weather. Councilmember Doty had no report. Mayor McCarty announced there are two vacancies available for the Lakeside Park Commission. Motion Carried Mounds View City Council May 10, 1982 Regular Meeting Page Five Mayor McCarty announced the City Clean -Up Day would be May 22, and the charge for dumping would be $5 per car or station wagon load, $10 for pick -up trucks, and $10 for home pick -up. Mayor McCarty asked that Mr. Ehlers, of Ehlers and Associates be present at the next agenda session. Motion /Second: McCarty /Doty to direct Staff to invite Bob Ehlers from Ehlers and Associates to the agenda session on May 17, 1982. 5 ayes 0 nays Clerk /Administrator Pauley asked approval of the purchase of the new police squad car, based upon Chief Grabowski's recommendation. He added that it was in compliance with the specifications. Motion /Second: McCarty /Blanchard to approve the purchase of the 1982 squad car for $9,622. 5 ayes 0 nays Clerk /Administrator Pauley reported it was the City's initial intent to put a backflow preven- tion valve above ground at Silverview Park, but they have been advised that a below ground valve is now available at approximately $500 additional cost. He stated Staff would recommend the below ground valve as it would increase mowing ease and decrease vandalism. He added there is approximately $8,000 in the project budget to work with. Motion /Second: McCarty /Hodges to approve Staff's request for a backflow prevention valve, for installation in Silverview Park, at an additional cost of $500 over the original proposal. 5 ayes 0 nays Councilmember Doty asked if the City can take legal action to stop the MWCC with their proposed sewer connection. Attorney Meyers replied he would have to review the law they are working under. Clerk /Administrator Pauley added that a similar suit was filed before, with the Court ruling against the party. Report of Administrator Motion Carried Motion Carried Mounds View City Council May 10, 1982 Regular Meeting Page Six Mayor McCarty suggested polling other Cities to see if they would be willing to join Mounds View in any legal action. Doug Wood, of Ramsey County Public Health Department, explained he would be giving a slide presentation the department has put together, showing the process followed in selecting a landfill site. Mr. Wood explained all the counties were required to come up with five potential sites for landfill, with Ramsey County coming up with only two, one in Shoreview and one in Maplewood. He explained that Ramsey County is a smaller area and more densly populated that many other counties, and thus did not have the area available to be considered. Mr. Wood answered questions from the Council after the slide presentation. Commissioner Orth was also present and answered questions from the Council. He explained that a site would be approved for a specific use and it was highly unlikely that that use would be upgraded. Mayor McCarty thanked Commissioner Orth and Mr. Wood for their presentation. This wetland inventory has been reviewed and found to be very useful to the District in implementing its permit program for new development within the City of Mounds View. The District appreciates and supports the City of Mounds View's efforts toward developing a comprehensive stormwater management and environmental quality plan, of which this wetland inventory is an essential part.
