CONSENT AGENDA

The Consent Agenda is a technique designed to expedite handling of
routine and miscellaneous official business of the City Council.
The entire Agenda may be adopted by the Council in one motion. The
motion for adoption is non debatable and must receive unanimous
approval. By request of any individual Councilmember, any item can
be removed from the Consent Agenda and placed upon the Regular Agenda
for. debate.

The Mounds View City Council was called to order 1. Call to Order
by Mayor McCarty at 7:31 PM.
MEMBERS PRESENT: Councilmembers Hodges, Forslund, 2. Roll Call
Blanchard, Doty and Mayor McCarty.

Peg Mountin, 8287 Red Oak Drive, reported a pro- 4. Residents Requests

stated they were bothered by youths riding mini
bikes, and asked that the area perhaps be posted
with signs, stating no motorized vehicles in the
park. She added that residents in the area have
had the same problem.
Donald Gross, 8060 Groveland Road, asked the
status of the radiator repair shop and why he was
allowed to be in business. Attorney Meyers
replied the City had taken action, based upon
the sign violation, but the Court had ruled it
was not a sign violation. He added that the City
is in the grocess of gathering further evidence in
order to return to court.
Mr. Gross also expressed concern with Steve's
Appliance, and the garbage he leaves on his lot. He
presented the Council with pictures he had taken
earlier in the day. Mr. Gross also questioned
why the City of Mounds View could not police their
businesEes as other cities can. Mayor McCarty replied
the City has taken action in the past and will take
further action.

Motion /Second: McCarty,'Doty to instruct the
Clerk /Administrator to have the Police Department
cite the business known as Steve's Appliance, for
a violation of their development agreement with
the City of Mounds View, by noon on May 25, 1982.

John Wells, 8020 Groveland Road, noted that the
radiator shop has placed ads in two phone books,
noting their new address.
Bob Pajak, 8415 Fairchild, informed the Council
of a noise problem he and other neighbors were
experiencing with one particular neighbor. He
reported they had called the police on numerous
occasions and while the police had stopped over,
the resident was not in violation until after
10 PM. Mr. Pajak requested the Council revise
the City ordinance to give the Police the authority
to take action.
Attorney Meyers explained to Mr. Pajak that in
prosecuting such a case, everything must be proven
beyond a reasonable doubt, and standards must be
set very clearly. Mayor McCarty added they will
check into the problem.
Mayor McCarty closed the regular meeting and
opened the first public hearing at 7.45 PM.
Dick Hedin, 8041 Long Lake Road, requested the
Council consider total square footage of a lot
when considering utility sheds and their sizes,
and recommended that perhaps 2 percent of the
total square footage be allowed for a utility
shed. He also suggested consideration of
allowing a utility shed to be an extension of
a garage, which could be more aesthetically
pleasing.
Mayor McCarty replied that that section of the
code is not up for review at this time, but
that the Planning Commission and City Council
should be innovative and look at new ideas and
suggestions.
Motion /Second: McCarty /Blanchard that the City
Council direct the Planning Commission to
consider revising the accessory building size
requirements to include two percent of the lot
area as the maximum allowable size.

Councilmember Forslund informed the Council that
the Planning Commission has requested a joint
meeting of the City Council and Planning Commission
to go over the code revisions. Mayor McCarty
replied they could discuss it at the next agenda
session.
Mayor McCarty closed the public hearing and reopened
the regular meeting at 7:57 PM.

first reading of Ordinance 313 and waive the
reading.

Mayor McCarty pointad out what a tremendous task
had been accomplished in the code review and
thanked everyone involved for a job well done.
Mayor McCarty closed the regular meeting and
opened the second public hearing at 8:00 PM.
Mrs. Doelz explained they would like to put an
addition on the front of their home as they
need more space. She added their neighbors
were not against the plan.
Mayor McCarty asked when they would plan to
begin construction. Mrs. Doelz replied it would
be within two weeks of receiving approval.
Mayor McCarty stated the Planning Commission
and City Council are in the process of reviewing
the code and it is possible changes will be
made which would allow an addition of this type
without a variance being required. He added
that at present, the request is not allowable
under the code, and the applicant must demon-
strate a hardship, and it has already been
determined that such a hardship does not exist.
Mayor McCarty recommended the applicants with-
draw their request until the code review has
been completed.
Attorney Meyers also explained that the Planning
Commission has found no hardship involved, and
the City Council would have to find the Planning
Commission guilty of acting improperly in order
to override the Planning Commission's Findings.

5B. Variance Appeal

Mr. Doelz expressed displeasure with the Council
and stated they would build on property they own
in Lino Lakes if Mounds View wouldn't grant them
a variance.
Mayor McCarty closed the public hearing and reopened
the regular meeting at 8:11 PM.
Motion /Second: Doty /Blanchard to deny the variance
request for Arthur L. Doelz, subject to existing
codes.

Olive Miller, 2102 Terrace Drive, stated she was
not in favor of a variance being granted, as she
would prefer to see unity in the block.
Jean Johnson, 2097 Terrace Drive, stated she was
the next door neighbor and she had not personally
been asked if she would mind an addition to the front
of the Doelz's.
Motion /Second: McCarty /Hodges to refund one -half
of the fees paid for the hearings to the Doelz's.

Mayor McCarty asked that Item C be removed for
discussion.
Motion /Second: Doty /Forslund to approve the
consent agenda, minus Item C, and waive the
reading of the resolutions.

Motion /Second: McCarty Forslund to table any
action on the job description of the Public
Works Foreman at this time.

Motion /Second: McCarty /Blanchard to approve the
job description of the Building Inspector, noting
that the Building Inspector position will pay a
minimum of $19,925.00 in the fiscal year 1982.
Further, that the position of Building Zoning
Official be terminated and Steven Rose re appointed
as Building Inspector subject to the approved job
description for that position. In recognition of
certain transitional tasks necessary to ensure an
efficient transfer of duties formerly performed by
the Building Zoning Official, the Building
Inspector's salary and the resulting reduction will
not be fully implemented at this time. It is

by the City Council.

Technician and Director of Public Works /Community
Development, and rescind all prior position descrip-
tions for the positions of Building Inspector,
Engineering /Planning Technician, Building Zoning

lution No. 1444 authorizing reassignment of
Larry Decheine and adjustment to his salary,
and waive the reading.

precinct boundaries and a central polling
place, and waive the reading of the resolution.

Clerk /Administrator Pauley noted that if the
central polling place does not work out during
the primary election, they can reassign places
for the general election.
Mayor McCarty introduced John Johnson, the new
part -time Director of Public Works /Community
Development for Mounds View, and welcomed him
on board.
Director Johnson reported he had received a
request from a recent graduate of Bemidji State
University, who would like to do a planning
internship with the City, on a volunteer
basis. Director Johnson stated he thought it
could work out well to use this applicant, and
it was possible that he may also be able to
fill one of the part -time positions the Park
Department has available.

Motion /Second: Forslund /Doty to approve putting
the planning intern, Dani Smith, on board.

Attorney Meyers pointed out that while Mr. Smith
will be working without pay, the City is still
liable for workmans comp.
Director Johnson requested approval of Change
Order #2 for the Silver Lake Woods project,
which is the result of an oversite on Change
Order #1.
Motion /Second: Doty /Blanchard to approve Change
Order #2 to the Silver Lake Woods project, for
the valve spec modification.

Director Johnson reported to the Council on the need
to install a manhole at the intersection of Ardan
Avenue and Long Lake Road. He explained there is
a contractor in the area who would be available to
do the work, and if he is given the authority to do
it before completing his present project, will be
able to save the City approximately $500 in
equipment mobilization. expenses.
Motion /Second: McCarty /Doty to authorize Dawson
Construction to install a manhole east of Long
Lake Road, on Ardan Avenue, in an amount not to
exceed $4,545.0C with the funds to come from
the SWM fund.

Director Johnson reported he had not received a
confirmation of acceptance of t' Public Works
Foreman position from Bill Hang and he
understands further discussion has been delayed
until the June 7 agenda meeting.
Director Johnson reported he has received
information on the flood plain program, and
the City has 90 days to petition for any changes,
and that any appeal would have to be based on
scientific fact. Mayor McCarty asked Director
Johnson to have a report ready for the Council
at the next agenda session.
Director Johnson reported interviews have been
completed for the three part -time positions
available in the Public Works Department. He
reported the three applicants who are being
recommended live in Mounds View (two) and
Blaine (one).

hiring of Gilman Groberg, Raymond Williams and
John Graham for the Public Works Department, as
recommended per the memo of May 24, 1982 from
the Director of Public Works /Community Development.

Attorney Meyers reported he had met *rith the
developers of Mounds View Residence, Inc. last
week and they had hoped to present a completed
contract soon, but have run into what could be
a major problem with tax increment financing.
He explained a ruling was recently made in a
similar situation, where the Court ruled the
property in question was tax exempt, which
would ruin the proposed financing. He added
he will keep the Council posted.
10. Report of
Attorney
Councilmember Hodges reported he will be on 11. Reports of
vacation from May 27 to June 6. Councilmembers
Councilmember Forslund proposed the dates of
June 16 and 17 for a code review between the
Planning Commission and City Council. Mayor
McCarty replied a date would be set at the next
agenda session. It was pointed out that the
June 16 and 17 dates would be in conflict with
the League of Cities Convention.
Peg Mountin stated the Planning Commission would
still like the opportunity to review the changes
once more before going over them with the Council.
Councilmember Forslund pointed out that June 7
is graduation for Irondale High School.
Motion /Second: Forslund /Hodges to move the
June 7, 1982 agenda meeting to June 8, 1982.

Councilmember Forslund reported the Planning
Commission has requested upcoming agendas for
the Council meetings, and suggested that mail
boxes could be set up at City Hall whereby they
could stop in and pick up the agendas.
There was discussion among the Council of the
system presently being used to deliver mail to
Council and Commission members.

Motion /Second: McCarty /Doty to direct Staff to cease
the system of delivering City Council packets to the
homes of Councilmembers via police squad cars.

ment be ordered to cease delivering Planning
Commission packets, and the packets be made
available at City Hall.

Peg Mountin stated that the Planning Commission
had directed staff to include an agenda in their
packet, should one be available at that time. She
also noted that it is City Staff, not the Police
Department who delivers their packets. Mayor
McCarty replied they could continue having Staff
deliver the packets.
Councilmember Doty reported Clean -Up Day had been
a success.
Motion /Second: Doty /Blanchard to adopt Resolution
No. 1441 thanking all groups and individuals whc
helped with Clean -Up Day for a job well done.

Councilmember Blanchard stated it was very unfor-
tunate that the Girl Scouts experienced problems
while they worked on Clean -Up Day.
Mayor McCarty reported that Susan Moore from the
Energy Department had called regarding auditing
homes in Mounds View. Councilmember Hodges added
that the Boy Scouts will be helping with the audits.
Mayor McCarty asked for authorization to attend the
Governor's Forum on housing, cn June 2.

meeting on May 26, in the Mayor's place, as Mayor

Mayor McCarty passed out a proposed resolution
regarding Golden Gloves boxing in Mounds View, and
asked the Council to forego adoption.
Motion /Second: McCarty /Doty to direct the proper
Staff member to rescind the letter endorsing the
Golden Gloves boxing in the Mounds View Rec
program and further, that the applicant be directed
to redirect his request to the Mounds View School
Board, for Edgewood Junior High.

Mayor McCarty directed Clerk /Administrator Pauley
to give a firm, verbal reprimand to the appropriate
Staff person.
Clerk /Administrator Pauley reported that Ron
Fagerstrom had suffered a heart attack on
May 21, and was at Unity Hospital. He stated
he would update the Council as soon as he
received further information.
Clerk /Administrator Pauley review items that
had recently been received from the Net Council,
regarding an upcoming meeting, the proposed
landfill site in Shoreview, and the airport
noise land compatability plan. He stated he
would be placing the aircraft noise /land use
compatibility plan on the June 8 agenda.

meeting at 9:32 PM.
