Adopt Resolution No. Street Light at 8384 CONSENT AGENDA The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire Agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM F. PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA MEMBERS PRESENT: Councilmembers Hodges, Forslund, 2. Roll Call Blanchard, Doty and Mayor McCarty. ALSO PRESENT: City Attorney Meyers, Clerk/ Administrator Pauley and Public Works /Community Development Director Johnson. Motion /Second: Doty /Blanchard to approve the June 14, 1982 minutes as corrected. 4 ayes 0 nays 1 abstain Councilmember Hodges abstained from the vote as he had not been present at the June 14 meeting. Jim Petrowski, 2708 County Road J, stated he would 4. Residents Requests like a variance to build a garage as a buffer zone and Comments from for the traffic on County Road J. He explained that the Floor due to the heavy traffic, the noise had become a nuisance in his home. Mayor McCarty explained Mr. Petrowski had informally asked the Planning Commission for their thoughts, and he was informally denied, as they felt it would be too large a deviance from the 30 foot setback requirement, as it would be a 40% encrouchment. The Planning Commission advised Mr. Petrowski to consi- der planting shrubs, adding insulation, or moving the bedrooms. Motion /Second: McCarty /Hodges to direct Staff to bring a report from the Planning Commission, giving the basis for their suggestions as a alternative to a variance for the Petrowski residence at 2708 County Road J. 5 ayes 0 nays Mayor McCarty stated the City should be able to substantiate suggestions they make to residents. Approval of Minutes: June 14, 1982 Motion Carried Motion Carried Mounds View City Council June 28, 1982 Regular Meeting Page Two He added they will have the PCA do a noise reading, and will take a look at the present position and see if there is a better direction to take. Paul Donley, of the Mounds View School District, asked the Council for temporary approval to begin the transformation of Edgewood from a school to a community center. He explained they have a tenant that must move in by July 1. Upon questioning by the City Attorney and Council, he agreed that if for some reason they were unable to meet the con- ditions of the conditional use permit, they would move the tenant out. Motion /Second: McCarty /Forslund to issue a tem- porary conditional use permit to the School Board of District 621. 5 ayes 0 nays Dick Povlitzki asked authorization for a license to sell 3.2 beer on the Waste property during a weekend festival at his establishment. He explained the beer would be sold on the Waste property, but the patrons would also be on his parking lot, and asked if he would be in violation of an ordinance. Attorney Meyers explained the ordinance and the reasons behind it. He stated Mr. Povlitzki would not be in violation by selling the beer off his own property, but he could not guarantee there would not be problems. Motion /Second: McCarty /Doty to grant a 3.2 license contingent upon receipt of a formal letter of application and payment of the applicable fees, for July 31 and August 1, 1982, on the property described as owned by Mr. Waste. 5 ayes 0 nays Greg Johnson, 2865 Highway 10, asked for an explanation of the May 24, 1982 Council minutes, which state the City is gathering evidence to take him back to Court. Attorney Meyers explained they had been questioned by a citizen who was concerned with a business being operated in a residential zone, and they are gathering the evidence to take Mr. Johnson to court for a home occupation that is inconsistent with residential property. Mr. Johnson stated he was not the only one who was not operating within the ordinances, and stated he had a complaint against Donald Gross, Motion Carried Motion Carried Mounds View City Council June 28, 1982 Regular Meeting Page Three 8060 Groveland Road, who had created a nuisance by having a live band a beer busts in his yard, and John Wells, a neighbor whose flowers attract bees, which go into Mr. Johnson's yard. Mayor McCarty closed the regular meeting and opened the first public hearing at 8:00 PM. Jim Bremmer, 2765 LaPort Drive, explained he had 5A. Fairchild Avenue initiated the proposal for the vacation of Right -of =Way Fairchild, and summarized the history of the area, Vacation citing the problems in maintaining it and the kids who play and ride their mini bikes there. Sue Gale, 8227 Groveland, stated she was there also to speak for Debbie Yost, her neighbor, and explained that if the vacation is approved, both of them would have the backs of their lots land locked, and would not be able to subdivide in the future. Mayor McCarty closed the public hearing and reopened the regular meeting at 8:12 PM. There was considerable discussion regarding both positions. Mayor McCarty explained that when the Gale addition was approved, it was felt then that a cul -de -sac could one day be put in to service the two lots in question. He added he was reluctant to land -lock the property. Attorney Meyers also reviewed the history of the property. Motion /Second: McCarty /Doty to direct Staff to prepare the necessary work for action by the Council to resolve the Fairchild easement, in particular the north portion easterly of the Gale addition, with preservation of the westerly portion behind 8205 Groveland Road, per the plat attached to the 6/24/82 memo from Staff. 5 ayes 0 nays Mayor McCarty closed the regular meeting and opened the second public hearing at 8:32 PM. Finance Director Brager made a presentation, explaining the process the City is going through with federal revenue sharing. Mayor McCarty closed the public hearing and reopened the regular meeting at 8:34 PM. Mayor McCarty closed the regular meeting and opened the third public hearing at 8:34 PM. Motion Carried 5B. 1983 Federal Revenue Sharing Proposed Use Hearing; Mounds View City Council June 28, 1982 Regular Meeting Page Four Director Johnson reviewed the proposed plan and answered questions from the Council. He stated all recommendations from the Planning Commission had been complied with. Motion /Second: Blanchard /Hodges that the Council concurs with the Planning Commission's Resolution No. 55 -82, reference the Dailey Knolls Addition, including the conditions that are required. 5 ayes 0 nays Clerk /Administrator Pauley asked that the explana- tion of snowcones be added to Timothy Rice, under Item F, and that Robert Schmitt, also for snowcones, be added to Item F. Motion /Second: Blanchard /Doty to approve the additional names under Item F. 5 ayes 0 nays Motion /Second: Doty /Forslund to approve the consent agenda, and waive the reading of the resolutions. 5 ayes 0 nays Motion /Second: McCarty /Hodges to transfer 75.00 from the general fund contingency accounto to account 100 120 -4303, Administra- tion, Professional Services. 5 ayes 0 nays Motion /Second: McCarty /Doty to approve the pay- ment of $1,605.00 to Gunnar Isberg for services rendered. 5 ayes 0 nays Director Johnson passed out a memo from the DNR regarding the flood insurance study. He added he was in contact with Mr. Stein and would be forwarding materials received from him. Director Johnson stated he would review the report he had received from SEH regarding ponding capacity, at the July 6 agenda session. Director Johnson reported a number of calls have been received regarding the quality of the City water. He stated they are being logged in and checked into, but at this time there does not 5C. There was discu_, ion regarding options open to the City, and the cost of adding filtration equipment to that already in use. Mayor McCarty suggested a letter be composed quickly which will explain the situation, and be sent to each person who calls regarding their water. Attorney Meyers reported that effective July 1, 1982, the law authorizes City's to prosecute all gross misdemeanors, which will involve a great deal of time on the part of the police officers and City Attorney. Councilmember Doty had no report. 10. Reports of Councilmembers Councilmember Blanchard reported she had attended the League of Cities conference in Rochester, and felt it was very informative. She also felt that Mounds View was very progressive in the steps they are taking now. Councilmember Hodges reported the Youth Service Bureau had left their budget the same as last year. He added they will be moving to the Edgewood Community Center. Councilmember Hodges read a notice of Zak MacRunnels, who will be awarded as an Eagle Scout on July 14. Councilmember Forslund reported she would be on vacation next week. Mayor McCarty reported he had received the annual report from the School District. 9. Report of Attorney Clerk /Administrator Pauley reported the 11. Report of Jaycee's would not be holding their rodeo. Administrator Clerk /Administrator Pauley reported the Council was invited to the grand opening drawing of the First State Bank of New Brighton, on July 1 at 4 PM. Clerk /Administrator Pauley presented the Council with a memo from Park Director Anderson, recommending payment for the turf establishment at Silver View Park, with a retainage being held. Mounds View City Council June 28, 1982 Regul,ax Meeting Page Six Motion /Second: Doty /Forslund to approve a partial payment in the amount of $14,428.13, retaining $7,000.00, to J S Sod. The reason for the retainage is to insure the seed will meet our expectations. 5 ayes 0 nays Clerk /Administrator Pauley announced he would be on vacation on July 2. Councilmember Doty asked the status of the ditch cleaning on County Road H2. Clerk /Administrator Pauley replied the contractor has removed the sub- contractor. He added he would have Director Johnson check with Dan Boxrud to get the project finished. Councilmember Hodges brought up the problem of the handicapped access at Mounds View Square. Clerk /Administrator Pauley replied he would call them again. Motion /Second: Blanchard /Forslund to adjourn the 12.
