CONSENT AGENDA
August 23, 1982
The Consent Agenda is a technique designed to expedite handling of
routine and miscellaneous official business of the City, Council.
The entire Agenda may be adopted by the Council in one motion. The
motion for adoption is non debatable and must receive unanimous
approval. By request of any individual Councilmember, any item can
be removed from the Consent Agenda and placed upon the Regular Agenda
for debate.

The Mounds View City Council was called to order by 1. Call to Order
Mayor McCarty at 7:35 PM on August 23, 1982.
MEMBERS PRESENT: Councilmembers Doty, Hodges,
Forslund and Mayor McCarty.
It was noted Councilmember Blanchard was absent.
ALSO PRESENT: City Attorney Meyers, Clerk/
Administrator Pauley and Public Works /Community
Development Director Johnson.
Motion /Second: Doty /Forslund to approve the
August 9, 1982 minutes as corrected.

Mayor McCarty stated that the Festival in the Park
had been a very fun and yet a very humbling event,
considering the Mounds View citizens who took the time
and made the sacrifice so others could have the
day to enjoy. Mayor McCarty read Resolution No.
1474, and thanked the Festivities Commission for
a job well done.
Motion /Second: McCarty /Hodges to adopt Resolu-
tion No. 1474.

CITY OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
Mayor McCarty closed the regular meeting and opened
the public hearing for the Silver Lake Woods
assessments at 7:45 PM.
Dale Cremers, of Kraus Anderson, presented the
Council with a proposed change to the schedule of
assessments for the Silver Lake Woods project. He
explained this change would allow higher assessments
.o be put on the condominiums, and thereby lower
the assessments for the single family homes.
Attorney Meyers stated he had discussed this pro-
posed change with Mr. Cremers and Engineer Boxrud

and his only concern was to insure that the
amount of assessment on any lot must be reasonable.
He also stated the total assessment figure for the
project must not change. Attorney Meyers also pointed
out that according to market analysts, it is believed
that the condominiums will sell more quickly than the
single family homes, which will result in the City
receiving an earlier payoff.
Councilmember Doty stated he felt this request was
similar to what was proposed for SWM earlier, then
changed. Attorney Meyers replied that this does
not appear to be a problem.
Clerk /Administrator Pauley corrected the interest
rate to read "11%" on the resolution.
Engineer Boxrud stated he had gone over the
final project costs, and he feels the figures are
very close.
Mayor McCarty closed the public hearing and opened
the regular meeting at 7:55 PM.
Motion /Second: McCarty /Forsiund to send Resolution
No. 1476 back to Staff for evaluation and
recommendation.

meeting on August 30, 1982 at 7 PM to deal with
the Silver Lake Woods assessments.

Karen Weigand, 2273 Lois Drive, presented the
Council with a petition signed by 100% of the
residents of Lois Drive, requesting an immediate
and thorough investigation of the quality of the
public water they are receiving. She presented
the Council with two samples of water taken from
her tap at different times. She added they are
all concerned with the safety of drinking the
water, as well as the discoloration of clothing
and fixtures.
Mayor McCarty explained the City is in the process
of working on this problem, which started at the
beginning of the summer, and an item further on
the evening's agenda is to select a consultant
to work on the project.

Director Johnson explained the City has not con-
ducted any tests during the past 20 -30 days, other
than standard tests on the drinking water, which was
acceptable. He stated that Mounds view has been producing an
extraordinarily high amount of water this past summer,
which makes the water problem more noticeable and
wide- spread. He added that they hope to have an
answer within 30 -60 days.
Councilmember Forslund asked if Ms. Weigand would
like the samples analyzed that she presented to the
Council. Ms. Weigand replied that she would, and
she also stated she would be glad to answer questions
and provide additional samples to whoever works on
the problem.
Mayor McCarty asked if the City could agree that the
tests run by the State are reliable for health
standards. Director Johnson replied they could.
He added that since it was a very busy time of the
year, it might take longer than usual to have the
samples analyzed.
The Council discussed Item B and determined the 7. Approval of
correct amount of payment was $48,224.91. Consent Agenda
Mayor McCarty asked that Item G be removed for
discussion.
Motion /Second: Hodges /Doty to approve the consent
agenda, minus Item G, and waive the reading of the
resolutions.

Mayor McCarty stated that there seemed to be some
continuing confusion over Item G, that while the
salary was correct, he was opposed to changing the
grade level and moved that it be a Level XI.
Motion /Second: McCarty /Doty to amend Resolution
No. 1481 to set the level of responsibility as a
Level XI.

Park Director Anderson explained that this is
a question of policy issue, and while he has
prepared a proposed resolution, it was open to
change.
Mayor McCarty agreed that formal approval should
come from the Council, and added he did have
questions and would like to discuss it further.

Park Director Anderson presented an update of
where the Rec Activity Fund has been during
the past five years.
Park Director Anderson reported the Park and
Rec Commission had voted unanimously to request
the Council approve sodding of the soccer field,
rather than seeding. He updated the Council on
the problems they have had to date with seeding.
Upon questioning from the Council, he informed
them there is a quick coupler which can ba hooked
up to, to water the field_ but that it is done
manually, rather than automated.
The Council discussed the issued and decided to
wait until they had more information available.
Councilmember Hodges mentioned he had been at
City Hall the previous Sunday and found several
people in the park who wanted to use the restrooms
in City Hall. Park Director Anderson replied the
Satellite in the park had been mistakenly removed
one week early, and would be put back in place.
Park Director Anderson presented the Council with
a summary of the joint puppet wagon program.
There was discussion among the Council and Staff
regarding the process of authorizing a temporary
occupancy permit. It was requested that Staff
make a recommendation for setting a procedure.
Motion /Second: McCarty /Forslund to grant the J. E.
Duoos Construction Company, representative of, and
Standard Oil Company, a temporary occupancy permit
for the building at 2155 Highway 10.

reading of Ordinance No. 315 vacating a portion of
Fairchild Avenue.

Clerk /Administrator Pauley read Ordinance No. 315.
Councilmember Doty proposed an amendment to the
Ordinance. Attorney Meyers explained that an
ordinance is law, and should not have a recommenda-
tion in it. Mayor McCarty added he felt the
proposed amendment was covered already by the
Charter.
Councilmember Doty decided to withdraw his
proposed amendment.
Motion /Second: McCarty /Doty to accept the
resignation of Patricia Bailey and authorize the
hiring of Tammy Turnacliff, at a salary of $3.50
per hour, starting August 24, 1982.

Clerk /Administrator Pauley recommended that
Staff meet with all the owners of the buildings
in a joint meeting to advise them of the complaints
and solicit their cooperation in resolving them.
The Council discussed the problems being exper-
ienced, and the legalities of trying to prosecute.

It was felt that the Police Department is doing a
good job in handling the situation. It was the
concensus of the Council that Staff should get
together with the owners of the buildings.
Attorney Meyers reported the Miller deed has
been recorded, and discussed with the Council the
implication of what has happened.
Motion /Second: Doty /Hodges to approve
mit waive the reading.

Attorney Meyers stated that Resolution No. 1482
will hopefully prevent this problem from occuring
again at the County offices.

Director Johnson reported the street patching had
been completed. He also reported the Wetlands
Subcommittee would like to schedule a mc.eting.

of the Wetlands Subcommittee for August 26, 1982
at 7 PM.

Director Johnson reported the final improvements
for Silver Lake Woods were made last week, and
anticipates the request for final approval will
be submitted soon.
Director Johnson reported he had received a notice
from MnDOT that they will be letting bids on
Noveraber 19, 1982 for the signalization of Long
Lake Road to Highway 10.
Director Johnson reported Staff is in the process
of preparing a letter to Mr. Miller, informing him
the timeframe for his subdivision request has ex-
pired. Per Council direction, Director Johnson
stated they will bill Mr. Miller for the amount he
owes the City, and will set up a procedure to moni-
tor this closer in the future.

Councilmember Doty reported he had not personally 20. Reports of
observed anything while driving by the Hillview Councilmembers
Apartments.
Councilmember Forslund reported she had received
some phone calls regarding clothes which had been
discolored by the City water.
Councilmember Hodges reported the Northwest Subur-
ban Youth Service Bureau is asking each City for
a resolution of support, and presented a proposed
resolution to the Council.
Motion /Second: Hodges /Doty to approve Resolution
No. 1484 and waive the reading.

Mayor McCarty reported he had met with members from
the Mounds View School Board and the coordinator
for the Mounds View District #621 Senior Citizens
for their weekly lunch at the Edgewood Community
Center.
Mayor McCarty reported he had received a brochure
from a well known collection agency regarding
collecting delinquent assessments and taxes.
At torney Meyers replied he would have to investi-
gate further, but that Minnesota law does not
allow the collection of these before they are due.
The Council directed Staff to check into the
delinquent taxes and see who the owners are.
Mayor McCarty asked that Chairman Mountin of
the Planning Commission be informed of the MAC
meeting to be held at 7 PM on August 25.

disposition of the City contract with Short,
Elliott, Hendrickson, engineering consultants.

Mayor McCarty explained the City is trying to
lower its operating costs as much as possible,
and now that they have a part -time in -house
engineer, they would like to put consulting
business out for bid, based on a recommendation
from the City Engineer, if it could not be done
in house. He explained it was strictly a
movement to cut cost, ard in no way is a
reflection on the past performance or value
of Short, Elliott, Hendrickson to the City.

other than current contracts or projects.

Clerk /Administrator Pauley reported he had received 21. Report of
a phone call from Mr. Povlitzki, informing him he Administrator
is investigating selling part of his ownership,
and asking what provisions the City has. Per
Attorney Meyers, it would be handled the same way
as any other applicant for a liquor license.
Clerk /Administrator Pauley stated he would convey
that to Mr. Povlitzki.
