Licenses for Approval CONSENT AGENDA September 13, 1982 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire Agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, any item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Adopt Resolution No. 1486 Approving Just and Correct Claims Against City FunJs PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order by Mayor McCarty at 7:37 PM on September 13, 1982. MEMBERS PRESENT: Councilmembers Hodges, Forslund, Blanchard, Doty and Mayor McCarty. ALSO PRESENT: City Attorney Meyers, Clerk/ Administrator Pauley and Public Works /Community Development Director Johnson. Motion /Second: Doty /Forslund to approve, as corrected, the August 23, 1982 minutes. 5 ayes 0 nays Motion /Second: Doty /Hodges to approve the August 30, 1982 minutes as presented. 5 ayes 0 nays There were no residents requests or comments from the floor. Motion /Second: Forslund /Blanchard to approve the consent agenda and waive the reading of the resolutions. 5 ayes 0 nays Motion /Second: McCarty /Forslund to adopt Ordi- nance No. 315 as presented at the first reading and waive the reading. No. 315 Vacating a Portion of Fairchild Avenue Motion Carried Mounds View City Council Regular Meeting Motion /Second: Doty /Hodges to amend section III of Ordinance No. 315 to add "Should the Council and property owners choose not to proceed with the improvement at that time, they will be required to meet annually or more frequently, if a problem such as dumping should reoccur on the right -of -way site. Motion /Second: Forslund /Doty to approve the iirst reading of Ordinance No. 316. 5 ayes 0 nays Clerk /Administrator Pauley read Ordinance No. 316. There was discussion among the Council regarding the length versus width ratio and whether there might be a problem with condominiums. Director Johnson explained that Staff addressed it only as it relates to single family homes, and there was a concern in stating a 24' width, as there are some existing homes that do not meet that requirement now. Attorney Meyers explained that if a structure was totally dest it would not be grand fathered in. Motion /Second: McCarty /Hodges to have Staff make the applicable amendments to Ordinance No. 316 limiting the impact of the ordinance to single- family zoned districts in time for the second reading. 5 ayes 0 nays Councilmember Doty asked that Section II also be researched further, regarding foundations. Mayor McCarty closed the public hearing and reopened the regular meeting at 7:55 PM. Mayor McCarty closed the regular meeting and opened the next public hearing at 7:55 PM. Conditional Use Permit for Edgewood Commu- nity Resource Ctr. Mounds View City Council Regular Meeting There were no comments or questions from members of the audience. Mayor McCarty closed the public hearing and re- opened the regular meeting at 7:56 PM. Motion /Second: Hodges /Blanchard to adopt the Planning Commission's Resolution No. 57 -82 for a conditional use permit for the Edgewood Community Center. 5 ayes 0 nays Mayor McCarty reported the Council has the Staff reports, and the appropriate investigations have been done, but stated that in light of the pro- blems other communities have been experiencing with establishments of this type, the City would like to protect itself by requesting the applicants to furnish the City with references from their immediate neighbors of Conroy's Bar and Lounge. Motion /Second: McCarty /Doty to table the application for the license until such time as the City receives references as requested. 5 ayes 0 nays Mayor McCarty explained to the applicants that this request should only result in a two week delay. Clerk /Administrator Pauley explained that the City has not received a reply yet to Mr. Anderson's letter to Ernst Movers. He added that as the purchase would exceed $10,000, the City would have to advertise for bids. It was agreed by the Council that the buildings were definitely needed, but the problem was where the funding would come from. Clerk /Administrator Pauley stared Staff would be doing further research, but that the revenue sharing budget for 1983 was already very tight, but another area to look into would be the interest earned by the City on certain funds. Councilmember Doty stated he had viewed the buildings and sat in on the meeting where the details were discussed. Motion /Second: McCarty /Doty to direct Staff to identify any possible funding sources to allow the purchase of these buildings, and to report back to the Council for further action, as per Park Director Anderson's memo of September 9, 1982. Review of Staff Recommendation Regarding Pur- chase of Park Shelter Buildings Mounds View City Council Regular Meeting Page Four In the meantime, bids should be advertised for, with the stipulation of the right to reject all bids, and with the number of buildings to be solicited for 1 -4. 5 ayes 0 nays Park Director Anderson reported that Mr. Ernst called him late in the afternoon and stated he would be willing to sell the buildings at $5,500 each, with the fourth wall and roofing complete, and delivered. The Council expressed a sincere hope that the funds could be found to purchase the buildings. Park Director Anderson reviewed the bid process the City had gone through for Silver View Park for the maintenance contract. He added that they need direction from the Council on the chemical applications. Motion /Second: Doty /Hodges to approve the park maintenance service contract with M and A Properties of New Brighton, to include that $2,000 be reinstated for the fertilizing and broad leaf control, for a total of $9,245. 5 ayes 0 r,<•ays Motion /Second: McCarty /Doty to amend the previous motion to a total of $7,245. 5 ayes 0 nays It was agreed that the City would purchase the chemicals and provide them to M and A Properties. Park Director Anderson reported the Lakeside Park shelter building had caught on fire on Sunday evening, and there was no estimate of the amount of damage yet, but that the building was fully insured. Park Director Anderson also reported the Groveland Park Fair on Saturday had been a huge success and had raised approximately $1,000 for the park fund. Motion /Second: Hodges /Doty to accept the resigna- 11. Lion of Laurie Johnson as the Police Department's part -time clerk /typist, effective September 2, 1982 and approve the hiring of Linda Meyer for the position, at an hourly rate of $4.50, not to exceed 20 hours per week. 5 ayes 0 nays September 13, 1982 Motion Carried 10. Director Johnson reported he had received a memo regarding the final acceptance of the First State Bank of New Brighton, Mounds View office. Motion /Second: McCarty /Doty to release the letter of credit to Sahara Investment Co., No. 61215, in the amount of $77,035, and issue a final certificate of occupancy. 5 ayes 0 nays Motion Carried Director Johnson reported the City had received notice from the Rice Creek Watershed District that an application had been made by Mr. Miller, for some type of action on his 70 acres. He reported Staff is checking into this. Director Johnson reported he had met with County and State engineers regarding County Road J and MSA funding and snow plowing, and would be following up with them. Attorney Meyers had no report. 13. Report of Attorney Councilmember Hodges had no report. 14. Reports of Counci lmembers Councilmember Forslund asked that Staff check into the cars being parked on the street in front of apartment buildings, as she was concerned with safety. Motion /Second: McCarty /Forslund to request the Planning Commission and Police Department make a recommendatior to the Council in reference to the continued parking on Greenfield between County Road I and Highway 10. 5 ayes U nays Motion /Second: Blanchard /Doty to amend the previous motion to include all on- street parking. 5 ayes 0 nays Motion Carried Motion Carried Mounds View City Council September 13, 1982 Regular Meeting Page Six Jerry Linke reported the Planning Commission has discussed the problem already, and at this point, there is nothing they can do. Mayor McCarty replied that if the Planning Commission comes back and says off street parking requirements should be made stronger, and Council can consider it. Councilmember Doty reported he had viewed the burned shelter building, and the damage seemed to be mainly confined to the roof. Councilmember Doty reported that since funds have been allocated for a dump truck for the City, Staff has been asked to check into purchasing a used one. Councilmember Blanchard reported the community picnic at Groveland Park was very well received, and she hopes to see this type of activity spread to the other neighborhoods. Mayor McCarty reported there would be another budget session on September 20, at the regular agenda meeting, prior to the public hearing. Mayor McCarty reported the City is required to publish a summary of the budget prior to the public hearing, and since it had been overlooked for the City newsletter, it would have to be published in the New Brighton Bulletin. Motion /Second: McCarty /Forslund to authorize from the contingency fund, adequate funds to print the budget summary in the New Brighton Bulletin for publication on September 16, and to post as soon as possible, notice of the hearing on the sign board outside City Hall. 5 ayes 0 nays Councilmember Doty reported the Charter Commission will be meeting at 7 PM on September 22. The Council reveiwed Resolution No. 1471, and Attorney Meyers advised that the ordinance would prevail over the resolution. Report of met with the Hillview Road apartment owners, Administrator and that while no conclusion was reached, some understandings were reached and the, majority indicated their desire to work with the City. It was recommended that some type of code of conduct be drawn up, with a number of violations being grounds for eviction. Clerk /Administrator Pauley reported there would be a meeting between the residents of the trailer court and Tyson's on September 23 at 7 PM in the Townsedge Mobile Home community center, and that he would be attending just as an observer. Clerk /Administrator Pauley reminded the Council to vote in the primary election on September 14, and to take note of the voting set -up at the Bel Rae Ballroom.
