CONSENT AGENDA
June 13, 1983
The Consent Agenda is a technique designed to expedite handling of
routine and miscellaneous official business of the City Council.
The entire Agenda may be adopted by the Council in one motion.
The motion for adoption is non debatable and must rece. a unani-
mous approval. By the request of any individual Councilmember,
any item can be removed from the Consent Agenda and placed upon
the Regular Agenda for debate.

It was noted that Councilmember Doty was absent to
attend a funeral.
ALSO PRESENT: City Attorney Meyers, Clerk /Admini-
strator Pauley and Public Works /Community Development
Director Johnson.
Motion /Second: Linke /Hankner to approve the May 23,
1983 minutes as corrected.
There were no residents requests or comments from
the floor.

The Mounds View City Council was called to order 1. Call to Order
by Mayor McCarty at 7:35 PM on June 13, 1983.
MEMBERS PRESENT: Councilmembers Hankner, Blanchard, 2. Roll Call
Linke and Mayor McCarty.
Mayor McCarty asked that Item K be removed fer 5. Approval of
discussion. Consent Agenda
Motion /Second: Hankner /Linke to approve the consent
agenda, minus Item K, and waive the reading of the
resolutions.

Mayor McCarty stated that, concerning Item K, for
a conditional use permit for an oversize accessory
building, the conditions for a conditional use
permit have been met under the present code, but
that the proposed revision to Chapter 40 is much
more restrictive, and he did not feel this
conditional use would be allowed if proposed revisions to Chapter 40
are passed. He also expressed concern in not
allowing the transfer cf the conditional use
permit to a new owner as such action would create

an encumbrance of the property. There was
discussion among the Council as to potential problems
if the permit was transferrable, as far as someone
running a home occupation out of the building, and
what type of door would be put on the building.
Mayor McCarty recommended the item go back to the
Planning Commission for additional consideration,
and asked that they also discuss the size of
accessory buildings allowed.
Motion /Second: McCarty /Blanchard to table Item K
and the request for an accessory building for
Willard Haro at 3048 County Road H2, and re -refer
the item to the Planning Commission for further
disposition.

Sydney Lang, 12 Buffalo Road, St. Paul stated she
has always had children in the Mounds View School
District, and commended the City for their position
on the 19 year old legal drinking age, and asked
that they do what they can when issuing liquor
licenses to see that ID's are checked.
Mayor McCarty stated that he agreed 19 is too low
an age and that they will do all they can.
Clerk /Administrator Pauley briefly explained the 6. 1st Reading of
purpose of proposed Ordinance No. 342, which Ord. 342 Amend-
adopts Rule #8 of the Minnesota Air Pollution ing Chapter
Control Agency, which allows the Fire Chief to 63.05 of the

Clerk /Administrator Pauley explained the proposed
resolution, stating that it was prepared under
advisement from Attorney Meyers.
Director Johnson added that Chapters 60, 61, 62
and 63 will require amendments, and to make all the
changes inclusive, they are proposing to modify
all the chapters.

Motion /Second: Blanchard /Hankner to approve the
?irst reading of Ordinance No 343, amending
the Municipal Code of the City of Mounds View, by
amending Chapters 60, 61, 62 and 63.

Clerk /Administrator Pauley noted the funding had
already been approved in the budget, and that it is
common practice for the Council to approve all
individuals hired by the City.
Motion /Second: McCarty /Hankner to approve the hiring
of Donald Matanowski and Nick Barbato, as summer park
maintenance laborers at the rate of $5.50 and $5.00
per hour, respectively, effective May 31, 1983.

Clerk /Administrator Pauley explained that the memo
dated June 9, 1983 from Park Director Anderson
was just an update for the Council on the composting
proposal.
Director Johnson reviewed his memo of June 9, 1983
to the Council, providing an update on special pub-
lic works projects. He reported there has been a
great deal of activity in special projects, and he
has utilized the budgeted hours that were set aside
for 1983.
Director Johnson reviewed the status of the budgeted
hours and dollars. Clerk /Administrator Paulev stated
he would provide the Council with a specific recommen-
dation on how to proceed to further provide additional
service time from Director Johnson.
Director Johnson asked the Co;incil's consideration of
proposed Resolution No. 1619, for the Dalberg Develop-
ment proposal, so they could proceed.
Motion /Second: McCarty /Hankner to adopt Resolution
No. 1619 and waive the reading.

Attorney Meyers reported he was asked to comment on 11. Report o
the Knollwood Green condominium proposal and the Attorney
screening planned. He reviewed the history of the
development, and stated Development Agreement No.
83 -57 indicates the developer will follow the
requirements of the City. He explained the code
does not specify the type of screening, and the
Development Agreement calls for a site plan, and
Exhibit 2A does not specifically require it. He
advised that to have it as part of the Development
Agreement, there is a provision in the contract to
do by mutual consent. He stated that Staff feels
the planting buffer will be adequate. He summarized
that unless the contract is amended, the developer
is not required to put up a fence.
Mayor McCarty stated that several residents had asked
to be present when Attorney Meyers provided his
opinion, and recommended they be invited to the next
meeting.
Clerk /Administrator Pauley replied that he has asked
Attorney Meyers to provide his opinion in writing,
and that he plans to mail a copy of it to all concerned,
and that if anyone still has questions, they could then
come before the Council.
Mayor McCarty questioned why the City couldn't have the
same fencing requirements for all, and stated he was
not sure that fencing could be required based on
density. Attorney Meyers replied that if a policy is
established, they would have to have some reasoning for
it, and that something could be added to the code.
Attorney Meyers reviewed a proposed amendment regarding
legislation on the Anoka County Airport, and advised the
Council of how it would affect the City's lawsuit.
Mayor McCarty asked that Clerk /Administrator Pauley
draft a letter on the Council's position on the airport
situation, for the next agenda session.
Councilmember Hankner had no report. 12. Reports of
Councilmembers
Councilmember Blanchard reported she had received
a complaint regarding the height of the duplex
being built at Greenfield and County Road I.
Clerk /Administrator Pauley replied that the Building
Inspector has checked it, and the grade is what was
stipulated, based on previous City requirements.
Councilmember Linke reported the Festivities
Commission would be meeting on June 26, and updated
the Council on what is being planned.

Councilmember Linke asked if more notice could be
given on the deadline for articles for the City
Newsletter. He also asked if what is now known
as the Mayor's Message could be turned over to
the other Council members for some issues, to
allow them the opportunity to submit articles
and become better known by the citizens. He
pointed out that the Newsletter is published
six times yearly, so each Councilmember could
have one issue, and the Mayor two issues.
Mayor McCarty replied that per the Charter, it
has been determined that the Mayor should write
a message to the citizens, and it has been
determined also that the City Newsletter is the
method to use. He recommended that they could
also add a Council's Corner, for the Councilmembers
to use for their articles.
There was considerable discussion on whether
there should be separate articles, or whether
they should be combined. Mayor McCarty stated
he would like to keep the Mayor's Message
separate, due to the Charter requirements.
Mayor McCarty asked Staff to prepare a proposal
for the Council, regarding the City Appreciation
Dinner, and having the City pay for the dinner
of all active Commission members, as a sign of
the City's appreciation of them. He asked that
Attorney Meyers determine what funds could be used.
Clerk /Administrator Pauley advised that all
Councilmembers will be receiving 15 dinner tickets
sometime in the next week, to sell for the
Appreciation Dinner.
Clerk /Administrator Pauley reported that a large
number of government organizations in the State
are co- sponsoring a 3 day symposium in Duluth
in July, on computer usage. He stated he would
like to make use of part of the $200 training
money available this year, and would have Finance
Director Brager attend with him. He reviewed
the expenses involved.
Clerk /Administrator Pauley asked Attorney Meyers
if the City has a legal means to require Bob
Waste to separate his commercial from his residen-
tial water usage, for his sewer and water billing.

Regular Meeting,
Attorney Meyers replied that the zoning there is
commercial and it is basically a commercial use, so
it should be billed as commercial.
The Council discussed the history of the property
and what their water usage was.
Motion /Second: McCarty /Linke to direct Staff to
inform Mr. Waste that the future water usage charges
on his meter will be on a commercial basis.

Councilmember Hankner abstained from the vote as
she stated she would like more information on the
matter.
Clerk /Administrator Pauley reported he will be at
the League conference on Wednesday, Thursday and
Friday.
