CONSENT AGENDA
June 27, 1983
The Consent Agenda is a technique designed to expedite handling of
routine and miscellaneous official business of the City Council.
The entire Agenda may be adopted by the Council in one motion.
The motion for adoption is non debatable and must receive
unanimous approval. By the request of any individual Council
member, any item can be removed from the Consent Agenda and placed
upon the Regular Agenda for debate.

PROCEEDINGS OF THE CITY COUNCIL
CITY OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
The Mounds View City Council was called to order by
Mayor McCarty at 7:30 PM on June 27, 1983.
MEMBERS PRESENT: Councilmembers Hankner, Blanchard, 2. Roll Call
Doty, Linke and Mayor McCarty.
ALSO PRESENT: City Attorney Meyers, Clerk/
Administrator Pauley and Public Works /Community
Development Director Johnson.
Motion /Second: Hankner /Linke to approve the June 13,
1983 minutes as corrected.

0 nays 1 abstain
Councilmember Doty abstained from the vote as he had
not been present at the June 13 meeting.
Mayor McCarty closed the regular meeting and opened
the public hearing at 7:40 PM.
Finance Director Brager explained that the hearing
is held prior to the Council considering any items
in the 1984 budget, and the purpose of it is to
obtain suggestions from the citizens on possible
uses for revenue sharing funds. He stated the
suggestions would be taken into consideration by
Staff in preparing the budget.
Councilmember Blanchard stated she had received phone
calls from citizens asking that the City parks be
included in the revenue sharing, for the repair and
update of the present equipment.
There were no comments from citizens present.
Mayor McCarty closed the public hearing and reopened
the regular meeting at 7:42 PM.
There were no residents requests or commments from
the floor.

Clerk /Administrator Pauley explained
Yenish was present, and had met with

Council regarding Item 3 on Appendix
development agreement, concerning spr
Mr. Yenish explained that the sprinklers were not
required when he first checked the City code, and
this requirement will totally change his plans
for his hotel development.
Motion /Second: McCarty /Doty to table the project
until such time as the developer has provided the
City with all the required information.

Mayor McCarty explained the City does not have the
final plat yet from Mr. Yenish, and he is not willing
to approve something he has not seen.
Mr. Yenish's engineer explained that there was a
misunderstanding in talking to Staff, as it is just
a matter of showing the property line being moved.
Director Johnson stated that after the second reading
of proposed Ordinance No. 342, it would be another 40
days or so before the code would take effect, and
asked if the Council intends to require sprinklers
for this particular building.
Mayor McCarty replied that they should be required in the
Development Agreement, as the Council is responsible for
the public health, safety, and welfare.

and adoption of Ordinance No. 342, an ordinance
amending Chapter 63.05 of the Municipal Code of the
City of Mounds View entitled, "Fire Code and waive
the reading of the ordinance.

second reading and adoption of Ordinance No. 343,
amending the municipal code of the City of Mounds
View by amending Chapter 60, "Building Code and
License Fees Chapter 61, "Plumbing Code Chapter
62, Electrical Code and Chapter 63, "Fire Code
and waive the reading of the ordinance.
Motion /Second: Doty /Linke to accept the recommenda-
tion of the Civil Service Commission, appointing
Officer Tim Smith for a 90 day period, to be
Acting Police Chief.

Clerk /Administrator Pauley explained that Staff has
evaluated the parking and determined there would
still be sufficient parking space to meet the
requirement.
Attorney Meyers explained the Building Inspector
determined this application to require a building per-
mit, and that it is not so much a zoning question as
it is a building code question, and since it is for
a commercial development, it is up to the Council's
descretion if they wish to review it. He added that
the developer has been warned that no liquor can be
consumed on the volleyball court, or outside in the
parking lot.
Mayor McCarty expressed concern with reaching too far
in controlling something of this nature. Attorney
Meyers further explained why it was before the Council.
Motion /Second: McCarty /Doty to approve the request
for a volleyball court and fence for the Loose -Ends
Night Club, with notification to the Police Department
of the potential for consumption of liquor in the
parking lot, or a conflict regarding the public
health, safety and welfare due to the proximity of
Highway 10.

Regular Meeting
Director Johnson reviewed the request for a fill
permit for 3048 County Road H -2. He noted that
Mr. Haro was present.
Councilmember Blanchard noted that Mr. Haro had
just asked the Council for a special use permit
for an oversized building, and asked where it would
be placed on the lot.
Mr. Haro stated the lots are 638' deep, with the fill
to go in the rear 438'. He stated the proposed
garage would go in the small, narrow section toward
the front of the lot.
Motion /Second: McCarty /Doty to approve Mr. Haro's
request, contingent upon compliance with the Staff
recommendations listed in the memo of June 23, 1983.

Mayor McCarty explained the cash escrow requirement
to Mr. Haro.
Director Johnson updated the Council on the installa-
tion of modifications in Treatment Plant #1.
He also reported that two calls had been received
from Rice Creek Watershed District regarding Mr.
Poplaars development, and that he might be required
to install a control outlet device, in addition to
what the City might require. He advised that
Mr. Poplaars might be back before the Council to
discuss it.
Director Johnson updated the Council on the Bob Waste
fill permit, stating that he had complied with two
of the three requirements, and is working on the third.
He advised that Rice Creek Watershed District has also
become involved.
Director Johnson updated the Council regarding the final
inspection on the Oak Park pond outlet structure, and
the work on Wells 5 and 6.

husband had visited the local liquor establishments
to observe how ID's were checked. She stated they
did not observe much carding at one. She also stated
she had been told that one establishment had an under
age person working as a bartender.
Clerk /Administrator Pauley asked Councilmember Hankner
to get in touch with Acting Police Chief Tim Smith
with the information she was given, so that he might
check it out. He also advised that a letter had been
sent to all the liquor establishments.
Mayor McCarty reported he had met with the probation
officer for the Ramsey County Juvenile Service Center,
and had spoken with someone at the courthouse, and
neither of them had been aware of any extraordinary problem
of juveniles being served liquor in Mounds View.
Attorney Meyers noted there has been very good enforce-
ment by the law officers, both from the City Police
Department, and the Highway Patrol.
Councilmember Hankner noted that when the grass is
mowed along the boulevards, the clippings go out
into the street, and then when it rains, they go
into the storm sewer. Director Johnson stated he
would check into the matter.
Councilmember Blanchard reported she had attended an
airport meeting the previous Wednesday, and was not
able to attend the Planning Commission work session.
Councilmember Doty reported he had attended the meeting
of the Park Commission, where they prioritized the
desired park improvements, to be passed on to the
1984 budget.
Councilmember Linke reported the Festivities Commi-
ssion is finishing up preparations for the Festival
in the Park.

Clerk /Administrator Pauley replied he would check
with Park Director Anderson to see if he had a
response yet.
Mayor McCarty directed Staff to give Mr. Wagner a
copy of the article from the Administrator's Newsletter,

regarding the water pollution from the Arsenol, to be
used as a public news release.
Mayor McCarty asked for concensus from the Council to
give no sympathy to any Council member or Department
Head found without a Festival in the Park button.
Clerk /Administrator. Pauley reviewed the cost of con- 15. Report of

Clerk /Administrator Pauley reported he had received
a call from the new administrator /manager of CTF, Inc.,
stating they would like to be able to come back and
finish the Long Lake Road ditch job. Clerk /Administra-
tor Pauley stated he advised the gentleman he would
have to contact the bonding company for their approval,
and that also if they did do the work, they would have
to put everything back to the original specifications.
Clerk /Administrator Pauley reported they hope to have
the City Newsletter out on July 5, and that some
articles are being rewritten to update their informa-
tion.
Clerk /Administrator Pauley reviewed the proposed costs
involved in the goal setting seminar, and reviewed
where he had been able to locate funds toward the cost.
Mayor McCarty stated he felt it was important for Clerk/
Administrator Pauley to attend his national conference
as it is very valuable to the City.
Motion /Second: McCarty /hlanchard to approve the request
for the seminar, and that the money be taken from the
contingency fund.
