CONSENT AGENDA
August 8, 1983
The Consent Agenda is a technique designed to expedite handling
of routine and miscellaneous official business of the City
Council. The entire Agenda may be adopted by the Council in one
motion. The motion for adoption is non- debatable and must
receive unanimous approval. By request of any individual
Councilmember, any item can be removed from the Consent Agenda
and placed upon the Regular Agenda for debate.

The Mounds View City Council was called to order by 1. Call to Order
Mayor McCarty at 7:34 PM on August 8, 1983.
MEMBERS PRESENT: Councilmembers Doty, Linke, 2. Roll Call
Hankner, Blanchard and Mayor McCarty.
ALSO PRESENT: City Attorney Meyers and Clerk/
Administrator Pauley.
Acting Police Chief Smith informed the Council that 3. 2nd Quarter
the second quarter had been quiet, with the number Department Head
of calls down, and citations up slightly. He Report Police
reported the CSO is working out well, and that one Chief
officer had been out on sick leave. He also reported
that Operation Block Watch is going well, but slow,
due to limitations in time and manpower, and asked
that an article be placed in the newsletter about it.
Motion /Second: Blanchard /Linke to approve the
July 25, 1983 minutes as corrected.

Councilmember Doty abstained from the vote as he had
not been present at the July 25 meeting.
There were no residents requests or comments from
the floor.
Mayor McCarty asked that Items D and E be removed
for discussion. Councilmember Doty asked that Item F
be removed also.
Motion/Second; McCarty /Blanchard to approve the con-
sent agenda, minus Items D, E and F, and waive the
reading of the resolutions.

On Item D, Mayor McCarty questioned how the damage
estimates were determined for the vandalism done to
the warming houses. Park Director Anderson replied
that Police reports had been filed in February 1982,
and claims filed with the insurance company, and
Satellite Industries was informed of the situation.
He added the City did not hear back from Satellite
until August 1982, and that they had gone ahead
and repaired the buildings and billed the City, at
which time the City submitted the billing to the
insurance company, which paid $318.74 of the
$3,073.57 bill. He explained that the insurance
company determined the acts of vandalism had
occurred over a period of time, and thus each had a
separate deductible, and they also felt that some
of the items were considered regular wear and tear,
which they would not cover.
Councilmember Doty asked if any of the vandals had
been caught. Park Director Anderson replied that
there had not been enough evidence to charge anyone
with, and that one attendant had admitted to his
part in it, and the money he had paid to the City
had gone into the appropriate account.
Mayor McCarty reviewed Park Director Anderson's memo
of July 22 to Satellite Industries, stating that he
felt the labor and repair bills provided did not
adequately reflect the damage that actually occurred,
and that the invoices and repairs were made after the
fact, without approval of either the City or the city's
insurance agency, and asked Attorney Meyers if the
City had any recourse.
Attorney Meyers replied that the matter could be
argued, but he was not certain what factual basis
could be used in the dispute.
Motion /Second: McCarty /Doty to table Item D and
direct Staff to negotiate with Satellite Industries,
offering a settlement of 60% of that which has been
requested.

Attorney Meyers also recommended checking to see if
Satellite had carried insurance on the buildings.
Park Director Anderson replied that the City had been
required to have a special rider taken on the build-
ings.
On Item E, Mayor McCarty questioned if the raise
was to be a merit increase. Park Director Anderson
replied that it was.

Motion /Second: McCarty /Doty to approve Item E, noting
that the salary increase is a merit increase, to be
funded from general account no. 100 350 -4304, retro-
active to June 15, 1983.

On Item F, Councilmember Doty stated that the people
involved would like to have a plaque to commemorate
those who were involved in the park and its ultimate
release to the community.
Motion /Second: Doty /Linke to approve Item F, and
direct the Park and Rec Commission to negotiate with
Spring Lake Park to put together a plaque commemorating
those people involved in Lakeside Park, Inc., and
prepare some type of fitting ceremony.

Park Director Anderson reported there was nothing
further to present to the Council at this time,
and he hoped to have an agreement reached before
the next agenda session.

until the next agenda session, for further Staff
report.

Clerk /Administrator Pauley reported that, due to
action taken during the 19d3 Legislative session,
the City is required to obtain two or mere written
proposals for a purchase of under $15,000, and if
the Council would be in favor of the purchase of
the dump truck, they should direct Mr. Anderson
to obtain a second written proposal.
Mayor McCarty asked for a clarification of the pro-
blem in transporting equipment and employees. Park
Director Anderson replied that with so many summer
employees working for the City through grant programs,
they have found it to work best to have everyone
report to Woodcrest Park first thing in the morning,
for their assignments and to dispense equipment, and
from there they are being transported to where they
are to work for the day, and since there is not an
extra City vehicle available to transport them, one
of the workers has been driving her own personal
vehicle, using it to transport the other workers
and equipment and so forth.

Motion /Second: McCarty /Hankner to table this item
until such time as the Public Works Director can give
the Council a report on the reasons for no City
vehicles being available to move equipment to Silver
View Park, and have Staff present a proposal on how
to sort out the days activities without doing so in
one area of the City and then moving to another,
and provide reasons if there are no other options.
Also, they should immediately discontinue the use
of personal vehicles on City business.

Mayor McCarty stated he had noticed trucks and trailers
parked while someone was mowing a lawn, and stated that
the situation should be clarified, and that some type
of motor pool operation should be set up.
Councilmember Blanchard asked if any type of a log was
kept of the miles driven, by whom and where. Clerk/
Administrator Pauley replied that mileage is kept
track of as the vehicles are filled up, but that
detailed logs are not kept, due to the paperwork
involved.
Councilmember Doty recommended that another bid be
received so that the proper procedure would be
followed, if a truck were to be purchased.
Park Director Anderson asked if there was an esta-
blished policy regarding the disposal of surplus
equipment in the City, as he had been contacted by
a City employee, wishing to purchase a surplus
generator.
Attorney Meyers advised that the Council must first
declare the equipment as surplus. Clerk/Administra-
tor Pauley added that after the Council has declared
it as surplus, the City would go out and get the
best price and present it to the Council.
Motion /Second: McCarty /Doty to approve the second
reading and adoption of Ordinance No. 345, vacating
14' of the alley right -of -way in Block 1, Iron Works
Plat, and waive the reading.

Mr. Miller stated they are requesting to file a final
plat, and at the last agenda meeting, Staff had
indicated they would like more time to consider the
wetlands alteration. He stated that he has no
objection to any additional time that they would
like.
Councilmember Hankner stated that there are a number
of differences in completing the process, and that both
Staff and the Planning Commission have requested policy
statements. She presented the Council with a suggested
timetable to be established for completion of the
process for the Miller plat. She also stated that the
Council has discussed the extension process and what
they want to look at during that period, to insure
conformance with the ordinance, make sure the preli-
minary plat meets the wetland reclassification, that
they give Staff the necessary time for their review,
and resolve the drainage issues.
Attorney Meyers reported that the input the Council
has received points out two areas to work on, to
amend the inventory of the wetlands, as the ordinance
does provide for it, which would require a public
hearing and a 4/5 vote of the Council. It would
also involve an ordinance, which would involve a
waiting time. He stated that he felt six months
was more than adequate to handle it.
Attorney Meyers also advised that once the wetlands
have been redefined on the parcels, they would have
to look at the plans as submitted by the developer
to see if they will fit within the redefined wetland.
He stated that the Council had extended consideration
of the preliminary plat on April. 11, and the Council
should now respond to the developers request and
extend the time limit for approval of the preliminary
plat
Motion /Second: McCarty /Linke to extend consideration
of the preliminary plat for the Miller Industrial Plat
for six months, until January 4, 1984, and to refer
the matter to Staff for their reports on the proposals for:
a reclassification of the wetlands and the ability of the
preliminary plat to conform to the wetlands designa-
tion, if amended, plus other criteria that must be
followed with the wetlands ordinance, within 60 days.
Also, prior to the expiration of the 60 day time frame,
Staff will submit to the Council for their approval,
a checklist to weigh the requirements of the ordinance
against the proposal, such as whether the proposal
complies with the ordinance and reasons why it does
not comply. Conceptual approval of amendments of the
wetlands alteration permit and drainage issues and
amendments, if any, to the wetlands alteration permit
to be considered target date is 15 days after receipt of

Staff's report. The developer will submit all docu-
ments necessary for final plat and development
agreement approvals within 45 days of conceptual
approval of the wetlands alteration permit. The
Council authorizes Staff to submit proposals for an
expert in the field to determine the validity of
the developers proposal in reference to the wetlands
boundry lines.

Mayor McCarty clarified that they can only enforce
the ordinances that are in effect, and they need to
take the proposal against existing ordinances only.
Mr. Miller replied that it is important to get
conceptual approval of the wetlands alteration
before they spend a considerable amount on
engineering.
Councilmember Linke stated he thought the Council
would be able to give a definite opinion at the end
of the 60 day period. It was also clarified that Phase
2 was not involved at this time.
Mr. Miller stated thatthe Ramsey Soils and water Conserva-
tion District has indicated there are errors in the
map used for the wetland map, and that they will be
happy to resolve those issues. It was pointed out
in an August 5 letter from Mr. Malkerson that the
site might be reclassified.
Mr. Miller stated he was comfortable with the dates
which had been established.
It was noted that the Council granted the extension
on the basis of the applicant's attorney's recommen-
dation and the request of the applicant, per their
letter of August 5, 1983.
Clerk /Administrator Pauley presented the Council
with a proposed timetable for review and approval
of amendments to Chapter 40. He stated that
copies would be given to the Planning Commission,
after approval by the Council.

Clerk /Administrator Pauley reported the Council
had issued a cease and desist order at it's last
meeting, and Mr. Johnson has now applied for a
permit.
Mayor McCarty stated he was not certain of the criteria
to be used to handle a borderline situation, which he
felt this was. Councilmember Linke read from Chapter 48.06,
Sub. 4 (C), which stated that it gives the Council
leeway.
Attorney Meyers advised that if this is an exemption,
it would have to fall within a minor development,
single family residential. He added if the Council
grants this request, they will be beginning to esta-
blish criteria to be used in the future.
Councilmember Linke pointed out that the contour of
the lot will not be changed, just holes filled.
Motion /Second: Linke /Blanchard to adopt Resolution
No. 1642, adding at the end of the sixth paragraph,
"pursuant to Chapter 48.C6, Sub. 4(C), and waive
the reading.

pursue the condemnation proceedings for 7900
Edgewood Drive, authorizing Attorney Meyers to file
the necessary documents with the Clerk of Courts.

Councilmember Hankner asked the status of the home
at the corner of Hillview and Woodlawn. Clerk/
Administrator Pauley replied that it was in the
process, which does take time.
Attorney Meyers reported he had spoken to the
attorney for GTF, the bonding company, and they
are ready to go ahead with the completion of
the contract, after receiving Council approval.
Clerk /Administrator Pauley stated that Staff would
recommend that Gilbertson not be used.
Mayor McCarty recommended continuing in the same
direction and calling in the bond and getting the
job done. Attorney Meyers replied that he will
send a letter, telling them to get the job done.

Councilmember Doty questioned the status of the City's 15. Reports of
water supply. Clerk /Administrator Pauley replied Councilmembers
that all the equipment is being put back into opera-
ting order, and the City is able to keep up with the
present demand, and Staff is keeping a close watch
on the situation.
Councilmember Linke reported the Ramsey County League
of Local Governments will be meeting on August 17,
and the topic of the evening will be the Metropolitan
Waste Control Commission.
Councilmember Linke reported the Festivities Commission
had met August 3 and went over their reorganization,
which they are well into.
Councilmember Linke reported the Park and Rec Department
held a picnic on August 2 for the volunteer coaches,
and presented each coach with a jacket, in appreciation
for the work they did.
Councilmember Hankner reported she had spent an after-
noon with Fire Chief Fagerstrom and toured the Fire
Department facilities, and found it very interesting
and a learning experience.
Councilmember Blanchard reported she had not attended
the August 3 Planning Commission and had no report.
Mayor McCarty had no report.
Clerk /Administrator Pauley presented the Council 16. Report of

Mayor McCarty expressed concern that there may be
some senior citizens on the list, who are too proud
to come to the City for help. Clerk /Administrator
Pauley replied that Staff is familiar with all but
five of the people on the list, and many had signed
promisary notes and then not followed through. He
added the City has made every attempt to try and
collect the delinquent bills and to help people
make arrangements for payment.

to proceed with tax certification for unpaid water
and sewer bills.

Clerk /Administrator Pauley reported that he and Finance
'Director Brager will be meeting with the Finance Director
and City Manager of Blaine and the City Manager of
Spring Lake Park to discuss the Fire Department budget.
Clerk /Administrator Pauley reported he would be on vaca-
tion August 10 -12.
Clerk /Administrator Pauley updated the Council on a
meeting he had recently attended regarding the decrease
in revenues to the City from the State.
Councilmember Doty discussed portions of the airport
hearing officers report to the MAC and recommended the
Council send a comment back where they disagree.
Clerk /Administrator Pauley replied that a letter has
been sent to the new Met Council rep, inviting her
in for a meeting.
Mayor McCarty added that the City can only lodge
complaints and cannot force legal action.
Clerk /Administrator Pauley reminded the Council that
the liason positions are in effect.
