CONSENT AGENDA
April 23, 1984
The Consent Agenda is a technique designed to expedite handling
of routine and miscellaneous official busness of the City
Council. The entire Agenda may be adopted by the Council in one
motion. The motion for adoption is non debatable and must
receive unanimous approval. By request of any individual
Councilmember, any item can be removed from the Consent Agenda
and placed upon the Regular Agenda for debate.

Motion /Second: McCarty /Doty to approve the April 9,
1984 minutes as corrected.
Carol Sidenkrantz, Student Services Coordinator for the
Mounds View School District, asked the Council to
again sponsor the district in renewing the community
resources grant, as well as a mini grant, and a
juvenile.crime prevention grant. She explained that,
as with last year, there would be no cost to the City.
and they would merely serve as the sponsoring party.
Motion /Second: Blanchard /Linke to direct Staff to
cooperate with Ms. Sidenkrantz, Student Services
Coordinator, to obtain the three grants requested.

neressa Kluck, no address given, r3quested permission
to have the Lifemobile on display at the Festival in
the Park. She explained the Lifemobile is pro -life
and anti abortion. She presented the Council with a
petition in support of this.

ouncilmember Hankner explained the request had been
iscussed by the Council at their last agenda session,
and they had discussed it with the Chairman of the
Festivities Commission, and the bylaws do not allow
any political organization to set up a display at the
Festival, of which this would be one. She added that
it was the concensus of the Council to have the City
Attorney address the question and give an opinion.
Motion /Second: Doty /McCarty to approve the request.

Councilmembers Linke, Blanchard and Hankner voted against
the motion.
Considerable discussion occurred before the vote was taken
on the previous motion.
Councilmember Blanchard stated she understood from the
Council's discussion at the last agenda session, that the
item would appear on the May 7 agenda, by which time
Attorney Meyers would have prepared his opinion. She
added that it was quite late in the season to be making
a request of this nature, which would require the bylaws
to be changed, and perhaps the people interested could
'oliow the proper procedures to have their display at
the following years Festival.
Joan Sundwell, 6942 Pleasantview, stated she felt this
was a very emotional issue, and not a good idea for a
family type gathering, as the other side would request
equal time, and the Festival in the Park is not the
proper place for this.
Robert Beutell, 2555 Ridge Lane, stated that the Festival
in the Park is traditionally a family type of entertain-
ment, and the politically active people have restrained
themselves in not abusing this event.
Marcy Pajak, 8415 Fairchild, stated that while the bylaws
say no political activities, there have been some in the
past.
Councilmember Hankner explained the bylaws allow fund-
raising, but the political parties cannot solicite
information or try to get people in to discuss their
issues. She pointed out again that just last week the
Council agreed to wait for Attorney Meyers opinion before
taking any action. She also stated that, being the mother
of a teenage daughter, as well as younger children, she
ould not want her children exposed to a display of that
ature, without her being right there to explain to them
its relationship to their personal philosophies. She
also stated that she was not speaking out against the
Lifemobile itself, buL rather the disregard of the bylaws.

Councilmember Linke stated the idea of the Festival in
the Park was not to present issues of any kind, which is
why the bylaw was written, and it is a day for the
citizens to come out and enjoy the parks and themselves.
He added that any fundraising activities must go to the
Commission first, and he noted that anyone that does have
a booth at the Festival cannot identify themselves or hand
out literature or express their philosophy. He recommended
waiting for Attorney Meyers opinion before discussing the
issue further.
Motion /Second: Hankner Linke to call for the question.

Councilmember Doty and Mayor McCarty voted against the
motion, and it failed for lack of a 4/5 vote.
Mayor McCarty stated the Festival in the Park is meant
to be a family day, with the intent to stay away from
politics and passing out literature and so forth, but
it has become political, with people wearing political identifying buttons
and discussions that have gone on, and so forth, and
he stated he could not advocate turning around in mid-
stream and denying this request. He added that he
does believe parental guidance is required.
Ms. Kluck stated she would personally guarantee that
no minor would see the exhibit without having their
parent present.
Councilmember Linke pointed out that political discussions
that may occur go on between adults, not children. He
alr-o pointed out they have upheld the rule that no booths
of this type be allowed in the past, and to allow this
would tr_ily be turning around mid stream.
Councilmember Hankner stated children are not capable of
understanding the issue of abortion, and there was no
guarantee that children in the area would not see some-
thing, or overhear something, or pick up some discarded
literature.
Ms. Kluck stated that anyone who is old enough to make
babies is old enough to t iderstand the abortion issue.
She added that it is a social issue, at a social event.
Brian Mackimerri, 5086 Brighton Lane, stated he did not
feel it should be called a political issue.
Mr. Beutell pointed out that if the Festival is opened
ip to something like this, they would have to open it
ip to all politicai quesLiocis and opposing issues. He
stated he would not want his children exposed to some-
thing like this.

Mayor McCarty stated the Council had received a direct
equest from a resident, which they should act upon.
Councilmember Doty stated that while the Council has
taken the matter under advisement, and sent their
request on to Attorney Meyers, when a resident comes
before the Council, they should be heard.
Mayor McCarty stated that political activities have
not been curtailed in the past, and to continue the
present policy would bring this into a narrow corridor
of a select few.
Mayor McCarty closed the regular meeting and opened the
first public hearing at 8:08 PM.
Clerk /Administrator Pauley explained the process the
City was following under the home rule charter, and
reviewed the 1983 long term financial plan.
Mayor McCarty closed the public hearing at 8:10 PM.
Motion /Second: Doty /Blanchard to have the second read-
ing and adoption of Ordinance No. 357, adopting the
1983 long term financial plan, and waive the reading.

Mayor McCarty closed the regular meeting and opened
the second public hearing at 8:11 PM.
Attorney Meyers reviewed the criteria of why the public
hearing was being held, in accordance with Minnesota
State Statutues 462.365 and 462.357.
Julian Sprunck, 2649 Louisa Avenue, stated he was
against the rezoning of the Red Oak Estates area on
County Road H2, from R -1 to R -3, as he would be
immediately effected by any development of that land.
He explained that with any type of a major storm,
his back yard becomes a lake, and at any given time,
the water table in his back yard is from 3' and less.
He stated that if the natural drainage is disturbed,
he would have water in his home. He requested that
an environmental impact study be done on this

Mr. Sprunck added that the three properties immediately
adjacent to his all experience the same sponginess that
he does, following a rain storm.

Mayor McCarty explained there are several ordinances
n effect regarding surface water control, and the
actual rezoning would not change the run -off, only
development would, and proper controls would be taken
to assure there was not a problem.
Mr. Sprunck stated he was concerned that the controls
would not be sufficient. Mayor McCarty replied that
it is a matter of record the success the City has had
in controlling this.
Greg Klugberg, 2614 Louisa Avenue, stated the property
as it is presently zoned is not inconsistent with the
Comp Plan, but rather the 6 unit building in the area
is inconsistent, and to rezone the land would just
further the inconsistency. He stated he was opposed
to the rezoning, and feels the best use of the land
would be to have single family homes. He added that
since there is no specific request to develop the
property, it should not be rezoned. He also stated
that he had been told the notice published was
defective, and this property would not be discussed
tonight, so many of his neighbors who were against
it had not come to the hearing. He added he feels
the area should be by metes and bounds. He also
noted the existing draina6e is excessive already,
nd any R -3 development would make a bad situation
worse, and he can see no benefit to anyone in the
immediate neighborhood.
Dave Pitzel, 2617 Louisa Avenue, stated he was opposed
to the rezoning, with his concerns being the same as
Mr. Sprunck's. He added his back yard always has
water in it, with his water table being 6' to 2'.
Bob Beutell questioned the maximum density that would
be allowed for R -3 versus R -1.
Mayor McCarty replied 3 -6 units would be allowed per
lot.
Linda Jessen, 5278 Sunnyside Road, stated she directly
abutts the proposed rezoning and is opposed to it. She
added it is a primarily residential neighborhood, and
they have enough multiple dwellings already. She added
she had checked the zoning of the vacant property before
purchasing her home, and was told it was R -1.
Suzanne Snoke, 5272 Sunnyside Road, stated she was opposed
to the rezoning as it would change the neighborhood and
increase traffic.
aan Andres, 2736 Louisa Avenue, stated she was opposed to
the rezoning, and she also was told the parcel was not be
be discussed or changed to R -3, so many of her neighbors
did not come. She added she did not feel the controls would

tie stringent enough. She also stated she had moved into
he area to live in a single family neighborhood, and
wanted it to remain that way.
Jim Smith, 2650 Louisa Avenue, stated he was opposed to
the rezoning, and not enough residents had received the
notice.
Chris Risbrudt, 2625 Clearview, stated he was against the
rezoning as he had chosen the neighborhood because it was
single family, and the rezoning would change it.
Barb Watkins, 2609 Louisa Avenue, stated she was opposed
to the rezoning, for the reasons already stated.
Linda Peterson, 2645 Louisa, stated she was opposed to the
rezoning as they have a drainage problem already, and they
do not need an increase in traffic.
Steve Seeman, 2606 Clearview, stated he was opposed to
the rezoning and he did not feel the controls would guarantee
no further water problems.
Mayor McCarty explained that the City is near the end of its
surface water management plan, and this particular area
would be getting special attention for their drainage problem.
e added that all builders would be required to present their
plans to the City, and the ordinance is in effect to control
the issue.
Mildred Sprunck, 2649 Louisa Avenue, stated she was opposed
to the rezoning and feels powerless and questioned how it
could be stopped.
Dave McGinn, 2646 Clearview, stated he was opposed to the
rezoning, as he had chosen that neighborhood because it
was R -1, and he wants to continue to see R -1.
Terry O'Keefe, 2618 Clearview, stated he was opposed to
the rezoning for reasons already stated.
Dick Snoke, 5272 Sunnyside, statLU to was cpposed, as R -3
would be out of compliance with the Comp Plan.
Mayor McCarty explained transitional zoning would be used
as a buffer, going from the higher density to medium
density, to low.
Peg Mountin, Chairman of the Planning Commission, explained
that since the late 1960's, the City has had a plan to
encourage development, which is reviewed every five years
o see what is working and what needs to be changed. She
xplained the City is bringing non complying properties
conformance with the recommendations of the Comp Plan.
She stated that in this particular area, the Planning
Commission felt that with the high density of Scotland

green, there should be a lower density across the street,
o buffer it from the single family homes. She added
that the townhouse development went to court nine years
ago, to get approval. She also noted the Comp Plan
refers to preserving the wetlands, and the Planning
Commission's intention was to set the wetland aside
and discuss requests by metes and bounds. She stated
the Planning Commission is not recommending a wetland
be developed, and they do not want to compound the water
problem that is experienced throughout the City.
Chairman Mountin recommended this particular rezoning
be tabled and placed in the controversial category.
Mayor McCarty closed the public hearing at 8:52 PM.
Motion /Second: Doty /Blanchard to remove Red Oak
Estates No. 3, subj to esmt; common area interest in
Lot 73 and 74, Block 1, attributable to the following:
1 -521 and 59 -721, and Red Oak Estates, Lot 1, Block 1,
from the Notice A rezonings, and instruct Staff to
prepare an ordinance for consideration on May 14.

Clerk /Administrator Pauley advised that notices will
e mailed to within 350' of the property in question,
and also to anyone who s.,ned in on the sheet for the
rezoning, w;.th the hearing to be set at the May 14
meeting, for July 9. He added that if the Planning
Commission decides to have an informational meeting,
notices would be sent out for that also.
Mayor McCarty closed the regular meeting and opened 6C. Public Hearing:
the third public hearing at 8:59 PM. There were Notice D
no comments, so he closed the public hearing. Rezonings

Councilmember Doty questioned if the permit from the DNR
had been required. Clerk /Administrator Pauley replied
the development agreement has not been finalized, and it
will be contingent upon DNR approval.
Motion /Second: McCarty /Doty to continue tc the agenda
session on may 7 for further discussion.

Service Commission's recommendation to hire William
Ulvi as a patrolman for the City of Mounds View:

Councilmember Hankner voted against the motion. She
explained that she did not have any information or know
anything about the candidates qualifications.
Clerk /Administrator Pauley explained he was aware that
some members of the Council desired to have background
information on the candidates, and he passed that
along to the Civil Service Commission, but they chose
not to provide that information to the Council.
Director Thatcher reported the MSA plans and specs should 11.
be ready April 27, and they will be submitted to the
State and County early next week.
Attorney Meyers had no report.
'ouncilmernber Doty stated that it reviewing Ron
agerstrom's report regarding financing of remodeling,
does not want them to get tied up into a high
interest loan and asked if the three cities could
get together to get them a better rate.

-lerk /Administrator Pauley explained that because of
he type of work that would be done, and the amount of
money involved, the cities could not assist.
Councilmember Linke reported he will not be able to
attend the Ramsey County League meeting on April 25,
where they will be discussing hospitals. No other
Councilmember was available to attend, so it was
suggested -Clerk /Administrator Pauley contact Betty
Wall to see if she could attend.
Councilmember I-Iankner had no report.
Councilmember Blanchard stated she would like to
commend the Planning Commission for the work they
have done on the rezonings. She added they have a
recommendation on overnight parking that will be
sent on to the Council soon.
Councilmember Blanchard stated the Lions Easter
Party had been a huge success.
Mayor McCarty had no report.
Clerk /Administrator Pauley asked for Council approval 14. Report of

Motion /Second: Doty/Blanchard to adopt Resolution
No. 1731, commending Patt Fry for three years of ser-
vice to the City of Mounds View, and waive the reading.

tion to hire Patt Fry for a maximum of 32 hours at her
present salary, to train her replacement.

her replacement at the discretion of the ClerL dministrator.

Clerk /Administrator Pauley reported he had finished
interviewing applicant's for the administrative secretary
position, and asked Council authorization to hire
Michele Severson.
Motion /Second: Doty /Linke to approve the hiring of
Michele Severson as administrative secretary, at a
tarting rate of $7.20 /hr., with an increase to $7.40/hr.

founcilmember Linke noted that while the Council has a
u11 resume and background information on the applicant
for the administrative secretary, it has no information
at all on the applicants for police officer.
Councilmember Blanchard stated they have the Police
Civil Service Commission to make the recommendation to
them.
Mayor McCarty stated the statute gives them the authority
to hire the police officers.
Councilmember Linke stated it gives them the authority to
recommend candidates, not hire one.
Councilmember Hankner pointed out that nothing says
they cannot provide the information to the Council, and

Clerk /Administrator Pauley reported an arbitrator has
been chosen for the 320 contract.
Clerk /Administrator Pauley reported information was
provided in the Council packet on the TAC meeting last
week. He added he would be attending a transporation
dvisory meeting on Friday at the Crystal City Hall.
