CONSENT AGENDA

The Consent Agenda is a technique designed to expedite handling of
routine and miscellaneous official business of the City Council.
The entire Agenda may be adopted by the Council in one motion.
The motion for adoption is non debatable and must receive unanimous
approval. By request of any individual Councilmember, any item
can be removed from the Consent Agenda and placed upon the Regular
Agenda for debate.

The Mounds View City Council Executive Session Meeting 1. Call to Order
was called by Mayor McCarty at 6:00 p.m. on May 29,
1984.
MEMBERS PRESENT: Councilmembers Doty, Hankner,
Linke, Blanchard and Mayor McCarty.
ALSO PRESENT: Clerk- Administrator Pauley, City
Attorney Meyers, Consulting Attorney Grant Merritt.
Mr. Merritt updated the City Council on the background 4.
and present status of his involvement in the City's
Maw suit involving proposed improvements to the Anoka
County Blaine Airport. Mr. Merritt introduced Dr. Joe
Megel, Hydrologist, who reported to the City Council on
his initial findings as a result of a broadbrush review
of the proposed improvements at the airport site. Mr.
Merritt indicated that it was his desire that the City
retain Dr. Megel's services should the need for a
hydrologist expert testimony be necessary.
The Council reviewed Mr. Merritt's recent billings to
the City for his services, however, no action was taken
at the meeting regarding these billing statements.
The meeting adjourned at 7 :30 p.m. in order that the City 5. Adjournment
Council might commence their regular Council Meeting
scheduled for that time.

Blanchard asked for more information on Tycoon, Inc.
under Item M.
Clerk /Administrator Pauley explained that. Tycoon is
the company of Wil Harris who ran his boxing operation
out of Be1Rae last year. Based on past good exper-
ience, he recommended approval without hesitation.
He concluded that they are strictly private.
Director Thatcher stated that there was an addition
to Item M under General Contractors: Kraus Anderson
Construction Co. (renewal).
Motion /Second: Hankner /Linke to approve Item Y as
corrected.

Mayor McCarty closed the regular meeting and opened
the public hearing at 7:45 p.m.
There was no one present to address the rezoning, so
he closed the public hearing and reopened the regular
meeting at 7 :50 p.m.

Attorney Meyers asked if information had been received
from staff to justify this particular rezonina
under the comprehensive elan. Mayor McCarty replied
that the Planning Commission wants this rezoning to
take place and that their recommendation is contained
in a memo written by Staff to Council dated March 28,
1984, entitled Controversial Rezoning; this plus the
comprehensive plan justify approval.
Mayor McCarty asked Attorney Meyers if there would be
diminution of assessed valuation and diminution as a
result of revenues. Attorney Meyers replied that there
would be no automatic diminution of value and that it
generally has to be determined on a ease-by-case basis.

Attorney Meyers indicated that ,Council should be
aware that this parcel would be brought into conformance with the
comprehensive plan with this rezoning.
Director Thatcher recommended the hiring of a fulltime 15
temporary worker, Mr. Galen K! lash, for a duration of
66 days during the summer.
Motion /Second: Linke Hankner to approve the recommended
hiring of 66 days at $5.00 /hour.

Director Thatcher reviewed discussions with the state
on the signal light at County Road J and Trunk Highway
10. He stated that after the state had proposed a
second modification to the intersection and he told
them they would have to pay, they decided to stay with
the first modification. He noted that it will all be
covered by ?SA funds.

rayor YcCarty stated that it had been discovered that
there was a defect in the notice procedures for the
next two public hearings on the agenda and therefore
the Council would not be able to hold the hearings as
planned. He further stated that, because of the contro-
versial issues surrounding these two rezoninjs, it was
suggested that further meetings with the Planning Commission.

be held and that they deal mostly with affected
property owners.
Motion /Second: McCarty /Hankner to table the next two
hearings for the rezoning of 2901 and 2841 Highway 10
for an indefinite period of time and authorize the
Planning Commission to coordinate hearings with the consulting
City Planner and with the affected property owners
as soon as possible.

Mayor McCarty indicated that he was contacted by a
resident who has a tree on the easement and wants to
find out why the cable company is trimming off tree
tops when they are running the cable 3' below those
tops.
Clerk /Administrator Pauley replied that he would take
the name and address of the resident and refer the
complaint to Group W and the City's Cable Commission
who, in the past, have shown to be respondent and
prompt in handling previous complaints.
Mayor !cCarty asked that the "CCL, who approached the
City earlier on requested space for a lifemobile at
vestibule parking for the festival in the parks, be
contacted on what the criteria will be this
Attorney Meyers' opinion was that the Festivities
Commission should develop criteria for use of public
property that would apply to any activity from any
group.
Motion: McCarty to direct that the Council request the
Festivities Commission to set forth the standards and
guidelines for festivities at the festival in the parks.
Councilmember 7 31anchard stated that the Commission
bylaws set down criteria and that they have been
abiding by this.
Councilmember Hanner added that, after they have
finished planning all activities, they Man on up-
dating standards and guidelines, so it will be done.

Robert Buetel, Chairman of the Energy Commission,
commented that he had a report to give. He stated
that the Commission met on May 19, 1984. They set
a number of goals and established programs and
activities. He stated that items will be brought
to the Council at a later date for specific action
and that he would be reporting regularly.
Mayor McCarty closed the regular meeting and opened
the next public hearing at 8:47 p.m.
Robert Balch, representing the developer, briefly
explained the environmental changes relating to the
request and turned it over to the engineer repre-
senting the owners.
The engineer from Short Elliott Hendrickson
reviewed existing and proposed zoning. He explained
that the proposed development would generate less
traffic over commercial and light industrial mixes
and anticipated a lesser strain on the water and
sewer system. He indicated that they are proposing
a 2 -phase development: (1) dedication of right -of-
way for connecting street, and; (2) construction of
Raymond, median cut, and any other utilities that
may have to be built along the way. He then reviewed
the berming plans that were presented as a third phase.
Mayor McCarty asked what effect the bermino would
have for adjacent property owners.
The engineer explained that they would view basically
evergreens offset with shrubs. He added that the
berminq was planned so that a person 6' tall standing
on a first floor would not be able to see the roof
of a 16' warehouse. He pointed out that other
factors that might lessen the impact is the sound-
proofing as a result of the slope, the setback
requirement for each building, the location of the
truck doors on the south side of the buildings, the
types of buildings (office warehouse, wholesalers,
etc.) and the fact that the City has its own code
for landscaping around buildings.

to Raymond at the culdesac. The engineer replied
that there would be no access except for emerency
vehicles and that the perming was planned in accord-
ance. He added that access from HiFhway 10 ;could
regain and would be somewhat restricted.

Jeanette Kilduff, 2213 Co. Rd. H -2, asked about a
petition she heard was submitted opposing the re-
zoning. Clerk /Administrator Pauley confirmed that
there was one filed by 14 property owners and signed
by residents and dependents.
Peg Mountin, Chairman of the Planning Commission,
reviewed Planning Commission discussions regarding
the rezoning. She indicated that concerns in the
past revolved around the through street and apart-
ment type dwellings that were originally proposed
under the high residential use and that other con-
cerns include the noise level, light intensity and
heavy industrial use. She stated that the Planning
Commission felt that berminc• was an excellent barrier
and constituted an adequate buffer. She pointed out
that residents are protected from high intensity
lighting under the zoning crdinance and felt that
heavy industrial would not be able to meet standards
imposed for conditional use permits. Her opinion
was that the I -1 was a good alternative and that
the birming was sufficient to protect abutting
properties.
Mayor McCarty asked if anyone was present who signed
the petition so that they could substantiate sore
specific concerns that the Council could address.
Jeanette Kilduff, 2213 Co. Rd. H -2, stated that
there was a previous concern that residents would
be billed for storm sewer. Mayor McCarty replied
that residents will not be assessed for storm sewers
installed within the development of Pinecrest properties.

Director Thatcher stated that the addition is
located between Groveland and Fairchild and showed
the areas that would be subdivided. He explained
that there will be an easement between LaPort and
Haden and a 10' easement for a walkway.
Jim Bremer, 2765 LaPort Dr., stated that he wanted
to change his fencing and asked if his fence could
be moved to within 10' of the center of Fairchild
if the subdivision is approved.
Clerk /Administrator Pauley replied that the final plat
approval would include vacation of the right -of -way
and that Mr. Bremer would be able to put his fence
right on the property line of the 10' easement.
Mr. Bremer asked if the City would be fencing the
walkway.
Clerk /Administrator Pauley replied that Staff is
currently looking at developing a policy with

and Setting a Public Hearing for the Necessary Improve-
ment, and waive the reading.

Clerk Administrator Pauley reported that one of the 24.
City's two Toro Groundsmasters threw a rod and the
engine was totaled so Staff was required to replace
the engine. As a result, he suggested rebudgeting
of a new machine to 1985.
Mayor McCarty indicated that he was concerned about
the difference in cost in delaying purchase of a new
machine to next year. He asked Clerk Administrator
Pauley to look into contingency or ether funds to
get whatever is needed for a new machine.
Clerk /Administrator Pauley reported that after dis-
cussions last week of contract negotiations, he made
an offer to the Police Union but was advised that
the offer was rejected. He stated that he is tenta-
tively scheduled to meet with them again this week and
has taken the position that he is willing to discuss
any other options they present so long as the total
package does not increase.
