Report of Administrator CONSENT AGENDA JULY 8, 1985 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Renewal PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order by Mayor Linke at 7:30 PM on July 8, 1985. The Pledge of Allegiance was said. MEMBERS PRESENT: Councilmembers Hankner, Quick, Blanchard, Haake and Mayor Linke. ALSO PRESENT: City Attorney Meyers, Clerk /Admini- strator Pauley and Public Works /Community Develop- ment Director Thatcher. Motion /Second: 1985 minutes as 5 ayes Haake /Quick to approve the June 24, corrected. 0 nays Duane McCarty, 8060 Long Lake Road, presented news articles to the Council, and stated he felt the traffic at the Anoka County airport was increasing and that the new Councilmembers should give their opinions and where they stand formally. He added that he feels the lawsuit should be pushed forward at this time, within the next few months. Mayor Linke replied that one of the prime issues in the lawsuit is the noise problem, and the City has a commitment from Al Perez to get the noise monitoring done. He explained that it has been a difficult problem to get the monitoring done by Mr. Perez and the Council recently called him in and made it very clear the work had to be done immediately, and Mr. Perez has agreed to it, and has estimated it will take three months to gather the data and analyze it and report on it. Mr. McCarty stated he agrees the noise study is important but they need to proceed now to attack the Master Plan and cannot delay any longer. Residents Requests and Comments from the Floor Mounds View City Council July 8, 1985 Regular Meeting Page Two Councilmember Hankner stated the Council has been working very deligently to compile all the informa- tion requested by the attornies to present the case, and all bases must be covered, so the noise data is needed. She added they have been pushing Mr..Perez to get the monitoring done. Attorney Meyers reported he had received the scoping review from MAC's consultant, and that Mr. Merritt feels it advocates segmentation. He is notifying MAC that the City is still opposing the way the EIS is being proposed. He added the noise issue is very important and the results should be back from Mr. Perez within the next few months. He asked that people register their complaints with Mr. Perez or City Hall, if they have not done so already. He added that once Mr. Perez had presented an analysis to the City, the lawsuit will be able to proceed. Bill Doty, 3049 Bronson Drive, stated the problem of low flying aircraft over the City should be looked into, and they should monitor altitudes and add it to the lawsuit. Mayor Linke explained the difficulties in obtaining accurate readings. Sandy McCarty, 8280 Greenwood Drive, stated she felt traffic has increased immensely over the past three months, and she has pictures of low flying aircraft, as well as a log of the calls she has placed to the Noise Abatement Council, which she will make available to the City. In response to questioning, Attorney Meyers stated that the report from Mr. Perez will be released at a later date, after it is evaluated, and once they have proceeded with the lawsuit, as it would be harmful to the City's case to publicize how they plan to approach the lawsuit. Julie Young, 8116 Eastwood, asked if all locations had been selected for the monitoring and offered her yard. Mayor Linke replied the City has supplied Mr. Perez with the information and he will make the selection on the locations. Mr. McCarty stated the contract was entered into in the Fall of 1984, with an expected completion in December 1984, and the report came in in the Spring of 1985. Mayor Linke pointed out that the report supplies Mounds View City Council July 8, 1985 Page Three Regular Meeting by Mr. Perez did not include the noise study, which was part of the original request, and was noted in the minutes. Mr. McCarty also asked the Council to removed revised Ordinance No. 391 from the table and deny it at this time. Mayor Linke replied it is scheduled for the next agenda session for further discussion. Mayor Linke closed the regular meeting and opened the public hearing for the M. H. Anderson property at Silver Lake Road and County Road H2 at 8:12 PM. Director Thatcher explained that M. H. Anderson is proposing to amend their existing PUD on the subject property, and he reviewed their request to rezone the property from R -2 to R -1, and subdivide the lots from 8 R -2 to 11 R -1. Jessie Barnes, 7350 Silver Lake Road, stated he was in favor of single family homes rather than double dwellings. He also asked if the dirt along the edges of Silver Lake Road and County Road H2 would be moved or who would maintain it. Director Thatcher replied that the dirt berm will be left as a noise barrier, and it will be the respon- sibility of the home owners to car for it. He added that M. H. Anderson will be cutting it later this week. Dan Grr,we, no address given, stated he had recently bought a home in the Anderson development and had not been told that duplexes were proposed for that area, and he was definitely against allowing duplexes, and was concerned about his property value. He also asked what price homes would be put there if it is approved for single homes. Director Thatcher replied they will be in the $115,000 to $130,000 price range. Alan Wetherhold, 2751 Hodges Lane, stated he also wants to see single family homes. Carol Holmgren, 7417 Parkview Drive, stated she also wants to see single family homes. Mayor Linke closed the public hearing and reopened the regular meeting at 8:17 PM. 6. Public Hearing: M. H. Anderson Property at Silver Lake Road and County Rd H2 Mounds View City Council Regular Meeting Mayor Linke closed the regular meeting and opened the next public hearing at 8:17 PM. There were no comments from anyone present, so he closed the public hearing and reopened the regular meeting at 8:17 PM. Director Thatcher reviewed the request of Kraus Anderson for a major subdivision of the property at Highway 10 and County Road I. He stated he has two proposals on his desk now, from Super America and Bonanza Steak House, to develop if the property is subdivided. Marcella Ragger, 8584 Mounds View Drive, stated she had just spoken to many people in her neighborhood who were against the projects and had not received notice of the hearing. She stated she was against the subdivision and rezoning as it would increase traffic in front of her home and decrease her property value. Joel Mesanze, 2626 Lake Court Drive, stated he was told the area would be developed with office buildings and a medical clinic when he purchased his property which he didn't mind, but he is opposed to having Super America there. Verna Melius, 2582 Mounds View Drive, stated she was opposed to the rezoning and subdivision and she did not see a notice published in the paper. Clerk /Administrator Pauley presented the notice of legal publication, showing that it was officially printed in the paper. Kathy Tacte, 7430 Park View Terrace, stated she has lived there three months and just now received her information packet and learned that the New Brighton Bulletin was the official. newspaper. Mr. Mesanze stated that if Super America has their exits on County Road I instead of Highway 10, all the traffic will go down through *he residential section. Jan Mesanze, 2626 Lake Court Drive, stated too much traffic would go into the residential area if Super America is approved, and she is against the proposal. Mike Holt, representing Super America, made a presentation of the proposed plan. He stated they would be servicing the area and would not be bringing people from other areas in. He also presented site lines, showing what would be visible of the operation from the second story balcony of the homes in the area. Councilmember Haake pointed out that Mounds View Drive is a ring road concept and was planned so that businesses on Highway 10 could have access to their buildings. She questioned the need for an entrance /exit on Mounds View Drive. Mayor Linke suggested tabling the discussion to allow the residents to get together and allow Staff time to get the names of the new residents to notify them. Bob Hartmann, representing Super America, stated that they are more than willing to listen to the concerns of the residents and they try to be a good neighbor. Motion /Second: Linke /Hankner to table the remainder 'o -this public hearing for the meeting of Monday, July 22 and have Staff notify as many of the new residents as possible, and notify Kraus Anderson also. 5 ayes 0 nays Mayor Linke closed the public hearing and reopened the regular meeting at 8:57 PM. Approval of Consent Agenda Mounds View City Council Regular Meeting Motion /Second: Haake /Blanchard to approve the consent agenda, as amended, and waive the reading of the resolutions. 5 ayes 0 nays Motion /Second: Linke /Hankner to approve the payment of $4,000 to Northern Sound for work performed and pursuant to proposal dated July 1, 1985. 5 ayes 0 nays Clerk /Administrator Pauley reviewed proposed Resolution No. 1907 establishing policies and procedures for Chapter 400. Motion /Second: Hankner /Haake to approve Reso- lution No. 1907 establishing policies and pro- cedures for the implemen`ation of Chapter 400 of the Municipal Code entitled "Administrative Offenses" and waive the reading. 5 ayes 0 nays Motion /Second: Quick /Haake to have the second reading and adoption of Ordinance No. 395, an ordinance amending the Municipal Code of Mounds View by amending Chapter 2 entitled "Council" and waive the reading. He recommended approval of the preliminary plat of the proposed subdivision of the PUD for M. H. Anderson. Motion /Second: Haake /Quick to approve the pre- liminary plat of M. H. Anderson for a major subdivision of property located at approximately Silver Lake Road and County Road H2, with Exhibit A, dated July 8, 1985, for Silver Lake Woods lots 1 -3, Block 4. 5 ayes 0 nays July 8, 1985 Page Six Motion Carried 11. Report of Public Works Community Dvlpt Director Motion Carried Mounds View City Council July 8, 1985 Regular Meeting Page Seven Director Thatcher recommended approval of the rezoning o. the property from R -2 to R -1. Clerk /Administrator Pauley pointed out that a rezoning must be done by ordinance, and Staff will prepare the necessary paperwork for the next meeting. Attorney Meyers advised the Council to take all the concerns voiced earlier about the S..kper America proposal into consideration, including the residents reliance on the B -2 zoning, the traffic generation, and noise. Attorney Meyers reported the Appelette Court approved the filing of an amecus brief by the League of Cities in the Greg Johnson case. He also reported he had received a call from the respondent attorney, asking what was going to be rezoned in that area. Councilmember Hankner reminded everyone of the 16, Reports of Festival in the Park on July 14. Councilmembers Councilmember Quick had no report. Councilmember Blanchard reported she had received complaints from neighbors about the Highway 10 Radiator Repair Shop, including that the fence has not been put up, excessive noise late at night, and dead trees on the lot. Clerk /Administrator Pauley replied he will have the forester inspect the trees. Councilmember Haake reported she had attended the Festivities Commission meeting and she feels the afternoon should be an enjoyable one. Mayor Linke read a letter he had received from Senator Dave Durenburger in response to the City's interest in having a post office built in the City. Mayor Lire reviewed a letter received regarding the Community Block Grant Meeting, scheduled for July 10 at 7 PM at the Roseville City Hall. Mayor Linke reviewed a request he had received from the North Suburban Crime Fund, asking for his signature on a letter which will be sent to businesses, asking for their support of the program. He explained no money was involved on the part of the City, and with Council approval, he would be signing it. 15. Clerk /Administrator Pauley reviewed a letter he had received from the Government Training Service regarding three workshops they will be holding for elected officials. He stated he would put copies in the Councilmember's boxes.
