CONSENT AGENDA FEBRUARY 24, 1986 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is 'non- debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. The Pledge of Allegiance was said. 3 ayes 0 nays PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA MEMBERS PRESENT: Councilmembers Quick, Haake, Hankner, Blanchard and Mayor Linke. ALSO PRESENT: Clerk /Administrator Pauley and Public Works /Community Development Director Thatcher. Motion /Second: Blanchard /Quick to approve the February 10, 1986 minutes as presented. Frank Blaziak, 5479 Adams Street, asked the Council's help in controlling the parking problem in his neighborhood. He stated they have had problems with the apartment residents and their guests parking along the street and in front of the homes in the area, and the past weekend someone had parked their vehicle in his driveway while visiting at the apartment building. He stated he had called the police and they called a tow truck but-the owner did return for his vehicle before it was towed. He added in his case it could present very serious problems as they have a chronically ill child who has had to be rushed to the hospital and his car that night was blocked in the garage by this vehicle. Mayor Linke stated he had received Mr. Blaziak's letter and had discussed it with the Clerk /Administrator, Public Works /Community Development Director and Police Chief, and there are no parking signs posted, nd they have met in the past with the apartment owners, -:ho are not willing to make any improvements to their parking area, as it would involve a cost to them. Residents Requests and Comments from the Floor Mounds View City Council Regular Meeting `lerk /Administrator Pauley added that the City had dvised the owners that they would allow them to build a parking area on the boulevard, but the o wners do not want to spend the money. He added? they: cannot prevent someone from parking in someone else's driveway, and recommended the police be called, who could then call a tow truck and ticket the offender. Mayor Linke stated Director Thatcher would be writing a letter to the apartment owners, advising them of the problem. Councilmember Hankner asked Mr. Blaziak's permission to include a copy of his letter, with his name and address removed. Mr. Blaziak consented. Mayor Linke closed the regular meeting and opened the public hearing on the Spring Lake Park Knolls Addition. Director Thatcher explained that Leonard Kremer is proposing to subdivide two lots into six zero lot line lots. 'r. Kremer reviewed the proposed development, tating the hardship involved would be an economic one, as they have had this property for several years and the taxes continue to increase more than they can raise the rents. Director Thatcher stated the Planning Commission has reviewed this and granted a variance on the northeast lot, since the County took a large amount of land from that piece of property to widen County Road 2. He added a few minor details are still required from Mr. Kremer before final approval could be granted. Mr. Kremer reviewed the plans they have for ponding the site. Director Thatcher stated the existing storm water retention pond does have meet existing City codes as it does not provide a positive outlet, and the new pond would be built to code. Bruce Wolfe, 7685 Groveland Road, stated his property abutts this proposed development and they have had problems with ponding in the past and they have often had standing water 3' deep on the property. He stated he land is too low to allow for any further development. February 24, Page Two 6. Public Hearing: Spring Lake Park Knolls Addition Mounds View City Council Regular Meeting r. Wolfe presented a petition with 22 signatures on it f residents who are against adding the proposed additional double bungelow due to the water problems. He added they have also experienced parking problems in the area from the double bungelows. Director Thatcher explained that if the existing hold- ing pond is redesigned, it should eliminate the water problem they presently have. Mr. Kremer reviewed how the drainage system would be constructed and where the water would flow and would pond. Jeanette Spiczka, 7644 Groveland Road, asked what a zero lot line was and whether the City has any others. Mayor Linke explained what a zero lot line is. Director Thatcher named some other locations in the City that have a zero lot line. Mrs. Spiczka asked if the Planning Commission was required to notify the residents of the area that they were discussing the request. Director Thatcher replied the Planning Commission was of required to do so, but the Council is and they have done so. Craig Zuidema, 2809 County Road I, stated he feels there is such a problem already that they could not build another structure there and not add to the problem. Mayor Linke stated that the plans show the developer would slope the drain -off down and it should not effect any of the residents. Mrs. Spiczka stated the City was concerned about a water problem there 10 years ago when they built their home. Mrs. Wolfe stated there is already enough of a problem there, and another duplex would only add to it. She stated she was also concerned with placing another structure there, as it would crowd the neighborhood. Director Thatcher explained that the development agreement would assure that the developer would not create a problem. He added that it is to the L eveloper's benefit to do it right the first time. Mr. Kremer responded that the City did not have zero lot lines at that time, but they were built to meet those requirements, with individual services and so forth. Councilmember Quick asked if the proposed changes would enhance the drainage on the lots. Director Thatcher replied it would as it would provide a larger detention pond. Councilmember Hankner stated she was concerned with the parking issue and felt the Council should look into it urther NIr. Wolfe presented a letter from one of the property owners, who could not be present. Clerk /Administrator Pauley read the letter, from Terry Martinson, 7653 Groveland Road, who stated he was against the development. Mrs. Neagbour, 7660 Groveland Road, stated there is a problem already with cars parking along the road, and her family had built in Mounds View 19 years ago because they liked the large lots and openess, and they do not want to see it go any smaller. Mayor Linke stated he was not concerned with the pro- posed drainage plan but he did have a problem with using economics as justification for allowing this. He also pointed out that parking is a problem. Councilmember Hankner suggested continuing the discussion to the next agenda session, where they could look at some solutions to the problems that have been brought up. Mr. Zuidema stated he feels putting in a duplex there encroaches on the R -1 area. "r. Wolfe stated he feels the Council was more than it in allowing the Kremer's to put up the first two tplexes. He added there has been a controversy all along and he does not feel any more concessions should be given. February 24, 1986 Page Four Mounds View City Council Regular Meeting r. Kremer stated he does not feel the City gave them f, py concessions, and they are not asking based on an 'economic hardship alone, but becaus it' makes sense. He added it is a proven fact that multiple family dwellings get fewer services than single family He also stated he would'be willing to work with the City on the parking problem. Mayor Linke closed the public hearing and reopened the regular meeting at 8:05 PM. He added they will continue the discussion at the next agenda session, on March 3. Councilmember Hankner asked Clerk /Administrator Pauley to provide the Council with the information from the parking study that was done approximately a year ago, at the agenda session. Motion /Second: Quick /Hankner to approve the consent agenda, as presented, and waive the reading of the resolutions. 5 ayes 0 nays f7ounci1member Hankner asked Clerk /Administrator auley for information regarding the salary "increases for non -union employees, including a copy of the previous information from the Stanton survey. Clerk /Administrator Pauley replied he would do a comparative analysis for 1985. Clerk /Administrator Pauley reviewed the purpose of proposed Ordinance No. 405. Motion /Second: Hankner /Quick to have the second reading and adoption of Ordinance No. 405, an ordinance renewing Ordinance No. 390, prohibiting development of certain properties on an interim basis, and waive the reading. No. 405 Carried Mounds View City Council Regular Meeting irector Thatcher reviewed proposed Ordinance No. 403. 9. 1st Reading of Ordinance "Motion /Second: Hankner /Blanchard to have the first No. 403 reading of Ordinance No.: the municipal c ode of Mounds View_by amending Chapter 40 entitled "Zoning and waive the reading. 5 ayes 0 nays Director Thatcher reviewed proposed Ordinance No. 406. 10. 1st Reading He recommended a public hearing be held, either before Ordinance No. after the first reading. 406 Councilmember Blanchard stated she would like to table the first reading until after the public hearing, as long as there is no great rush for this rezoning. Motion /Second: Blanchard /Quick to table the first reading of Ordinance No. 406 until after the public hearing, and set the public hearing for March 24, 1986 at 7:05 PM. 5 ayes 0 nays irector Thatcher updated the Council on the status 11. He stated he felt the meeting was successful and they were all brought up to date on the new county park at Long Lake. He added their main concern seemed to be funding of the maintenance. ouncilmember Haake reported she had attended the Festivities Commission meeting earlier in the evening, and Tony Jambor is proposing a citizens dance, which the City would be involved in. Councilmember Hankner asked how much revenue was generated from the 26 illegal parking notices that were issued in January. Clerk Administrator Pauley replied the revenue is $10 per ticket, with the collection rate being approximately 67 Councilmember Blanchard reported she had attended the Planning Commission agenda session last week and that the Commission was dealing with many interesting and contro- versial issues which would be forwarded to the City Council when discussions were completed. Mayor Linke reported he would be meeting with the mayors of Shoreview and New Brighton later in the evening to discuss how the cities can become more involved and assist the school district in long range planning. Clerk Administrator Pauley reported the Council had authorized staff to prepare a request for proposal for insurance for next year, and he asked if the Council would like to review the RFP's before they go out. He added that once they are received, he will be reviewing them with Councilmember Haake and Finance Director Brager, before they make a recommendation to the Council. I want to Clearly Express my Disapproval of Any additional units, or dwellings of any size or kind in this area for the followings reasons: 1. I have a Water Shed Area or Wet Land Area behind my residence now which cause water to enter the rear of my property due to the drainage now existing. 2. The two existing two (2) unit dwellings on the southwest corner of Silver Lake Road and County Road I took away some of the natural holding pond area when they were built due to its existing low area. 3. With the above being true, any additional dwellings of any kind will again cause futher flooding to the rear of my property and that of my neighbors. 4. I also question the legal right of the owner of the 2 unit dwellings on the cornerin providing the very poor fence around the holding pond that always exists. 5. Any further dwelling construction in the mentioned area will take away more of this holding pond area and cause drianage across the neighbors property causing additional problems will certainly be addressed to the commission. 6. The Mounds View Area is highly regarded for housing that has larger lots, mature trees and a comfort life style. The idea of splitting lets or acreage into small parcels will only cause the city to take on the trash look of cramped housing which I moved to Mounds View to get away from. Mpls, Mn. 55432 Mark Schultz 7692 Groveland Road Mounds View Mounds View City Council, As I am unable to attend the meeting requarding the rezoning of the duplexes on the corner of County Road I and Silver Lake Road I would like to express my objections in this letter. I) The addition of a rental unit usually brings with it large numbers of cars as evidenced by the two present duplexes. In this case most probably cars will get parked on County Road I. This road is heavily traveled and these cars would present a hazard to motorists and to, pedestrians trying to walk to the park. As there is no sidewalk, pedestrians would have to walk far out in the road to get around the cars. 2)The area is essentially made up of single family dwellings on large lots. It appears that the land was zoned for two duplexes because that is what best fit on that land. The squeezing of another duplex on that land would diminish the appearance of the area. 3)The lot has an unsighlty water drainage problem which was not handled adequately at the time of construction. No assurance can be made that these problems will not continue. Why should the neighborhood residents risk these problems when the only gain is the improved finanical condition of an absentee landlord? Sincerely, Mark Schultz 4
