CONSENT AGENDA

The Consent Agenda is a technique designed to expedite
handling of routine and miscellaneous official business of
the City Council. The entire agenda may be adopted by the
Council in one motion. The mot ion for adoption is non
debatable and must receive unanimous approval. By request
of any individual Councilmember, an item can be removed from
the Consent Agenda and placed upon the Regular Agenda for
deoate.

The Mounds View City Council was called to order by
Mayor Linke at 7:06 PM on Monday, July 28, 1986.
MEMBERS PRESENT: Councilmembers Haake, Hankner,
Blanchard, Quick and Mayor Linke.
ALSO PRESENT: City Attorney Meyers, Clerk /Administrator
Pauley and Public Works /Community Development Director
Thatcher.
Motion /Second: Haake /Hankner to approve the July 14,
986 minutes as corrected.

Bill Frits, treasurer of the Mounds View Lions Club,
presented the City with a $500 check, to be donated
to the Spano /Balk Benefit Fund.
Attorney Meyers reviewed the latest developments that
have occured relative to the explosion of the Williams
Pipeline in Mounds View on July 8. He stated they
have received a report from the U.S. Department of
Transportation, relative to 1984 pipeline breaks, and
he reviewed the types of breaks that were involved.
He stated they have been told that hydrostatic testing
could further weaken the existing line, and that is the
only testing the U.S. DOT is requesting of Williams
Pipeline Co. Attorney Meyers stated the City sent a copy
of the resolution the Council passed on July 14, 1986 to
the U.S. DOT, and they have not responded in any form.
He further stated that, along with a determination that
the pipeline is installed in the county right -of -way, under
a 1957 resolution, the County Board is investiaating the
of that agreement and will be making a complete
:cnvestigation into the pipeline. A request has also been

-V ,ttorney Meyers explained that in the resolution of
ily 14, visual inspection was required of the pipe
ine before any hydrostatic testing was done, and
based on conditions, the City is now changing their
plan, and he asked the Council to rescind the resolu-
tion of July 14th, as it no longer reflects the City's
position, and has not been responded to by .the U. S.
DOT. He stated the City is now ready to demand that
the pipeline in Mounds View be completely removed
from the City. He added he feels the City has a good
case, and the City is asking the Ramsey County
Commissioners for their assistance to do whatever is
necessary.

Motion /Second: Linke /Quick to rescind Resolution
No. 2028 by repeal, and direct Staff to prepare a new
resolution for consideration at the next Council
meeting, stating the City's new position, and requiring
removal of the pipeline.

Clerk /Administrator Pauley asked that Item EE be
added, Resolution No. 2057, a resolution of
commendation and appreciation to New Brighton
Police Officer Robert Jacobson.
Motion /Second: Quick /Hankner to approve the
consent agenda, as presented, and waive the reading
of the resolutions.

Director Thatcher reviewed the activities of the
sewer and water department for the past quarter.
He also reported that building permit applications
have increased year to date over 1985, and presented
an overhead projection, showing the breakdown by
month. He also reported that the department secretary
was out ill, so he was not able present the data on
the fire inspections. He stated he will have a
report for the Council at their next meeting.
Mice Chief Ramacher reported all is well in the
`•olice Department, and the new white squad car is
in operation.

finance Director Brager presented the Council with the
second quarter financial print -outs and reviewed them
briefly. He reported they are in the process of getting
the computer in and running, and training will begin
soon. He also reported they are in the process of
working on the budget, and are in the second round now.
Park Director Anderson reviewed the activities of the
Park and Rec department for the past guarter, which he
stated was their busiest. He reported the Forester
is working on the problems resulting from the Williams
Pipeline explosion for the first hour of each day.
He also reported a survey was done through the last
newsletter on the park department, and he will be
compiling the results to present to the Council.
Park Director Anderson reviewed the activities of
the Park Board and discussed the encroachments at
Silver View Park by the neighborhood residents. He
explained the Park Board has adopted a resolution
which they feel should handle the matter. He reported
they have also discussed a memorial to be placed at
Random Park, and will be discussing it further.
Park Director Anderson stated that Staff would recommend
aproval of the Park and Rec Commission's recommendation
n the purchase of playground equipment for Greenfield
Park, and he reviewed their recommendation and the type
of equipment that would be purchased.
Motion /Second: Quick /Hankner to purchase playground
equipment from Game Time, from Minnesota Playground,
at a cost of $14,992, to be funded from the contingency
fund.

Mayor Linke stated he would like to have the equipment
installed during the evening, to give the residents an
opportunity to help with it.
Councilmember Haake questioned whether the insurance
would cover any future problems, if it was not installed
by authorized staff.
Attorney Meyers replied the insurance would be in full
effect. Park Director Anderson stated that Staff would
go back and double check all work done, to make sure
everything was correct. He also pointed out that by
)ing it in the evening would necessitate paying overtime
the Maintenance Department, and questioned whether the
ost factor would be a problem.

5uncilmember Quick asked that Mayor Linke report at the
.ext agenda session how much interest there is on the
part of the residents to participate.
Director Thatcher asked if a representative of the
company could be present during installation, to
assist.
'Park Director Anderson replied that the salesman could
be available, but would be of limited assistance, as
they only sell the .product. He added the maintenance
crew has put together one of these before, and it should
go easier the second time.
Motion /Second: Hankner /Blanchard to have the second
reading and adoption of Ordinance No. 410, amending
Chapter 59.03, entitled "Building Permits and Fees
and waive the reading.
Director Thatcher asked approval of the pay request
from Midwest Asphalt Co. for the reconstruction of
County Road H2, in the amount of $113,175.36, for the
work done to date.
Motion /Second: Quick /Hankner to approve the payment
to Midwest Asphalt Co. in the amount of $113,175.36,

Director Thatcher reported he had received a letter
from Leggette, Brashears Graham, Inc., the
consulting firm for Williams Pipeline Company regard-
ing the groundwater testing and removal of contaminated
soil in the area. He stated they would like an
emergency permit to excavate the soil and connect the
sanitary sewer.
Motion /Second: Hankner /Quick to grant an emergency
permit according to the July 21st memo, subject
D the Ramsey County Board granting approval, and
illiams Pipeline Co. paying all appropriate fees.

Councilmember Haake expressed her thanks to everyone
who helped with the Festival in the Park.
Councilmember Hankner reported she had attended the
production of "Music Man and found it very enjoyable.
She also reported the Council /Staff picnic had been
held, and she would have a report on expenses soon.
Duncilmember Hankner reported she had been appointed
o the Governor's commission on pipeline safety, and
would be attending the first meeting this week.
Councilmember Blanchard thanked Councilmembers Hankner
and Quick for their efforts on the Council /Staff
picnic.
Councilmember Blanchard requested permission to use
the Council chambers for the Fair Share program, and
she explained how the program works, and stated she
feels it is a very good program. She explained she
would need the chambers for a few hours a month.
It was the concensus of the Council that it was alright
to use the Council chambers for Fair Share.
Councilmember Quick had no report.
Mayor Linke reported he had also attended a performance
of the "Music Man" and found it to be very enjoyable.

Regular Meeting
Clerk /Administrator Pauley reported the Council has
len invited to a public hearing on pipeline safety, to
held in Faribault on August 13, at 7 PM. He asked
t he Council to notify him if they plan to attend, as
he must confirm the number who will be going.
Clerk /Administrator Pauley reported the Clerks for
Blaine, Spring Lake Park and Mounds View have been
negotiating a ten year capital improvement budget
for the Fire Department. They have requested the
Fire Department arrange a tour, which has been set
for Wednesday, August 6 at 5:30 PM He asked the
Council to let him know who would be attending.
Clerk /Administrator Pauley reminded the Council the
second meeting on the Ardan drainage district would
be held on July 30 at 7 PM at Abiding Saviour Church.
Clerk /Administrator Pauley requested authorization
to extend the hiring time of Rita Docken through
July 29. He stated she has been very helpful in
filling in at City Hall.
Motion /Second: Blanchard /Hankner to extend the
hiring time for Rita Docken through July 29, 1986
at the same rate of pay as previously approved.
