Adjournment CONSENT AGENDA JANUARY 26, 1987 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Motion /Second: Quick /Hankner to a grove the January 12, 1987 minutes as presented. 5 ayes 0 nays PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Mayor Linke asked Clerk /Administrator Pauley to send a letter to the Office of Pipeline Safety, requesting that hydrostatic testing be done before the line is reopened. Regular Meeting January 26, 1987 Mounds View City H111 2401 Hwy. 10, Mounds View, MN 55112 The Mounds View City Council was called to order by 1. Call to Order Mayor Linke at 7:01 PM on Monday, January 26, 1987. Bill Frits, 8072 Long Lake Road, stated that about one week ago a portion of the Williams Pipeline on Long Lake Road north of Sherwood was dug up and replacec, and he was told by one of the workers that they would not bec hydrostatic testing the new piece of pipe, and he feels that without hydrostatic testing, there is no way to guarantee what pressure the line will take or at what point it would fail. He added that in his past experience, he has seen x -rayed lines fail under hydrostatic testing. Clerk /Administrator Pauley replied it was his under- standing that they would be retesting the line this summer, but he could not guarantee it would be done before the line was reopened. 2. Approval of the consent agenda. Consent Agenda Mounds View City Council January 26, 1987 Regular Meeting Page Two -.:,,Motion /Second: Hankner /Blanchard to approve the consent agenda, as amended, and waive the reading of the resolutions. 5 ayes 0 nays Clerk /Administrator Pauley explained the purpose of proposed Resolution No. 2159 is to make permanent appointments for 1987 for the official newspaper and depository for the City. He stated Staff had received proposals from various newspapers and banks in the area and would recommend the bank and newspaper remain the same for the coming year. Motion /Second: Hankner /Quick to approve Resolution No. 2159, amending Resolution No. 2148 appointing the official newspaper and official depository for 1987, and waive the reading. 5 ayes 0 nays Clerk /Administrator Pauley reported that, following the direction of the Council, Staff has prepared a smoking and non smoking policy for Staff and City Hall. Motion /Second: Quick /Wuori to approve Resolution No. 2158, adopting a smoking policy, and waive the reading. 5 ayes 0 nays Motion Carried Councilmember Blanchard stated she was supportive of the concept, but questioned whether it was necessary to do in resolution form, versus making it an ad,..inistrative policy. Clerk /Administrator Pauley explained that by having it in resolution form, it will be much easier for him to enforce, whereas if it was an administrative policy, employees could choose to ignore it, and he would then have to go to the Council with the problem. Clerk /Administrator Pauley explained this is a temporary action which will be rescinded once the personnel code is amended. He explained this will establish a policy regarding accrual and use of benefits by employees who have used up all their sick leave, vacation and comp time but continue to be absent due to illness. Consideration of Resolution No. 2151 Mounds View City Council January 26, 1987 Regular Meeting Page Three Motion /Second: Hankner /Wuori to approve Resolution No. 2151, establishing a policy on employee benefits, and waive the reading. 5 ayes 0 nays Director Thatcher explained the project will go from County Road 2 and Bona Road to Sherwood Road and Jackson Drive, where portions of the ditch are completely filled in. He stated the cost will not be assessed to the property owners, but the funds will come from the City and Rice Creek Watershed District. Motion /Second: Quick /Blanchard to award the contract for Judicial Ditch No. 1, Branch 5, to Park Construction Company, in an amount not to exceed $27,858.50, with the City's portion of funding to come from the storm water management fund. 5 ayes 0 nays Motion /Second: Quick /Hankner to remove this item from the table. 5 ayes 0 nays Chuck Cook explained that based on the requests of the Council at their last meeting, they have altered the drainage pond area and changed the contour of the pond, and now it is at an average depth of 1.8 feet, with a 4.0 maximum depth: Councilmember Hankner asked that it be noted that on both this particular item, and many others on the Council agendas, that the Council had discussed them in great length at an agenda session, and thus did not have a need for a lengthy discussion during the regular meeting. Motion /Second: Blanchard /Quick to approve Resolution No. 2153, approving the final plat and development agreement for the Red Oak Park subdivision, and waive the reading. 5 ayes 0 nays Motion Carried 10. Consideration of Resolution No. 2153 Motion Carried Motion Carried Mounds View City Council January 26, 1987 Regular Meeting Page Four Clerk /Administrator Pauley reviewed the purpose of proposed Ordinance No. 417. Motion: Wuori to table action on this ordinance until the findings of the Gunner Isberg study are complete. The motion failed for lack of a second. Cour: 1member Wuori stated that Ordinance No. 416, which is very similar in the scope of private property usage, was tabled, and she felt the sme guidelines should apply to this ordinance also. Clerk /Administrator Pauley explained that Ordinance No. 416 concerns the updating of non conforming driveways. Motion /Second: Blanchard /Quick to have the second reading and adoption of Ordinance No. 417, amending Chapter 81 of the Mounds View municipal code entitled "Parking" by adding Section 81.03, "Vehicle for Sale Parking and waive the reading. Councilmember Councilmember Councilmember Councilmember Mayor Linke Hankner aye Quick aye Blanchard aye Wuori nay aye Councilmember Blanchard stated the she interprets this ordinance as that it does not prohibit a for $ale sign on a car when it is on their own personal property, as long as it is on a driveway. She added this would benefit other areas of the City also, where people are parking them alongside the road, and they are starting to look like used car lots. Mr. Frits asked if the ordinance applied to automobiles only, or if it applies to trucks, boats and so forth. Clerk /Administrator Pauley replied it applies to motor vehicles and read the definition of a motor vehicle. Director Thatcher had no report. 12. 2nd Reading and Adoption of Ordinance No. 41 Motion Failed Motion Carried 13. Report of Public Works/ Community Dvlpt. Director Attorney Meyers reported there were no new develop- 14. Report of ments relative to the pipeline case, and the Depart- Attorney ment of Transportation has not issued an order yet, allowing them to start the line. Mounds View City Council January 26, 1987 Regular Meeting Page Five Attorney Meyers reported a new judge will be assigned on the Highway 10 radiator case and it should be in court soon. He recommended no further action be taken regarding this property until the case has been resolved in court, such as any requests for permits or zoning, and he asked that such requests be referred to him. Attorney Meyers asked the Council authorize action to begin the process of applying to MnDOT to allow the City to acquire the property that was formerly known as the George Jackson property. Motion /Second: Hankner /Quick to have Staff proceed with the application to MnDOT for the property known as the George Jackson property. 5 ayes Councilmember Hankner reported she is the new liaison 15. Reports of to the Park and Rec Commission, and she had attended Councilmembers: her first Park and Rec Commission meeting last week. Councilmember Hankner Councilmember Hankner reported the Senate Transporta- tion Committee will be meeting at 8 AM on January 27, to hold a hearing on legislation introduced by Representative Knuth and Senator Novak. She stated she has spoken with the two of them about making a presentation to the Council regarding their bill, which would also allow the cable viewing audience an opportunity to hear them. It was agreed they should be invited to the February 9 Council meeting. Councilmember Hankner reported there will be a suicide awareness planning committee meeting on February 2, at 6:30 PM at Central High School, and Roger Taylor will be speaking to the parents of gifted students. Councilmember Quick had no report. Councilmember Quick Councilmember Blanchard reported she had represented Councilmember the City last week at the public service appreciation Blanchard dinner at the Kraus Hartig VFW, where they had pre- sented a flag to the City. She added that Policeman Reed Krough had received a plaque naming him officer of the year. Councilmember Wuori reported she had attended her first Planning Commission meeting and found it very interesting. Clerk /Administrator Pauley outlined the hearing schedule 16. Report of for the pipeline safety hearings. Clerk/ Administrator Clerk /Administrator Pauley reported the consultants doing the City's management analysis have requested a special meeting with the Council for 6 PM on February 2, to discuss the results of their evaluation. Motion /Second: Linke /Hankner to set a special meeting with the consultants for 6 PM on February 2. 5 ayes Clerk /Administrator Pauley reported that Park and Rec Director Mary Saarion has proposed to the Park and Rec Commission that they take over the Festival in the Park, as there seems to be so much difficulty in getting a group together to organize it each year.
