Adjournment CONSENT AGENDA AUGUST 10, 1987 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order by Mayor Linke at 7:03 PM on Monday, August 10, 1987. MEMBERS PRESENT: Councilmembers Blanchard, Wuori, Quick, Hankner and Mayor Linke. ALSO PRESENT: City Attorney Meyers and Police Chief Ramacher. Motion /Second: Quick /Hankner to approve the July 27, 1987 minutes as presented. 4 ayes 0 nays 1 abstain Mayor Linke abstained from the vote as he had not been present at the July 27 meeting. Mayor Linke read Resolution No. 2216 and Resolution No. 2217, resolutions of commendation and appreciation to Michael and Brian Strauss, and presented the resolutions to them. Alice Frits, 8072 Long Lake Road, asked what is being done to the pipeline now, and why. Mayor Linke replied they have been asking that question all weekend and do not know why. He explained the City was not informed of any work to be done, and they are checking with Ramsey County to see if Williams got the necessary permits. Mrs. Frits asked if the homeowners have any right to privacy, as the wor'1ers are digging up the boulevard and parking wherever, and she stated something should be done. Residents Requests and Comments from the Fioor Mounds View City Council August 10, 1987 Regular Meeting Mayor Linke explained the boulevard is County property. He added the City has pointed out the problems when they were in court before. Attorney Meyers explained Williams is continuously taking cathatic protection readings and sometimes have removed sections of the pipeline and sent them out to Neighborville, IL for testing. He added the pipeline will also be lowered for the County Road I recon- struction. He further explained there is a court order that Williams is to keep the City informed on what they are doing, and their lack of doing so may come back to haunt them some day. Bill Frits, 8072 Long Lake Road, asked who ascertains that the welds being made are safe. Attorney Meyers replied the Office of Pipeline safety is responsible, but he does not feel it has been done properly, and the work has been covered up at times without calling for an inspection. He added the City is still in court regarding the issue of safety of the pipeline, and they should be back in court sometime after November, and this issue of removal and recover- ing of the line will be addressed then. He stated the City has a court order prohibiting it from interferring with the work being done on the line. Steve Legell, no address given, stated he is a new resident to Mounds View and would like to build a garage that is larger than code permits and asked what procedure must be followed. Mayor Linke advised him to come into City Hall during regular business hours, at which time someone on Staff will outline for him the procedure to be followed. He stated it takes approximately 30 days for the process, and he must go before the Planning Commission with his variance request. Councilmember Hankner asked that Item F be removed 7. Approval of for discussion. Consent Agenda Motion /Second: Hankner /Blanchard to approve the consent agenda, minus Item F, and waive the reading of the resolutions. 5 ayes 0 nays Councilmember Hankner stated that since the Council has not had an opportunity to review the RFP's on Item F, she would prefer not taking action at this time and discussing it at the next agenda session. It was the concensus of the Council to discuss the item at the next agenda session. Councilmember Councilmember Councilmember Councilmember Mayor Linke Blanchard aye Wuori aye Quick aye Hankner aye aye Motion /Second: Quick /Hankner to approve Resolution No. 2221, amending Resolution No. 1917 establishing various fees and charges, and waive the reading. 5 ayes 0 nays Mayor Linke explained this item has been before the Council for a very long time, and they would be continuing discussion at this time. Tom Foster, 2516 Ridge Lane, reviewed what he feels is the chronology of- the park shelter building, and he stated he was present once again to oppose the placement at Random Park, as he feels Random Park is wonderful the way it is, and the Master Plan for the park system does not call for a building there, 8. 2nd Reading and Adoption of Ordinance No. 422 s. Discussion of Placement of Portable Classroom Building at Random Park Mounds View City Council August 10, 1987 Regular Meeting Page Four although it does call for a hard surface court. He stated he feels if the park is changed, they will continue to have a water problem in the area, and would have increased traffic, and would need a walk entrance to the park and better lighting, and he feels the park is too small for this type of addition. Mr. Foster stated they do not need a parking lot there for neighborhood residents, and as far as he is concerned, other residents of the City who would have to drive there and want to use it could go to New Brighton or Bloomington instead, and use their parks. Mr. Foster asked that if the Council stays with their decision on I,andom Park, to at least reconsider the placement of the building and the need for such a large parking lot. Charlie Crook, 5231 Skiba Drive, stated the Council had told them previously that the problem in moving the building from Random Park was money and asked why they should spend more money now. He stated if the Council wants to make people happy, they could find a way. Fran Mueller, 5226 Skiba Drive, stated she is against the building at Random Park, but can offer no solution. Mary Ann Wey, 5220 Skiba Drive, asked what the pipeline company will think of having the building on top of the pipe. Mayor Linke explained the building would not be over the pipeline, which is closer to the street. Robert Wey, 5220 Skiba Drive, stated the water flows down Long Lake Road, and if the pipeline broke again, it would flow into the park. Mrs. Mueller stated she is worried the pipeline company will think the City is lax if they place the building there. Mary Jane Czech, 5214 Skiba Drive, stated she feels the park is too small for the building, and she doesn't want it there. Pat Crook, 5231 Skiba Drive, stated her grandchildren do not like the location of the building there. Mike Finstimacher, 5219 Skiba Drive, stated he had taken pictures of the area during the last storm, and the water was very high, and something would have to be done about it. 0 Mounds View City Council August 10, 1987 Regular Meeting Page Five Mayor Linke replied it is already planned. Mr. Frits stated he lives near Hillview Park, where there is a problem with people parking on the road and dropping children off, and he asked if the Council will be responsive to the needs of the people, which have been expressed. Mayor Linke replied there is no parking lot at Hillview Park, other than during the winter, and the area Mr. Frits mentioned is not to be used for parking. Councilmember Hankner stated the Council had hoped to be able to find the financial resources to be used for alternate plans for the building, but the City is facing severe budget cuts and the money is just not available to move the building again. She stated the Council had planned to do something for the citizens as a whole, and not just for the immediate neighborhood. She stated she personally cannot support any spending of money that does not exist. Mr. Frits suggested the City sell the building. Councilmember Hankner expressed her frustration with citizens who do not want to participate in anything until after the fact, if they do not like it. She stated she personally tried her best to get citizen input, and the Council must weigh the property rights, and she pointed out Random Park is City property, and it does not belong to any particular individual, nor is it there for their exclusive use. Motion: Blanchard to reconsider placement of the Motion Failed building. The motion died for lack of a second. Motion /Second: Wuori /Blanchard to approve Resolu- tion No. 2224, approving the minor subdivision for William R. Zwieg, 5309 Greenfield Avenue, and waive the reading. 5 ayes 0 nays Attorney Meyers reported he had received an order from the court for a dismissal with prejudice in the Povlitzki case, and that is now considered resolved. He added he has been presented with a mutual releaso of all claims to resolve the matter be,ween the Povlitzki's and Conroy's, regarding the Muldoon's property. He added there is a quit claim 13. Report of Attorney Mounds View City Council August 10, 1987 Regular Meeting Page Six deed and bill of sale, dated in October 1985, which all represent that the property once again belongs to the Povlitzki's. He added he understands Mr. Povlitzki would like to apply for a liquor license in the City, and he has been informed that in order to apply, a public hearing is required, and he has advised all the attorneys involved that the Council is interested in getting back to a restaurant operation, as it wa7 originally with the Anchor Inn, when the liquor license was first issued. Mayor Linke reported Mr. Povlitzki has asked to meet with the Council at their next agenda session, on August 17. Motion /Second: Hankner /Quick to set a public hearing for August 24, 1987, at 7:25 PM at City Hall, and publish the required notices. 5 ayes 0 nays Attorney Meyers reported the Council had had the first reading of Ordinance No. 420, and then tabled any further action at his request. He reported he has received an executed stipulation of dismissal from Greg Johnson, and requested the Council take action on the ordinance at this time. Motion /Second: Linke /Quick to have the second reading and adoption of Ordinance No. 420, and waive the reading. Councilmember Hankner Mounds View City Council August 10, 1987 Regular Meeting Page Seven a Mayor Linke reported he had attended the Mounds View IFIr Community Theater production of "Mame" and found it to be an excellent production. Mayor Linke reported the Ramsey County Youth Corrections Department has cut funding from their proposed budget for 1988 for the North Suburban Youth Service Bureau, which is an organization that handles troubled youth in the community, as well as assists other youth. He stated he feels this is a very worth- while program and he would like the residents to send letters and make phone calls to Ramsey County Commissioner Duane McCarty, voicing their support for the program. Chief Ramacher reported they have sent a number of offenders to the Youth Service Bureau, and he feels it is a very worthwhile program, and he would hate to lose iv.. Councilmember Hankner pointed out that while the Corrections Bureau has removed funding from their budget, the Ramsey County Commissioners must approve the budget and could put it back in.
