Adjournment CONSENT AGENDA DECEMBER 28, 1987 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. New Fire Protection Expires 6/30/88 Industrial Sprinkler Corporation New Land O' Lakes Fire Protection New PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The Mounds View City Council was called to order by Mayor Linke at 7:00 PM on Monday, December 28, 1987. The Pledge of Allegiance was said. MEMBERS PRESENT: Councilmembers Blanchard, Wuori, Quick, Hankner and Mayor Linke. ALSO PRESENT: Clerk /Administrator Pauley, City Planner Herman. Motion /Second: Blanchard /Wuori to approve the December 14, 1987 minutes as presented. 5 ayes 0 nays There were no residents requests or comments from the floor. Clerk /Administrator Pauley read the items on the proposed consent agenda. Councilmember Hankner asked that Items C and D be removed for discussion. Motion /Second: Quick /Hankner to approve the consent agenda, minus Items C and D, and waive the reading. 5 ayes 0 nays Councilmember Hankner explained she had requested Item C be removed, because she would like it to receive attention. She noted that the payment of $101,982.27 to Ramsey County for County Road I reconstruction is only a partial payment on the project and she wanted people to be aware that the cost of the project is not being assessed to them, but rather is being paid for by the State aid gas tax. Approval of Consent Agenda Motion Carried Mounds View City Council December 28, 1987 Regular Meeting Page Two "'Councilmember Hankner asked for Item D if the employees had been involved in their position accountability write -ups. Clerk /Administrator Pauley explained the supervisors were required to involve the employees in the write up, and if a disagreement should occur, it would be taken to the department head or himself to resolve, but no such disagreements had occurred. Motion /Second: Hankner /Quick to approve Item C, the partial payment No. 2 in the amount of $101,982.27 to Ramsey County for County Road I reconstruction, and Item D, to approve the position accountability write -ups dated December, 1987 for the Utility Accounting Clerk, Accountant, Finance Director /Treasurer, Accounting Clerk, and Clerk /Administrator. 5 ayes 0 nays Motion Carried Linke closed the regular meeting and opened the first public hearing at 7:09 PM. Clerk /Administrator Pauley reviewed the history of the vacation of easement on St. Stephens Street, and the necessity of the proposed amendment to the original ordinance. Motion /Second: Hankner /Blanchard to approve the first reading of Ordinance No. 433, amending Ordinance No. 359 vacating a portion of St. Stephen Street and drainage easement, and waive the reading. 5 ayes 0 nays Motion Carried Mayor Linke closed the public hearing and reopened the regular meeting at 7:15 PM. 7. Public Hearing: Ordinance No. 433 Mayor Linke closed the regular meeting and opened the 8. Public Hearing: second public hearing at 7:15 PM. Odas Newton, Cur for City Planner Herman reviewed the request of Mr. Newton Oversized to construct an oversize accessory building at 8319 Accessory Groveland Road, and she presented the site plan. She Building explained the oversized building would be used only for storage of boats, lawn mowers, and so forth, and she reviewed the allowable uses of the building. She added that the Planning Commission has reviewed the request and recommends approval. Councilmember Blanchard asked if the attached garage would remain as it is. Mounds View City Council December 28, 1987 Meeting Page Three Planner Herman replied it would, with the existing driveway being seeded over, and the new driveway would face Fairchild. Mayor Linke closed the public hearing and reopened the regular meeting at 7:18 PM. Clerk /Administrator Pauley explained the necessity of the proposed ordinance, which would allow non- peace officers to issue citations. He stated that State law now requires municipalities to have such an ordinance in order for non -peace officers to issue citations. Motion /Second: Quick /Hankner to have the first reading of Ordinance No. 434, amending the Municipal Code of Mounds View by amending Chapter 1.11, entitled, "General Provisions of Code and waive the reading. 4 ayes 1 nay Councilmember Blanchard voted against the motion, with there being considerable discussion on the motion before the vote was taken. Councilmember Blanchard stated she did not feel it was necessary to have every department head in the City able to write tickets, and she added with so few being written, it should not be a hardship on the Police Department to write them, as they are trained to do so. Mayor Linke stated he did not feel the Police officers were trained to find things in violation that a building inspector would, and that the Police would not be that proficient in Court in presenting evidence, as would the building inspector who was familiar with the violation. Councilmember Blanchard stated the Police are trained to communicate with people, and she felt if a case went to Court, the building inspector would be there also to provide testimony. Councilmember Quick pointed out that would he tying up at least two Staff members then, in going to Court. He stated he feels comfortable with the way the ordinance is written, with specific people assigned to their area of expertise. Councilmember Blanchard stated she felt these were Police powers, and should be left to the Police. 9. First Reading of Ordinance No. 434 Motion Carried Mounds View City Council Regular Meeting Page Four r Bill Frits, 8072 Long Lake Road, stated he was against the proposed ordinance, since Police officers are trained to do that type of thing, and that upon receipt of a complaint, they can issue a citation and gather evidence to present it. He added it is not right or necessary to have half a dozen people driving around the City issuing citations, and he felt it was putting too much power in the hands of a single individual. Upon questioning by Mr. Frits, Councilmember Quick stated he could recall three citations being issued since he was on the Council, and they would have been handled by a judge, and he was not sure what the outcome of each one was. Mayor Linke clarified that the areas listed in the proposed ordinance are criminal offenses, not administrative offenses. Councilmember Quick pointed out that Mr. Frits is advocating giving all the power to the Police department, and he would be much more comfortable with several people having say in the matter, rather than just one body. Councilmember Hankner stated there appeared to be confusion over the items the ordinance would cover, and she reviewed the areas it would cover. She added the Police Chief had met with the Council last week to review the proposed ordinance, and he was comfortable with it. Savri Ayaz, 7751 Bona Road, asked if other cities such as Minneapolis and St. Paul have an ordinance of this nature. Clerk /Administrator Pauley explained Minneapolis and St. Paul have a different form of government, and he was not certain what other cities were doing. Motion /Second: Wuori Hankner to approve Resolution No. 2276, approving a conditional use permit for Odas Newton, 8319 Groveland Road, for an oversized accessory building, Planning Case No. 229 -87, and waive the reading. 5 ayes 0 nays December 28, 1987 10. Consideration request of Alphonse Petron, for aminor subdivision at of Resolution 2909 Woodale Drive, and the Planning Commission has No 2275 reviewed it and recommends approval. She explained the circumstances that resulted in such an unusual lot configuration, and she added that the ,ubdivisir_.n request meets all requirements of the zoning code. Motion /Second: Quick /Wuori to approve Resolution No. 2275, approving a minor subdivision for Alphonse L. Petron, 2909 Woodale Drive, Planning Case No. 227 -87, and waive the reading. 5 ayes 0 nays Motion Carried Clerk /Administrator Pauley reported Planner Herman 12. Consideration 1987 memo from Public Works Foreman Ulrich regarding of Staff Memo water department stock items, and his request to Regarding replenish that stock. Water Depart- ment Stock Motion /Second: Wuori /Hankner to accept the low bid Items of Water Products Co. in the amount of $3,348.50 to replenish the water department inventory. 5 ayes 0 nays Motion Carried Councilmember Blanchard asked if there was a system in place for the automatic replenishment of items as they are used. Clerk /Administrator Pauley replied he was not aware of one, but in the change of personnel, it appeared to not have been done. Clerk /Administrator Pauley requested Council approval to appoint Steve Dazenski as a permanent full -time employee of the City. 14. Consideration of Resolution No. 2279 Mounds View City Council December 28, 1987 Regular Meeting Page Six otion /Second: Hankner /Wuori to approve Resolution :+7o. 2279, approving the appointment of Steve Dazenski as a permanent full -time employee of the City, and waive the reading. 5 ayes 0 nays Mayor Linke stated he had spoken to Attorney Meyers earlier in the day, and he had no report for the meeting. Councilmember Blanchard had no report. Councilmember Wuori had no report. Councilmember Quick had no report. Councilmember Hankner had no report. Mayor Linke reminded everyone of the Pinewood playground Buy -A -Board campaign and the penny jugs that are located at businesses throughout the City, and he encouraged the residents support of this venture. Mayor Linke reported he had received a request for a $250 donation from the Dispute Resolution Center, and requested that it be placed on the January 4, 1988 agenda for discussion.
