Adjournment CONSENT AGENDA OCTOBER 24, 1988 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Adopt Resolution No. 2401 Approving Just and Correct Claims Against City Funds The Mounds View City Council was called to order by Mayor Linke at 7:00 PM on Monday, October 24, 1988. The Pledge of Allegiance was said. PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA MEMBERS,, PRESENT: Councilmembers Wuori, Quick, Blanchard, Hankner and Mayor Linke. ALSO PRESENT: City Attorney Kerney, Clerk /Administra- tor Pauley. Motion /Second: Hankner /Wuori to approve the October 10, 1988 minutes as corrected. 5 ayes 0 nays Bill Frits, 8072 Long Lake Road, questioned why three different water districts were listed for voting on the absentee ballot, and whether it was valid. Clerk /Administrator Pauley explained they had just been received earlier in the day and he had not had an opportunity to look at them. He explained they were printed in Chicago, by Ramsey County. Later in the meeting, after briefly reviewing the ballot, Clerk/ Administrator Pauley stated the question would have to be referred to Ramsey County. He stated he would get an answer from them and call Mr. Frits. Carolyn Basterash, Health and Safety Chairman of the Pinewood PTA, explained the McGruff Safe House Program they are looking at for this area. She explained it involves coordination with the Police Department and she has been working with Lt. Brick on getting a pro- gram set up. The initial cost of signs to go in windows is $1 per sign, and they would like to start with 100, and she asked the Council to consider funding this cost. Brick there to make a Staff report and answer questions. Mounds View City Council Regular Meeting Mayor Linke advised the public hearing scheduled for 7 :05 PM had been cancelled due to improper notice. Clerk /Administrator Pauley stated Staff would recommend an informational hearing be held at this time, and the public hearing rescheduled to 7:05 PM on November 14, as well as a public hearing for 7:10 PM on November 14, to consider the PUD Concept_Plan_ Motion /Second: Hankner /Blanchard to reschedule the Wetland Alteration Permit, Wetland I -24 public hearing to November 14 at 7:05 PM, and schedule a public hearing for the PUD Concept Plan at 7:10 PM on November 14. 5 ayes 0 nays Phillip Seipp, president of SYSCO /Continental, explained they have over 220 employees in their company, and they are very proud of their low turn- over rate, and they also attribute the success of their company to their employees. Mr. Seipp explained the site plan has evolved through many discussions with City Staff and input from the residents and the Planning Commission. He added they are willing to address all the issues presented. Scott Kinkaid, of Ryan Construction, reviewed the site plan and the changes made since the last presen- tation. Dick Koppie, of Westwood. Professional Building viewed the site plan for grading, drainage, landscap- ing and traffic flow. He explained they have been requested to align their roadway with existing Xylite Street, due to anticipated traffic flow, and that, coupled with the location of the Williams Pipeline on the property and constraints in building near that, resultsin the encroachment on the wetland. He added they are working with the Rice Creek Watershed District, Department of Natural Resources, Army Corps of Engineers, and City of Mounds View, in meeting the requirements of all the governing bodies. 6. Ron Peterson, a wildlife biologist, reviewed the wetland mitigation package that has been developed, and he reviewed the wetland boundaries and how they were arrived at. He also presented a drawing of how the wetlands would be after development. Mr. Peterson reviewed the issues the ordinance requires to be addressed and how the had approached them. Meeting Kathy Ayaz, 7751 Bona Road, asked if the 100' buffer zone indicated by the Mounds View Code was included in the Corps of Engineering mitigation. Mr. Peterson replied the boundary is actually beyond, and the mitigation plan has been developed to offset the encroachment within the buffer area also. Sabri Ayaz, 7751 Bona Road, stated he felt the develop- er was doing a commendable job and was not ignoring both boundaries. He added, however, he feels it has only one boundary, and the Army Corps of Engineers is more knowledgeable than the City, and they should only discuss the Corps boundary. He added they should deal with the 100' setback, which is not honored in this proposal. a Mr. Peterson stated they did not assume the 100' buffer zone beyond the Corps boundary. Councilmember Hankner explained for the City to accept the Corps boundary line would require an ordi- nance change, which would be time consuming, and there is not enough time with this project. Mr. Ayaz asked why they don't use the City's boundaries rather than the Corps. Mr. Peterson explained the only encroachment would be the roadway. City Planner Herman stated Staff had asked the City's consultant to compare the City's requirements with the Corps of Engineers. Attorney Karney advised the Army Corps of Engineers far exceeds the City's 100' buffer with the exception of a small area, and they are responsible to the Code, which would have to be changed if the boundaries were moved to that of the Corps. Mayor Linke noted the current Code was changed in 1983. Councilmember Hankner reviewed how the City boundary was established in 1983 or 1984. Mr. Ayaz stated he would like a copy of all wetlands in the file, as he still feels this would be encroach- ing. He was presented with a map of the City's wetlands. Mr. Kinkaid explained the encroachment is necessary due to lining up the road and the placement of Williams Pipeline, and those two issues are what is driving that portion into the wetland. He added if they were relieved of those two constraints, they could stay entirely out of the buffer. Mounds View City Council October 24, 1988 Regular Meeting Page Four Mr. Peterson explained if the 100' buffer was added to 'the A rmy Corps of Engineers, it would not be any greater than the impact from the mitigation. He pointed out there is also the opportunity to add additional mitigation in the future. Mr. Ayaz stated he did not want the City to set a precedent for other wetlands. He added an excellent job has been done here, with the proposed wetland being much better than what is there now, but he is afraid the building encroachment would set a precedent. Clerk /Administrator Pauley replied the City has dis- cussed this in depth with the City Attorney, and they feel there are enough extenuating circumstances in this case, that they could continue to enforce the ordinance. Mr. Ayaz replied he was satisfied. Attorney Karney added the circumstances in this develop- ment are unique and he feels they can remain consistent in applying the Code on a case by case basis. Mr. Koppie reviewed the traffic projections, clarifying that they are for truck traffic, not cars. Ms. Ayaz noted it had been brought up at the joint Planning Commission /City Council meeting last week that a good portion of the site had already been cleaned, and in looking at the wetland ordinance, that is a misdemenor to clear any vegetation before the City has issued a permit. She stated she under- stood the owner of the property had done the clearing and asked what action the City would be taking against him. Clerk /Administrator Pauley replied that after consult- ing with the City Attorney, a letter of warning was sent to Mr. Miller. Attorney Karney explained that if legal action more than a warning letter was taken against this property owner, they would have to do the same to all the other property owners in the City, including residential, who may have mowed their lawn too close to a wetland. He added the fine could be up to $750 or 90 days in jail, or both. Cou;icilmember Hankner noted in a previous case a warning letter had been sent and thus a precedence was set to send a warning. She added it is a problem throughout the City with garbage and grass clippings being dumped in the wetlands, and they must educate the public. Mounds View City Council October 24, 1988 Regular Meeting Page Five Dave Jankee, of Eastwood Road, asked why the public hearing had been cancelled. Mayor Linke explained Staff did not get notice to the paper in time for their cut -off, so the public hearing had to be rescheduled to November 14 to allow for proper notice. Mr. Jankee asked how long it would be before action would be taken. Mayor Linke replied they are working as fast as they can. Councilmember Hankner explained the procedure that is followed,and what happens once a proposal is received by the City. She stated they may or may not take action on November 14, depending on the issues that are resolved or unresolved at the conclusion of the public hearing. She added they could keep the hearing open for a time or could close it and wait for further Council discussion, or close it and take action that night. Mr. Ayaz asked what advantages were offered the developer as a tax increment district. Clerk /Administrator Pauley they have only had one negotiation meeting so far and nothing has been formulated at this point. Mayor Linke closed the regular meeting and opened the public hearing at 8:14 PM. Finance Director Brager presented overhead graphs showing water fund expenses comparing 1988 to 1989, project income and loss for 1989, and water rates for 1983 -1989, and sewer fund expenses comparing 1988 to 1989, project income and loss for 1989 and sewer rates for 1983 -1989. He noted there will be a sizeable increase in the sewer and water billing for the average customer, of $8 per quarter. Mr. Ayaz noted the sewer increase is approximately 20% and questioned why it was so high. Finance Director Brager explained it is connected to the billing for sewer treatment from the Metro Waste Control Commission and increases to the City. He explained 60% of the cost of the sewer budget is for treatment of sewage. Mayor Linke closed the public hearing and reopened the regular meeting at 8:30 PM. 7. Public Hearing: Proposed 1989 Water and Sewer Utility Budgets and Rates Mounds View City Council October 24, 1988 Regular Meeting Page Six Aft Motion /Second: Quick /Blanchard to approve the con- sent agenda, as presented, and waive the reading of the resolution. 5 ayes 0 nays Park Director Saarion reported four bids were re- ceived for the printing of the 1989 City newsletter and she recommended the low bid of Advanced Printing in the amount of $8,800 for six issues, with the funds to come from the Administrative fund and Recreation fund jointly. Wuori /Hankner: Wuori Hankner to award the bid for the 1989 City newsletter to Advance Printing in the amount of $8,880. 5 ayes 0 nays Park Director Saarion explained the proposal was submitted to the Park and Rec Commission some time ago, and the plan would give the City a viable way of setting a policy for the maintenance of Silver View Park pond. She explained it was a concensus of the group present the night of the meeting to omit two items, numbers 4 and 5, due to little interest, and it was further discussed by the Park and Rec Commission and City Staff, and the decision was made through those discussions to eliminate those two items. Councilmember Hankner stated she would like more time to look at the proposal and perhaps add back in the omitted options. Park and Rec Director Saarion explained the omitted options were for a fishery, and dredging which is required to go along with it, and no one was interested at this time, but it could be added later. Councilmember Hankner stated those people did not know at the time the Council would be supporting the plan, and she recommended asking for additional input, and notifying people by letter and through the newspaper. It was agreed the item would be discussed further at the November 14 Council meeting. Motion /Second: Quick /Wuori to approve Resolution 11. Consideration cf Approval of Con tract from Environmental Specialists for Management Plan fo Silver View Park of Resolution No. 2400 Motion Carried Mounds View City Council Regular Meeting Motion /Second: Hankner /Blanchard to approve Reso- lution No. 2402, setting water rates effective January 1, 1989, and waive the reading. 5 ayes 0 nays Motion /Second: Wuori /Quick to approve Resolution No. 2403, setting sewer rates effective January 1, 1989 and waive the reading. 5 ayes 0 nays Clerk /Administrator Pauley explained that after the special meeting with the Library Board, they were notified the Board will be having a special meeting on November 1 to authorize the issuance of bonds, and they would like some idea of the preference of the Council for the location of the library by City Hall. He stated he had directed Public Works supervisor Minetor to review the options available using the feasibility study the Library Board developed and review them with the Council. Mayor Linke stated there had been discussion with Mr. DeGross, owner of the gas station, last week, and he has not had negotiations with the County. He stated the contamination on the site has been determined to be from 1963. Public Works Director Minetor presented overhead maps of the property in question and reviewed the three options possible for the location of the library and its future expansion. Clerk /Administrator Pauley explained the Library Board will make the final decision on the options presented by the City, so the Council should be clear in stating if they have a preference. He also advised they state that if the land used is donated by the City so the County doesn't have to go out and purchase it, the funds saved should be reinvested in the Library, in meeting rooms or some other manner. He added the Council will have development and site review on the plan. Councilmember Hankner stated she was not happy with taking commercial property off the tax rolls, es- pecially when it could require a good deal of clean -up. She also pointed out the City has administrative costs cn that site for trying to get it leaned up. October 24, 1988 Page Seven 12. Consideration of Resolution No. 2402 Motion Carried 13. Discussion of Optional Library Location on City Hall Property Mounds View City Council Regular Meeting Park Director Saarion stated that as an advocate of City Flall park, she would like to see the park kept as activity oriented as possible, without land being taken. Councilmember Blanchard stated she had received a call last week from someone on the Library Board, and does not feel the Council has to make a definite recommenda— tion or decision. Councilmember Quick stated they could possible place the building to the center, and it is up to the Council to decide the impact they would agree to most. Councilmember Wuori stated that the original site offer did not include the gasoline station but was requested by the Library Board and they are aware of the tax loss to themselves as well as the City. Public Works Director Minetor added he had checked on it about a month ago and it was on the list to be installed. Councilmember Hankner inquired on the policy of sidewalk clearing for snow. Public Works Director Minetor replied he is working on a complete snow policy, and sidewalks will be a part of it. He added he would try to get the sidewalk portion to the Council as quickly as possible. Councilmember Hankner asked for an update of the speed limit by Pinewood School. Public Works Director Minetor replied he had received information from the State and would be presenting it to the Council at a future agenda session. Mayor Linke had no report. Mayor Linke pointed out the overlay was not matched well at the shoulders in some spots and could cause problems in the future. Public Works Director Minetor asked for a list of specific locations, which he would check into. Mayor Linke replied one location was Jackson and Terrace, and he would have to check on other locations.
