MEETING IS CALLED TO ORDER 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL: Flaherty, Stigney, Hull, Mueller, Gunn. NOT PRESENT: None. 4. APPROVAL OF AGENDA A. Monday, November 22, 2010, City Council Agenda. MOTION /SECOND: Gunn/Hull. To Approve the Monday, November 22, 2010, agenda as presented. Ayes 5 Nays 0 Motion carried. 5. PUBLIC INPUT None. 6. SPECIAL ORDER OF BUSINESS None. 7. COUNCIL BUSINESS A. 7:05 p.m. Public Hearing. Resolution 7700, Approving the 2011 Fee Schedule. City Administrator Ericson reviewed the 2011 fee schedule with the Council. He indicated revisions had been made to the schedule after discussing this item in detail at the November work session meeting. Staff recommends approval of the document. Mayor Flaherty opened the public hearing at 7:20 p.m. Mounds View City Council November 22, 2010 Regular Meeting Page 3 Council Member Mueller questioned if the fees covered staff time to complete necessary administrative tasks. Community Development Director Roberts stated this was the case, with additional engineering and attorneys fees paid for by the applicant. MOTION /SECOND: Mueller Stigney. To Waive the First Reading and Introduce Ordinance 855, an Ordinance Amending Appendix E of the Municipal Code about Planning Development Fees. Ayes 5 Nays 0 Motion carried. C. Resolution 7701, Approving the Mounds View Data Practices Policy and Procedures. City Administrator Ericson explained this item was back before the Council for approval after being discussed by Council at the November work session. He indicated the data practices policy provided detail as to how public and private data should be handled by the City. After numerous legislative changes, the City's policy needed revisions. City Attorney Riggs indicated the intent of the document was to dispute how public data would be handled by the City in a more user friendly manner. He explained the State had guiding policies as well. The document before the Council this evening was being used by other communities and he recommended the Council proceed with approval. Mayor Flaherty stated the policy refers greatly to Minnesota State Statute and asked if this was cause for concern. City Attorney Riggs indicated the City's policy was much more user friendly than State Statute and provided the necessary information to the public on how data practices would be handled in an efficient manner by City staff. Council Member Mueller questioned if there was a statute of limitations with data practices. City Attorney Riggs explained this was referenced on Page 12. However, the Records Retention Schedule would address this in further detail. This document would dovetail into the data practices policy and procedures. Council Member Stigney asked where emails are discussed. City Attorney Riggs indicated daily emails discussing information regarding public meetings or agendas are public information. He stated unless strictly specified, emails are public information. There was nothing written expressly into the policy, but private data policies would be applied if the issue came into attorney /client privileges. City Administrator Ericson reviewed the item further with the Council. Council Member Mueller questioned if the past bids for the street improvement projects were public information. City Attorney Riggs explained this was public information. MOTION /SECOND: Gunn/Hull. To Waive the Reading and Adopt Resolution 7701, Mounds View City Council November 22, 2010 Regular Meeting Page 5 with his neighbor to see if they were willing to assume half of the infiltration basin. Public Works Director DeBar did not oppose this suggestion but stated time is of the essence as plans were being drafted by Bonestroo. City Administrator Ericson suggested that staff hold off until the feasibility of this option is determined. Public Works Director DeBar stated the second appeal was submitted by the owner of Sands Apartments at 5440 Jackson Drive. Two infiltration basins were planned for this parcel and the applicant expressed concern with the area becoming a stormwater "hot spot" as the area has flooded in the past. Staff explained this was not a valid claim. Public Works Director DeBar indicated the second claim was that the basins were not properly spaced. However, the infiltration basins were spread properly along the roadway and sized by the consultants based on specific regulations. He ensured that the slope would be proper while maintaining a natural look in the right -of -way. Mayor Flaherty questioned if the slope in this area would be a concern. Public Works Director DeBar indicated the basin would have to be properly sloped or built up on the back slope to assure there was no ponding of water runoff. This would direct the water back into the street and away from the property. MOTION /SECOND: Mueller/Hull. To Waive the Reading and Adopt Resolution 7702, Denying SIP Appeals and Approving the Proposed Locations of Stormwater Infiltration Basins in Area D of the Street and Utility Improvement Program. Mayor Flaherty thanked the Streets and Utility Committee for diligently discussing these issues and for their recommendations to Council. Ayes 5 Nays 0 Motion carried. E. Resolution 7703, Approving Service Agreements with Trane US, Inc. and Architect Mechanical, Inc. for HVAC System Maintenance of City Facilities. Public Works Director DeBar explained the City owns 13 buildings that have an HVAC unit. Seven of these buildings have simple units; three buildings had more significant units. The remaining three buildings were park buildings with controlled units. He indicated the maintenance contract with Trane has expired. He reviewed that proper maintenance of these systems could reduce the City's expenses in the long term. The maintenance agreement would provide quarterly inspections of each unit. Public Works Director DeBar reviewed three bids received for HVAC system maintenance throughout the City. The City has been pleased with Trane's performance in the past and recommended the Council approve a service agreement with Trane and Architect Mechanical for the HVAC system maintenance of City facilities. If approved, the contractors would visit the City in December to prepare the units for winter. Mounds View City Council November 22, 2010 Regular Meeting Page 7 MOTION /SECOND: Mueller /Stigney. To Approve the Just and Correct Claims as presented. Ayes 5 Nays 0 Motion carried. 10. APPROVAL OF MINUTES None. 11. REPORTS A. Reports of Mayor and Council. Mayor Flaherty stated the proposed property taxes for 2011 have been sent out. He reported his Ramsey County and school district taxes were increased but the City of Mounds View taxes went down. He indicated this may not be the case for all, but he was encouraged by the decrease. Council Member Mueller mentioned that Susan Gertner, Ramsey County Attorney, was being recognized for 16 years in leadership on December 7, 2010, at the Landmark Center in St. Paul. Mayor Flaherty encouraged all to read the recent Mounds View Matters that contained a great deal of information on upcoming holiday events. Council Member Mueller indicated Santa would be coming through the neighborhoods via fire truck December 6 th through December 9 She encouraged all to welcome him and present the firemen with a donation to the local food shelf. B. Reports of Staff. 1. Community Development Department Third Quarter Report Community Development Director Roberts reviewed his third quarter department report with the Council. Highlights included his department staying on budget through September, along with Select Senior Living signing a purchase agreement. Work may begin on this project in January. He reviewed that all code enforcement cases were closed this quarter with the exception of six. He indicated the majority of the issues addressed in the third quarter were leaf and grass concerns. Community Development Director Roberts thanked the Council for approving the GMAC guidelines as this has been a focus for his staff in recent months. He shared his appreciation for all in his department, each for their contributions to the City. Mayor Flaherty thanked the Community Development Department for working so strongly on behalf of the City even while in an economic downturn, indicating that now was the time to prepare for upcoming opportunities. City Administrator Ericson reminded the Council that the December 27, 2010, regular City Council meeting has been cancelled. C. Reports of City Attorney. City Attorney Riggs had no report. 12.
