Hwy. 10, Mounds View, MN 55112 CALL TO ORDER The Mounds View City Council was called to order by Mayor Linke at 7:00 p.m. on Monday, December 13, 1993. PLEDGE OF ALLEGIANCE • ROLL CALL MEMBERS PRESENT: Mayor Linke, Councilmembers Trude, Wuori, Blanchard and Quick MEMBERS ABSENT: None ALSO PRESENT: Samantha Orduno, City Administrator; Mary Saarion, Director of Parks, Recreation and Forestry; Paul Harrington, City Planner; Mike Ulrich, Public Works Supervisor APPROVAL OF MINUTES MOTIONf SECOND' as presented. VOTE' Trude/Quick to approve minutes of November 22, 1993 5 ayes 0 nays Motion Carried SPECIAL ORDER OF BUSINESS: There was no special order of business. CONSENT AGENDA Samantha Orduno, City Administrator, read the Consent Agenda. Mayor Linke asked if there were any items the Council desired removed from the Consent Agenda. VOTE: 5 ayes 0 nays Motion Carried RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR There were no resident requests or comments. PUBLIC HEARINGS a. Consideration of Request .for Rezoning and Development Review of Everest Development Paul Harrington, City Planner, reported that the City of Mounds View received a letter dated December 3, 1993 from Everest Development stating that the City site plan review/rezoning approval process should be halted. No further action was necessary on this item. b. Continuation of Public Hearing of Conditional Use Permit Request (Residential Doc,L Kennel),. Victoria Bowers, 8351 Groveland Road Paul .Harrington, City Planner, explained that the City Council at their November 22, 1993 Meeting, asked Staff to contact the Humane Society to schedule an on-site inspection of the applicant's property. The Humane Society had already inspected the property on November 20th and stated that there was no basis for a cruelty or neglect complaint. Harrington stated that provided in the Council Packet was two resolutions. One of the resolutions would approve the Conditional Use Permit for the Residential Dog Kennel and the other would deny the Conditional Use Permit. Mayor Linke stated that the only issue under consideration at this time is the approval/denial of a Conditional Use Permit for a residential dog kennel. Councilmember Trude stated that it is hard to ignore the complaints of five households stating that there is excessive barking on the property. This definitely impacts the neighborhood. Trude suggested denying .the kennel license and that way Ms. Bowers could still keep two of the dogs. The issuance of a Conditional Use Permit for a residential dog kennel at this location would negatively impact the neighborhood based on the dogs excessive barking as testified to by the number of persons who were in attendance at the public hearing on this matter. Councilmember Blanchard stated that there is no indication that it is always Ms. Bower's dogs barking. Councilmember Blanchard stated Mounds View City Council Page Three Regular Meeting December 13, 1993 that Ms. Bowers states that she brings her dogs in at night. Blanchard stated that Ms. Bowers has accomplished everything that the City has asked of her and that the Humane Society has also stated that the facility is adequate for three dogs. Councilmember Trude stated that at the last portion of the public hearing persons living 500 feet away from the property stated they were also bothered by excessive barking of the dogs on the property. Councilmember Trude stated that it is difficult to ignore the complaints of reasonable people. Mayor Linke stated that when a kennel license was denied in the past it was denied because there had been police calls. Mayor Linke stated that after one year there is a review done on a conditional use permit and substantiated by police records. Mayor Linke stated that, at this time, in his opinion, there is no legal reason to deny the license. Councilmember Blanchard stated that the statements made at the public hearing were made against Ms. Bowers, not against the animals. Mayor Linke closed the public hearing at 7:43 p.m. • Councilmember Quick stated that the petition that Ms. Bowers brought in was haphazardly signed. Quick also stated that, in his opinion, Ms. Bowers is not able to handle the dogs and two of the dogs are not hers, therefore, the City would be allowing her to board dogs. Ms. Bowers stated that she has lived at this address for 14 years. Ms. Bowers stated that she controls her dogs and loves her dogs. Mayor Linke stated that in the past when a license was voted on and denied it was because of police reports that stated that there were definite problems could be substantiated. Councilmember Trude stated that five households came forth and stated the problems that they are having with the property being licensed as a kennel. Ms. Bowers was even told it would be appropriate to ask persons to attend who supported her kennel license, but no one attended or testified on her behalf. Trude stated that she doesn't feel that the police should be responding to dog calls. Mayor Linke stated that the barking of dogs is part of the nuisance code. Mayor Linke closed the public hearing at 7:43 p.m. • Mounds View City Council Page Four Regular Meeting December 13, 1993 MOTION/SECOND: Trude/Quick to Deny Resolution No. 4450 Approving the Request by Victoria Bowers for a Conditional Use Permit to Allow a Residential Dog Kennel at 8351 Groveland Road Councilmember Trude requested that conditions 1 and 2 be stricken from Resolution No. 4450 and that one condition be added which would state, "due to the negative impact on the neighborhood due to excessive barking of the dogs as testified to by a number of neighbors who attended the. public hearing on November 22, 1993." VOTE: 2 ayes 3 nays Motion Failed MOTION/SECOND: Blanchard/Wuori to Adopt Resolution No. 4450 Approving the Request By Victoria Bowers .for a Conditional Use Permit to Allow A Residential Dog Kennel with Existing Three Dogs* at 8351 Groveland Road *If something happens to one of the dogs it is not to be replaced and Conditional Use Permit would be null and void. **VOTE: 3 ayes 2 nays Motion Failed ** Motion Failed due to lack of 4/5 Affirmative Vote. . Mayor Linke stated that the approval for a residential dog kennel at 8351 Groveland Road was denied and directed staff to bring the household into conformance with the City's Municipal Code. COUNCIL BUSINESS A. Consideration of Resolution No. 4425 Providing for the Issuance and .Sale of the City's $3,090,000 Gross revenue Golf Course Bonds, Series 1994A Samantha Orduno, City Administrator, stated that the City is on the road to constructing a 9 hole golf course. Construction will start approximately April of 1994 and tee off would take place approximately June 15, 1995. Orduno introduced Bob Thistle of Springsted who indicated that all bonds were sold and that negotiations had taken place with Piper Jaffrey for fair and equitable interest rates. MOTION/SECOND: Quick/Blanchard to Adopt Resolution No. 4452 Providing for the Issuance and Sale of the City's $3,090,000 Gross Revenue Golf Courses, Series 1994A VOTE: 5 ayes 0 nays Motion Carried B. Review of Snow and Ice Control Policy Mike Ulrich, Public Works Supervisor, indicated that this policy can be updated as needed. Staff is recommending that the section that discusses damage to boulevard areas be changed from the City supplying seed, to the City supplying sod for pick up by residents that have received damages by City plows to the boulevard areas during one week and one weekend. View City Council Page Five MOTION/SECOND: Wuori/Quick to Approve Change in Snow and Ice Control Policy As Presented VOTE• 5 ayes 0 nays Motion Carried At this time., Bill Frits, 8072 Long Lake Road, asked who had been plowing Long Lake Road and putting snow on private property. Mike Ulrich, Public Works Supervisor, explained that the County had not plowed the street wide enough for mail delivery, so the City widened it which did throw snow on private property. Councilmember Blanchard stated that she had received two calls regarding salt in the snow that was thrown on private property and its effect on the grass. " Mike .Ulrich responded that the salt content is very low in the snow and sand that is thrown on the grass. Ulrich explained that the sand would injure the grass sooner than the salt would. Victoria Bowers commented that two years ago a plow had come by and plowed in her mailbox and her neighbor's mailbox and that she had to dig them out. • Mayor Linke stated that two years ago we had an inordinate amount of C. Consideration of Hiring of Public Works Maintenance Worker Tim Cruikshank, Assistant to the City Administrator, stated that a job placement ad was placed in the paper advertising a Maintenance Worker position to fill a vacancy created by the passing of a City employee. After completion of the interviews, the interview panel recommends the hiring of Cheryl Sutton as Public Works Maintenance Worker in the Streets Division. Cruikshank commented that the City of Mounds View is the first metropolitan city to hire a female public works maintenance worker and that this would help establish a female dominated class of employees in this department. MOTIONLSECOND: Quick/Trude to Adopt Resolution No. 4458 Approving the Hire of Cheryl Sutton, Public Works Maintenance Department, Streets Division VOTE: 5 ayes 0 nays Motion Carried snowfall. Mayor Linke extended congratulations to Cheryl from the City Council as the new Maintenance Worker in the Streets Department Consideration of Approval to Paint the Water Pipes and Floor at t_he Booster Station • Mounds View City Council Page Six Regular Meeting December 13, 1993 Mike Ulrich, Public Works Supervisor, explained that the paint on the piping and flooring at the Booster Station was blistering and flaking. Ulrich explained that staff had received a bid from the contractors, New Mech, that is performing the Water Treatment Plant renovation in the amount of $4,641.00. Staff stated that this is a quality bid and would like to utilize their services while they are here working in the City. In addition, Ulrich explained that the .Booster Station is in dire need of a. new dehumidifier to keep the condition from happening again. Staff requested an additional $1500 to purchase this dehumidification equipment. The total requested amount to be charged to the Water Department is $6200. MOTION~SECOND: Trude/Wuori Approve the Painting of the Water Pipes and Floor at the Booster Station and the Purchase of a Dehumidifier for the Same Booster Station at a Cost Not To Exceed $6200 to be Charged to the Water Department Contingency Fund VOTE: 5 ayes 0 nays Motion Carried E. Consideration of Resolution No. 4460 Regarding Amendment to Development Agreement 92-97 Paul Harrington, City Planner, reviewed Staff .Report No. 93-1014C MOTION/SECOND: Quick/Trude to Adopt Resolution Authorizing the City of Mounds View to Execute An Amendment to Development Agreement No. 92-97 regarding Resolution No. 4460 Amending Development Agreement No. 92-97. Harrington explained the amendment which is two building permits be issued on two specific properties to be referenced by lot and block number and that final completion of all improvements on the project (excluding homes) shall be made by July 1, 1994. VOTE: 5 ayes 0 nays Motion Carried F. Consideration of Approval of Resolution No. 4461 Rescinding Resolution No. 423.5 and Establishing a Uniform Schedule of Fees and Charges for 1994, Exhibit A Samantha Orduno, City Administrator, explained that this resolution is revised annually and updated as needed. Councilmember Blanchard - Councilmember Blanchard reported that Tim Cruikshank, Assistant to the City Administrator, presented the Council with new Municipal Code books and stated that now they can begin to revise them. b. Councilmember Quick - No report. c. Councilmember Wuori - Wished everyone a Happy Holiday Season. • d. Councilmember Trude - No report. 2. Report of Mayor Linke: a. Mayor Linke thanked all who attended the budget hearings. Mayor Linke reported there were 61 people and 47 households in attendance. Linke stated it was a very positive meeting. 3. Report of Administrator: There is a possibility that the City may loose more than $46,000 in local government aid. 4. Report of Staff: Tim Cruikshank gave a brief report on the building expansion . 5. Report of Attorney: No report, not in attendance at this meeting. Mayor Linke announced the upcoming Council Meeting Dates.
