AGREEMENT FOR REIMBURSING MINNESOTA HIGH4 °1AY DEPARTMENT FOR LABOR AND EQUIPMENT
FURNISHED DURING THE CIVIL DEFENSE E ERGENCY RESULTING FROM STORM OF MAY 6, 1965.
THIS AGREEMENT made and entered into by and between the State of Minnesota
acting through the Commissioner of Highways, hereinafter referred to as the "State ",
and the Village of Mounds View , hereinafter referred to as the
"Municipality ", Witnesseth:
Pursuant to Sections 12.37 and 160.21 Minnesota Statutes annotated, repre-
sentatives of the aforesaid ?Municipality requested the Minnesota Highway Department
to furnish labor and equipment, as required, to remove debris from any and all
roads and highways (other than Trunk Highways) under the jurisdiction of the
Municipality and to otherwise restore and maintain said roads and highways in a
passable condition after the storm of May 6, 1965.
The State will furnish said labor and equipment for storm clean up work
on said roads and highways as so requested, provided, however, that said men and
equipment shall only be furnished by the State hereunder in the event that in the
opinion and judgement of the Area Maintenance Engineer, whose decision shall be
final, said men and equipment are available therefor without impeding or affecting
the need and use of the same on the State Trunk Highway system.
The Municipality agrees to reimburse the Trunk Highway Fund for the cost
of furnishing said labor and equipment in the manner and extent hereinafter set
forth:
1. The State will prepare and submit to the Municipality an itemized
statement showing total labor and equipment used in said storm
clean up work on and after May 6, 1965, until the official of said
Municipality, in charge of said roads and highways, advises the Area
Maintenance Engineer of the Department of Highways at his office at
2055 Lilac Drive North , Minnesota, that the State's assistance in
