2. Reimbursement shall be made on the basis of the actual time records
kept by the State and the hereinafter described rates plus ten per
cent of the total charges as an allowance to cover all direct or
indirect overhead charges, except the actual cost of workmen's
compensation for the State's regularly employed forces, an amount
equal to the actual cost of workmen's compensation for said State's
regularly employed forces which engaged in said clean up work shall
be added to said invoice or statement.
3. The hourly charge for labor used on the aforesaid clean up work will
be the rates set forth in the Minnesota Highway Department memo
dated June 24, 1963 establishing Paintenance Labor Cost Rates to be
used effective June 26, 1963 in the computation of Maintenance Labor
Costs. A copy of said memo is attached hereto as Exhibit A hereof.
4. The hourly or mileage rates for equipment used in said clean up work
will be at the rates set forth in a Minnesota Department of Highways
Schedule effective November 11, 1964 establishing equipment rental
rates for State Owned Equipment. A copy of said schedule is attached
hereto as Exhibit B hereof.
The foregoing is the mutually ascertained cost per hour for the furnishing
of men and equipment hereunder. In addition to said ascertained cost the muni-
cipality further agrees to reimburse the trunk highway fund of the State of
Minnesota for all other and further costs or expense of any kind or nature what-
soever arising out of the furnishing of said men and the operation of said
equipment hereunder, and without limiting the general effect of the foregoing, it
is further agreed that said costs and expenses shall include but not be limited to
such costs or expenses as may or might arise out of any accidents causing injury
or damage to equipment.
