Deputy Clerk read legal notice and attested to its publication in the New Brighton Bulletin October 17 and 24. Hearing previously held September 23 for same request. Legal: Parcel (1) except the N 150' of Lot 59, Auditors Subdivision #89, R1 (residential) to R3 (multiple dwelling). Parcel (2) except the W 100' lying Northerly or Southerly 514.63' of Lot 58, Auditors Subdivision #89, B3 (general business) to R3 (multiple dwelling). Project includes two 23 unit and one 17 unit apartment building, pool and garages. Petitioner Dan Vaughn presented petition for the rezoning signed by over 60 residents of the area. Mayor asked if anyone in audience for the rezoning. Robert Eigenheer, Andrew Simon, Chuck Larson. Mayor called for objectors. None. Hearing closed at 8:50 P.M. MSP (Johnson /Malvin) To grant the rezoning. 4 Ayes David Yurkew, a tenant in the Siwek Apartments, inquired as to whether the buildings had been checked and approved by the inspectors. Council replied yes and the Village is responsible for upholding the codes originally. Other tenants desired knowledge on personal recourse against Siwek who supposedly has ignored tenant requests for improvements. Siwek was meeting with inspectors and fire chief this evening to discuss remedies against fire problem caused last Saturday. Asbestos will be tried under furnace. Jerry Scott in favor of asbestos. Also stated heater flow backwards. Inquired as to who determines who will insect for the Village. Desires better building inspector. Would like it reinspected. Electrical inspector rebutted criticism and was defended by fire chief. Mayor asked for written reports from all inspectors. MSP (Lang /Johnson) To authorize reinspection of Siwek Apartments. 4 Ayes MSP (Malvin /bang) To approve final plat of Feige Addition and to authorize the Mayor and Deputy Clerk to sign. 4 Ayes Anthony Holchuh showed Council new preliminary plat. Ken Ballenger and Mrs. James Borofka inquired into contractor working all night on 35W. Road belongs to contractor until turned over to the state. Clerk's office to write letter to Barton Contracting Company requesting some consideration be given to installing a temporary light at Pinewood and TH8, placing additional signs on the bypass, and alleviating some of the noise after normal working hours. Mayor Rustad's Report MSP (Rustad /Malvin) To order the installation of a street light at Adams and Groberg streets. Petition received. Mayor read Planning Commission minutes of October 15, 1968. MSP (Johnson /Lang) To approve square foot variance for Rocket Development Corp. to construct an apartment building at 59- 0080 - 080 -29. 4 Ayes 3 Ayes Rustad Abstained Discussion followed on whether our square footage requirements are too stringent. Planning Commission to be notified to take under advisement. MSP (Johnson /Lang) To approve plans and specifications for Towns Edge Terrace Mobile Home Park. 4 Ayes
