Total abatement $348.15. Attorney Meyers presented a subdivision filed by F. N. Shaffer Realty Company, George Gustafson agent, which called for an additional assessment. MSP (Johnson /Hodges) To approve the subdivision of Lot 72 Spring Lake Park Hillview Addition subject to the signing of the additional assessment agreement or the payment of the additional assessment. The attorney presented a resolution releasing certain easements on Lots 1 -8, Block 1 Parkview Terrace. Easements are utility and drainage easements which no longer are necessitated. MSP (Rustad /Hodges) To rescind Resolution #428 previously passed abating easements in Parkview Terrace. MSP (Rustad /Johnson) To approve Resolution #435 vacating, releasing and discharging certain utility and drainage easements in above mentioned Parkview Terrace on said Lots 1 -8. Attorney Meyers presented his resume' of senate file #237, Metropolitan Sewer Bill. Attorney Meyers also read a memorandum regarding public hearings relative to rezoning. In essence it stated the Planning Commission may hold public hearings but if this is the case the Council should act as an appeals board so that no one is denied their rights under the due process clause of the constitution. Mayor Rustad stated that at the Planning Commission meeting of January 21st the Planning Commission had recommended to issue a special use permit to Mr. William Gillespie to sell cars at 2045 Highway #10. The Council advised that the Planning Commission should readvise Mr. Gillespie to either attempt to have the property permanently rezoned or to drop the matter. That a special use permit could not be issued since the property is zoned R1. 5 Ayes 5 Ayes 5 Ayes 5 Ayes MSP (Johnson /Malvin) To approve Ordinance #163 rezoning all property in the Village of Mounds View presently zoned shopping center S -C to commercial B3. 4 Ayes Blanchard Naye Engineer Boehm's Report Engineer Boehm presented the proposed plat for Dailey Homes. Daileys Red Oak Plat Estates contained eight lots. Engineer's office has corrected the previously incorrect legal description on the proposed plat. MSP (Hodges /Johnson) To approve the preliminary plat for Dailey Homes Inc. Subdivision is South of 8290 Red Oak Drive. 5 Ayes Engineer presented plans and specifications for Street Improvement Project 1969 -1 continuation of Sewer and Water Improvement Project 1968 -2 Parkview Terrace. The engineer also presented specifications for the improvement of Well #1. Well in general is lacking pumping capability which it originally had when it was first installed and the Council had felt that the pump was in need of a general overhaul. MSP (Hodges /Johnson) To approve plans and specifications and to set the bid date for 12:00 noon February 24th. 5 Ayes
