Engineer Boehm's Report 3 Ayes MSP (Malvin /Blanchard) To approve Change Order #1 for the repair of Well #1. Adjusted contract price $4,936.00. 3 Ayes MSP (Rustad /Malvin) To approve Change Order #1 for 1968 -3 Schedule A. 3 Ayes MSP (Blanchard /Malvin) To approve Change Order #2 for 1968 -3 Schedule A. 3 Ayes MSP (Malvin /Rustad) To approve the final payment for Aamot Well Company for Project 1968 -3 Schedule A, check #3224 for $3,343.50, and to enter into a one year warranty period. Completed contract price $14,998.50. 3 Ayes Engineer Boehm suggested that the Council consider routing the water mains for 1968 -3 to conform to the street pattern in the Pinecrest Properties project. Engineer Boehm also reported that none of the test wells for 1968 -3 Schedule A were satisfactory. Rezoning hearing called to order by Mayor Rustad at 8:30 P.M. Clerk Zylia read the legal notice and attested to its publication in the New Brighton Bulletin April 3rd and 10th. The South 300' of Lot 61 Auditors Subdivision No. 89. Rezone from R1 (Residential) to B3 (Commercial). Mr. Gillespie, petitioner, spoke on his proposal to sell used cars and do minor repair work. The following persons spoke against the rezoning: Mr. James Gable, 7934 Fairchild - would destroy property value. Mr. Arnold Scholljergerdes, 7950 Fairchild- object sane reason, and can't get FHA loans. Mr. Robert Larson, 7960 Fairchild - messy, buffer not adequate. Mr. Jerome Rickard, 7980 Fairchild - object same reason. Mr. Robert Shelquist, 8025 Fairchild - village planner said residences should be protected, this is spot rezoning, no opportunity to buffer it, :. Mr. Palmer Larson - used car lot detrimental. Mrs. Robert Shelquist - would set a precedent on Highway #10, single family residences must be protected. It is up to Gillespie to accomodate people. Mayor Rustad closed the hearing at 8:25 P.M. No formal action can be taken at this time because only three members present and a 4/5s vote is needed. Councilman Blanchard commented that he would vote against. Councilman Malvin had no comment. Mayor Rustad stated he would go with the people and deny the rezoning. Robert Eigenheer asked about the extension of LaPorte West of Red Oak Drive.
