HomeMy WebLinkAboutgr00090_000025_pg037Attorney Meyers' Report Attorney Meyers stated that he received a notice of hearing for June 24th in which the Metropolitan Council is determining the sewer service areas. He also stated that a request by Red Oak Estates Development et al to have their case advanced in District Court had been turned down. The Court felt the case involved land speculation and had no irreversible harm so the matter was denied. Attorney Meyers stated that there will be two school assessment appeals coming up for hearing on May 20th, and that one which was scheduled to be heard May 21st was dismissed. A letter of intent on flood plains was referred to the office. Attorney Meyers stated he had received a call from Ery Herbst requesting action to obtain a 30' easement off of the East side of the Edgewood School property. The Council felt that Mr. Herbst should contact the School Board directly to obtain their feelings on the easement. MSP (Blanchard /Hodges) To approve Ordinance #175 establishing the street name of Ardan Avenue. MSP (Malvin /Hodges) To approve Resolution #480 establishing a parking restriction on one side of Ardan Avenue between Red Oak and Groveland Road. Attorney Meyers presented a $5,000 check from State Auto Insurance and $500 in checks from the Emerald versus Mounds View case award. Engineer Boehm's Report Engineer Boehm stated that he had ascertained that the property requested by the Spring Lake Park Lutheran Church on Ardan Avenue is approximately a quarter acre. The Council is to consider which action they want to take on releasing all or a portion of this land to the Spring Lake Park Lutheran Church. Engineer Boehm stated that he received a request to determine the proper align- ment or stakes for the Erickson Road walkway and he found that the easement is in the proper place and that a 12' strip North of the easement belongs to Mrs. Erickson. Engineer Boehm gave a brief progress report on Improvement Project 1968 -3. The Council discussed back washing and whether it is being disposed of correctly into the sanitary sewer system or into the surface water drainage system and then into Rice Creek.
