Rezoning from R1 to B3 legal description: E 410' of Unplatted Lands, ex Red Oak
Estates, the following: N 3/4 of NE 1/4 of SE 1/4 & N 3/4 of the E 1/2 of the
NW 1/4 of the SE 1/4 (Subj to rds) in Sec. 7, T 30, R 23. Special use permit to
construct town houses legal description: Ex E 410' and W 790' of Unplatted Lands,
Ex Red Oak Estates the following N 3/4 of NE 1/4 of SE 1/4 of N 3/4 of the E 1/2
of NW 1/4 of Sec. 7, T 30, R 23.
Clerk Zylla stated that the legal notice was published in the New Brighton
Bulletin on January 13th and 20th and fourteen individuals were sent notice of
hearing. He stated that on January 19th a card was sent to these same individuals
advising them that the hearing had been cancelled. The reading of the legal
notice was dispensed with but Clerk Zylla described the location of the area
under consideration.
Councilman Johnson made the following statement. "Mr. Harstad was requested at a
previous meeting to supply to the Planning Commission and then the Council certain
information relative to soil conditions of the proposed site for commercial
development. Mr. Harstad was also asked to supply other information that would
aid the Planning Commission and Council in its deliberations.
The minutes of the January 18, 1972 Planning Commission meeting indicate as
follows: "Keith Harstad not here. No action taken." In view of Mr. Harstad's
failure to appear at the January 18, 1972 Planning Commission hearing and in
view of the lack of information presented to the Council I move
MSP (Johnson /Pickar) That the hearing for rezoning and special use permit
requested by Mr. Harstad be terminated and that he proceed to reapply for
rezoning and for special use permit pursuant to our zoning ordinance."

MSP (Hodges /Johnson) To adjourn the hearing at 8:38 P.M. 5 Ayes
Mr. Harstad stated that he had forgot about having to attend the Planning Commission
meeting since he had been there previously. (Refer to Council minutes of Dec. 13th.)
Mr. Harstad was present at the hearing, did not object to the Council action and
left the hall shortly after the hearing was adjourned.
MSP (Baumgartner /Johnson) To delay action on expansion at the maintenance
building until the Council has a further chance to reach a decision among
themselves as to the space needs of the maintenance department.
Jerry Blanchard and Gerald Fields were invited to attend the next agenda meeting
to discuss their space needs relative to the Boy Scouts and the Civil Defense
respectively.

MSP (Hodges /Pickar) To adopt Resolution #562 apportioning the assessments on
Division #44315 Chapman Addition. 5 Ayes
MSP (Neisen /Johnson) To waive the requirement of Ordinance #192 known as the
Personnel Ordinance that comp time be taken within two weeks after it is earned
for Gary Korf so that he may accumulate enough time to go to the League sponsored
Minnesota State Fire School on April 24th through the 27th.
MSP (Johnson /Blanchard) To authorize Attorney Meyers to review the file accumulated
by Clerk Zylla relative to the Irondale Road water assessment which has been
challenged by White Oak Builders and of which they are currently in arrears
totaling $1,500 from a'previously agreed upon amount.
