HomeMy WebLinkAboutgr00090-000030_pg122-2- MSP (Hodges- Baumgartner) To recess the regular meeting at 8 :31 P.M. 5 Ayes Mayor Neisen called the rezoning hearing to order at 8:31 P.M. to consider the request by White Oak Builders to rezone from R1 (single family) to Bl (limited business) the South 186' of Lot 96, Knollwood Park Addition. Clerk Zylla read the legal notice and attested to its publication in the New Brighton Bulletin November 16th and 23rd. Edwin Dropps, partner in White Oak Builders made the presentation. He stated that the proposed building would be 701 x 28', would generate approximately $3,000 in taxes, and would contribute no children to the school district. He stated that the property across the street is zoned commercial at the present time. Mayor Neisen opened the hearing to the public and called for questions or comments from the floor. Mrs. Barbara Haake, 1740 County Road I asked if there was parking provided up to the property line on Silver Lake Road, Mr. Dropps replied that the parking lot as presented on the plan was up to the boulevard. Mrs. Haake felt that a buffer should be provided between the property line and the parking lot. Mrs. LeRoy Valley, 2016 Woodale asked where the homes in the area lie in relation to the proposed building. Mr. Dropps referred to a map noting that there were homes on the South, North, and Northwest of the proposed building. Paul Winther, 2049 Woodcrest Drive presented a petition signed by ten residents (five { nilies) against the proposed rezoning. Mrs. Paul Winther stated that she was against it. Mr. Winther quoted a number of permitted uses for B1 zoning taken from Ordinance #67 and stated that he did not ;cant: an office building and a parking lot in his back yard. Mr. Valley asked why Mr. Dropps did not want to build a home on the site.. Mr. Dropps replied, no reason other than Silver Lake Road is a busy road and he has a large special assessment on the property. Mr. Dropps stated that he presently is using 7090 Silver Lake Road as a model home. Mrs. Valley replied that there is someone living upstairs in the model home. Mr. Dropps replied that he did not think it was in violation of the Ordinance. Mrs. Valley felt that the traffic on Woodale is bad now with the model home. She did not want her back yard exposed to a proposed office building. Mr. Winther stated that the police have had numerous traffic problems on Silver Lake Road. He felt any access to Silver Lake Road from the proposed parking lot would be hazardous. Mrs. Barbara Haake declared that the area East and West of Silver Lake Road, North from Rice Creek is all residential now and that a house could be built on the proposed office building site. t uncilman Baumgartner inquired whether the proposed office building was in fact across om commercial property. Upon checking the map, Mayor Neisen stated that it was zoned R1 across the street. Councilman Baumgartner also asked if Mr. Dropps had commitments to rent.
