Conrad Dumke inquired if the law says only the persons in the drainage area
should pay for this. Mayor Neisen commented that it's an area problem and
only the people in the area pay for it.
Mrs. K. Larson of 2401 Sherwood Road questioned the $15,000 cost for conduit
and the $1,000 for cleaning out the ditch. Why not clean the ditch out - she
would get a shovel and help, and then tar the bottom 2/3 of the way up.
Engineer Bearden stated these were two alternatives, two extremes of procedure.
It wouldn't be easy to put tar under water.
Delores Fehlderg speaking for Nellie Dormeier felt it was the builders fault
and since the Engineer couldn't guarantee either of these procedures would
work perhaps sump pumps could be installed to take care of the problem. She
asked the Council for suggestions to solve the problem.
Mayor Neisen stated the Council did not want to dictate to the people. This
was just an informational hearing.
John Lauterbach of 8193 Eastwood Road asked what they would recommend to
solve the problem. Engineer Bearden replied to lower the water table. This
can only be done by putting in storm sewer.
Builder, Vic Loeffler said he had built 15 homes and they were high and dry.
These in question were built too low.
Mrs. Wayne Depew, 2385 Sherwood Road stated they had a sump pump for 1 year
which kicks in every four minutes, but it doesn't do the job. A resident
inquired of Mrs. Depew where the water is coming from. She stated through the
floor.
Conrad Dumke asked why the Village doesn't demand further study before issuing
a building permit to show that there will be no water problems in the future.
In another village where he built, he had to go back 100 years and research
to show proof that he wouldn't have water problems in the future.
Attorney Meyers read from the Statues, Chapter :429,the law on assessment of
fees, stating assessments were only levied on benefiting property owners.
A resident inquired if the houses could be raised. The attorney stated
municipal money couldn't be used to raise private homes.
Mrs. Lauterback thought the builders should be responsible. She was informed
that after one year the builder is off the hook.
Ole Bacon reported that the condition he had complained about previously is
now correcting itself. He doesn't feel it's always the fault of the builder.
Joe Christy, 2365 Sherwood Road remembered the slew until the sewer was put
in. He wondered if a street had been put in somewhere without a culvert that was
holding up the water.
Attorney Meyers reassurred the audience again that this was strictly an
informational hearing. The storm sewer may eventually have to go in the
north area to open the Village up.
