They both thought that it was a welcome addition to the community. Councilman Baumgartner asked if they were going to blacktop the parking lot and if the fire department had checked it. Mr. Miller stated, yes, it would be blacktopped and the fire department will designate where they want their hydrant but haven't determined exactly where yet. Councilman Baumgartner inquired regarding parking, and Mr. Miller replied that the PAK Co. will allow them to use their parking lot for certain events. Bud Teslow, 7932 Fairchild, asked where exactly it would be located. Mr. Miller replied that it was the vacant lot behind the PAK building on the east side. A group of investors from Indiana own the house directly to the east of the PAK Co. Richard McFarland stated that all tennis courts seem to be in the south, and it is tremendous that we will now have one in the northern suburbs. Mr. Miller, in reply to a question regarding their hours, said that it will be what the people want. The indoor courts could stay open 24 hours. Councilman Baumgartner asked him if he had received a copy of the city's fencing and screening ordinance? Mr. Miller replied that he went over this quite thoroughly with the Planning Commission and that the Commission granted them a 10 -foot fence with a 32 -foot variance. Donald Borgen inquired as to why they decreased the side yard setback to 24 feet, and Councilman Shelquist replied that we have under consideration a new zoning ordinance and that this would conform to that. MSP ( Shelquist- Hodges) to grant the special use permit to Roland Miller for construction of a tennis court per plans presented and approved by the Planning Commission, subject to issuance of a building permit and entering with the city in a development contract setting forth the stipulations for construction of the facility and posting of bond for performance, and authorizing the administrator to negotiate a construction contract. Mayor Johnson spoke in favor of the motion, from the standpoint that he thought it would be a very good addition to the city and explained that Mr. Miller could negotiate with the staff the various points that the Council would want in the develop- ment agreement. Administrator Achen stated that the developer will have to prepare detailed plans on what is discussed and go to the Planning Commission for final approval and then back to the Council, and at that time the contract can be executed.
