We have to assure that the house is removed without imposing too stringent conditions upon the property owner. Planning Commission recommended July 1. Mayor Johnson inquired as to whether he would enter into a develop- ment agreement with the city and a bond, so that the city can be assured that it will be removed. Mr. Buzzel said that had not been raised before so we haven't given it any consideration. Mr. Sakariason has been waiting on the outcome before he relocates. The whole thing is conditional upon the approval of the subdivision. He is assured that I have a buyer and he has received a down payment. Mayor Johnson explained that the only reason we have a bond is to act as an impetus to make sure that you have the home removed by July 1. Mr. Buzzel said that he would agree to that. Atty. Meyers stated that the Council cannot approve a subdivision that creates a violation of our subdivision ordinance. Admin. Achen asked if the contract could be made airtight to meet the city's requirement so that the sale can go through prior to the filing of this plat. Approval would be on the condition that the buildings be removed. That way you would protect the buyer, the seller and the city. Atty Meyers stated that he could only envision a development contract and posting a bond for an agreement where the city could go in and demolish the building. Mr. Buzzel stated that they hoped to break ground on the 25th of this month. The buyer's home is already sold and the financing of this new home has a deadline of July 1. If it isn't granted he cannot get a building permit which would hamper building of the home on Lot 1. MSP (Johnson- Hodges) that we approve the major subdivision of Selmer Sakariason for property on Sunnyside Rd. between Ardan Ave. and County Rd. J, subject to the home being removed on the proposed Lots2 & 3 and the garage being removed on Lots 3 & 4 prior to final approval of the proposed major subdivision and the recording thereof. A roll call vote was requested. Councilman Shelquist - aye Councilman Hodges - aye Councilman Baumgartner - aye Councilman Pickar - aye Mayor Johnson - aye MSP (Shelquist - Pickar) to adjourn the special hearing of Selmer Sakariason at 8:45 p.m. 5 ayes 5 ayes Mayor Johnson called to order the public hearing on the updating of the Mounds View Comprehensive Plan at 8:46 p.m. The public hearing was then recessed and the Council went back to the regular Council meeting to hear more citizen requests.
