Councilman Shelquist stated that he dislikes the situation but will
go along with it that way. He would like it referred back to the
administrator to negotiate with the Rosenquists to replat the land,
including Outlot A; in addition getting proper wording on the deed
that Outlot B would have the restriction in the title "abatement
of the assessment for two years or some reasonable time ".
Councilman Baumgartner stated that he agreed with Councilman Shelquist.
He would also suggest that Outlot B be made an outlot and hope that
he negotiates with the land owner. Have Outlot A as discussed before
and leave Outlot B as it is and not have it as being deferred as the
interest probably cannot be waived.
Acting Mayor Hodges stated that this should be referred. He agreed with
the lot splits, but something should be worked out for deferred
payments.
Atty Meyers stated that there are two issues here: deferred assessment
and whether you want to waive interest.
MSP (Shelquist - Baumgartner) that we `refer the subdivision back to the
administrator for negotiation of terms for a temporary abatement of
assessment and deferment of interest on Outlot B and for negotiating
of Outlot A into the Bonin property.
A roll call vote was requested: Councilman Pickar - aye
Councilman Shelquist - aye
Councilman Baumgartner - aye
Acting Mayor Hodges - aye 4 ayes
PUBLIC HEARING ON LEROY'S ADDITION
Acting Mayor Hodges called the Public Hearing on LeRoy's Addition
to order at 8:50 pm. The Planning Commission recommends approval of
LeRoy's Addition (applicant: LeRoy Johnson) with the requirement
that existing structure be removed from Lot 1 before approval of final
plat. The staff recommends accepting the Planning Commission's proposal.
The two new lots will be provided service from the front underground
utilities.
MSP (Baumgartner- Shelquist) to close the public hearing. 4 ayes
Councilman Pickar stated that he approved of it in concept the way
that he has it. We should run it through the engineer to determine
whether any easements are required.
Councilman Shelquist stated that he approved in concept subject to an
easement on the south lot line being determined necessary by the
engineer.
Councilman Baumgartner stated that the possibility of an easement along
the rear lot lines exists.
Acting Mayor Hodges stated that he concurs.
