ATTORNEY MEYERS' REPORT. Atty. Meyers stated that there was a hearing
on the Dumas assessment appeal and the Judge said that he was kicking
it out since the first judge didn't find any benefit. Atty. Meyers
reviewed the action that had happened with this appeal in the past. The
only recourse is to attempt appeal to the supreme court that both courts
made an error. Atty. Meyers suggested that the Council not take this
appeal any further. If Mr. Dumas ever decidesto subdivide his lot, the
City can pick up the assessments. The difficulty is in catching this
in the future years when the property is developed. The City has no
right to file anything against the deed.
