the existing homestead. There is also an additional drainage easement of 10' on the
north lot line of lot 3 extending to the proposed new back lot line.
Mr. Smith reported that the Fishers have owned the land since 1941, and that what was
once rural land has now become residential, and due to the amount of assessments and
taxes Mr. Fisher has paid on the land, he now feels it is time to sell it.
Mayor Pickar asked if the problems discussed in the Planning Commission meeting had
been resolved, i.e., setback requirements.
Councilmember Baumgartner replied that when lot 5 was made into one big lot, the
variances originally asked for were no longer required. Also, the garage variance
would no longer be required.
Mr. Smith stated that the shed on the property would be removed, and that they are now
seeking approval of the revised plat, which consists of 9 lots, rather than the original
10 lots
Engineer Hubbard reported that Short, Elliot and Associates have some improvements
planned for the area. Administrator Achen replied that the City is asking for a 28'
easement and asked if there would be any problem with property damage.
Engineer Hubbard replied that they would be working within about 14' of the building
and will have to be careful. Mr. Smith pointed out that the original easement was for
10', which was now been expanded to 28'.
Councilmember Ziebarth asked what drainage district the property was in. Engineer
Hubbard replied that it was in SCP5, and that the water would eventually drain south
and go to the Scotland Green basin.
Councilmember Ziebarth expressed his concern that the water from the area would drain
onto the property of the people who already have water problems and recommended that
no development be approved until a decision was made on the drainage project.
MSP (Baumgartner - Pickar) to approve the preliminary plat of the Fisher Addition as
presented on the revised plat plan of 7/27/77 with the condition that if the garage
on lot 5 is less than 5' from the property line that it be moved, and the shed present-
ly on lot 6 be removed and that the lots facing Groveland that will require fill and so
forth before development, be required by the City to have soil tests and grading plans
prior to the issuance of building permits. 3 ayes

Administrator Achen asked if there would be a single developer for the lots involved.
Mr. Smith replied that there would be one single developer. Administrator Achen then
recommended that the City enter into a development agreement on the Fisher addition.
MSP (Pickar - Baumgartner) to amend the previous motion and add that a development
agreement be drawn up on the Fisher Addition to conform with the file, the grading
plan, etc., as required by the City Engineer.

Councilmember Ziebarth asked what the timetable was for development. Mr. Fisher
replied that they plan to start on four lots this Fall and that the remainder would
then be developed next year. Councilmember Ziebarth then expressed his concern with
the speedy development without having a decision on the drainage project. He stated
