Ronald Abiac introduced himself as the district manager for Seven - Eleven and replied that the store at 105th and University Avenue is one of their highest volume stores and that on the busiest days they have had only one or two cars waiting to get to the pumps. He also stated that the lot at 105th and University is even smaller than the one at H2 and Silver Lake Road and that they had not experienced any problems. Councilmember Baumgartner asked if it was located at an intersection. Mr. Abiac replied that it was at a very busy intersection. Attorney Meyers explained that the zoning map does not conform to the Comprehensive Plan because the map has not been updated since adoption of the Plan and the new zoning code in 1976. Jessie Barnes, 7350 Silver Lake Road stated,that he was very much against the gas pumps going in as he felt it would increase the traffic and noise considerably. Less Mills, 7338 Silver Lake Road stated that he was also against the gas pumps for the same reasons. Norm Crosby, 7344 Silver Lake Road stated that he was also against the gas pumps for the same reasons. Don Schapass, 2824 County Road H2 stated that he was also against the gas pumps for the same reasons. Mr. Schaak replied that it was his feeling that traffic would not increase because it is already there and that they would not be bringing traffic off of Highway 10 since there were plenty of gas stations available on 10. He also stated that he had discussed the traffic with a traffic engineer for Ramsey County, who did not find any problems with the intersection since the four way stop signs had been installed. Mr. Barnes pointed out that several gas stations in the area have closed down in the past few years and questioned the need for another. Mr. Schaak replied that the major dealerships are getting out of the business, but that one stop service for both gas and groceries was the future need. Attorney Meyers pointed out that the property is zoned commercial and the Council would be limited in what they could consider in granting a conditional use permit, and that if the conditions they laid forth were met, the courts generally would rule in favor of the request. Mr. Barnes questioned if the present zoning would allow gas pumps. Attorney Meyers replied that it is zoned commercial but that a conditional use permit would be required. Councilmember Ziebarth stated that he was concerned with the amount of turn - around space between the parking stalls and the gas pumps since it was only 25 feet, approximately.
