Mayor Pickar recessed the hearing and opened the public hearing for the rezoning.
REZONING OF SOUTHWEST CORNER OF COUNTY ROAD I AND SILVER LAKE ROAD - DUPLEX DEVELOPMENT
George Payne, 2740 Laport Drive stated that he would like the land rezoned from R -1
to R -2, from single family to two - family, to allow him to build a two family home
with a single family home look.
Mayor Pickar asked if the. area had been subdivided.
Mrs. Kramer introduced herself as a joint property owner with Mr. Fox and stated that
the property had been subdivided.
Jerry Foss stated that lot two had been subdivided and the corner lot was subdivided
at a later date.
Larry Fox stated that he had a legal description of the property that he had received
from Ramsey County, which stated that it was subdivided.
Mayor Pickar stated that the City must have proof of the subdivision before anything
could be approved. He also stated that a public hearing was set for February 13, 1978
on putting in the services for the area and that the plan could be approved tonight,
contingent upon the services being put in.
Jim Celt stated that he owned the east half of lot four and that he would also like
to have his lot rezoned to R -4. Councilmember Baumgartner replied that a formal
application would have to be made to the City before his request could be considered.
Councilmember Ziebarth stated that if the subdivision could be validated and services
provided, he did not see any problem with the development.
MSP (Pickar- Hodges) to rezone the property located at 7664 Silver Lake Road approxi-
mately from R -1 to R -2, contingent upon the installation of services and the
development agreement being executed and that proof of the subdivision be included. 4 ayes

Councilmember Rowley abstained from the vote as she had been out of the Council
Chambers when the motion was made.
Mayor Pickar closed the public hearing and opened the public hearing for North -
crest Park.
