Mr. Loeding stated that he would like to have all the information that is available
and that he could discuss it further with the City Engineer.
Councilmember Ziebarth stated that it was his understanding that any information
that comes to the Planning Commission will be available to the Task Force. Admini-
strator Achen replied that the information will be presented to the Task Force
before the Planning Commission. Mayor Pickar added that the Task Force can find out
what is on the agenda before each Planning Commission meeting and study the issue.
Administrator Achen asked what would happen if the Task Force decides an item on the
Planning Commission agenda needs more discussion before it goes to the Planning
Commission.
Councilmember Baumgartner asked those present on the Task Force if they were speaking
as individuals or as representatives of the Task Force. Mr. Loeding replied that he
was speaking as a member of the Task Force.
Councilmember Baumgartner pointed out that a builder would not build a home that
would allow water to run into the home and that the water will run off someplace.
Mr. McCarty stated that the City has allowed people to build in places where they
should not have and that the City has not helped much in working toward solving the
problem.
Mayor Pickar called the meeting back to order.
Attorney Meyers stated that he had discussed the subdivision with Official Rose
and pointed out that the piece of property has 155' of frontage and one of the compli-
cating factors is that Staff is interested in proposing an east /west road which would
go across Ken Sjodin's property. He added that there have been discussions on a
north /south road but they have been turned down. He added that in 1976 the City
Council passed a resolution requiring the land owners to present a petition of 35% or
more of the property owners requesting a road before the Council would hear the issue
again.
Attorney Meyers pointed out that if the road does go through, the lot would become a
corner lot and thus should be required to be 100'. He also pointed out that the 772'
lot would require a variance and that variances can only be granted when undue hard-
ship is proven, and that Mr. Sjodin could get an 85' lot in.
Administrator Achen asked if Mr. Sjodin would be willing to deed the extra frontage
if the road goes through. Mr. Sjodin replied that he would but that he would not give
an easement without knowing if the road was going in.
Attorney Meyers questioned how Mr. Sjodin plans to get a variance for the lot size since
he would have to prove an undue hardship. Mr. Sjodin replied that there are other 75'
lots which have been allowed. Councilmember Baumgartner replied that hardship would
have to be shown.
Mr. Sjodin added that he has been told the Metro Council is recommending smaller lots
due to the high cost of assessments and homes.

circulation of a petition for a road, with a time limit of 30 days. 5 ayes
Mr. Sjodin asked why his minor subdivision request could not be approved now since
